Six days later, she filed a DVPO at the Victim Assistance of Charlotte, NC I filed her US citizenship application on September 29th, 2023, from that day forward. Everything changed. She didn't pick up her phone for the whole day. It was my mistake that I didn't pay any attention to these red flags. On October 14, I caught her with a man in the park touching his face. It is a long story. I have had 3 hearings. The first two hearings were not good because my first attorney sold herself out. The opposing attorney offered her a position in her firm, so she betrayed me, and I signed a MOJ that wasn't helping at all. The two crocks attorneys acted like they were working, but they didn't do anything. My new attorney has been good. He submitted a motion telling the judge in their hearings the conflict of interest issue. I haven't seen my kids for about 110 days. I have been sleeping in a semi truck since the day of separation. My ex-wife has a boyfriend for a long time. Before my official separation date.

I completed BIPP but the DA won't offer anything besides probation. My ex told the DA that I drove by her job despite me not even being in the city. It feels like the "victim" can say whatever they want and the DA will go with it

Ok my ex cheated I said ima go to her work and make a scene ( cause they guy would vist her there) never did just packed her things. Days go by I get fired (we worked same place ) lose apt and met up once forgave her didn’t ask her back, recently asked for few items since we being civil. She replied with I’ll give it to a co worker give to u, which I reply “ ok,”2 min later lI reply “nvm you need them more than I do” next day cops at my door. Can I fight this . Only time it got ugly was the day I caught her stayed away etc days after trying to heal. Please help

My neighbor falsely accused me of pointing a tool at your child. I have a camera showing my entire action. I showed it to the police but they still filed charges on me. I was wrongfully evicted & I had a hard time getting an attorney.I got a public attorney. I showing the footage To the attorney & my accuser was subpoenaed. she never showed up to court because she lied on her address. My case was dismissed.

Or it could be the complete opposite way. You may get physically assaulted, cops may intervene, ask the person to leave and never take him or her to jail bc they didn’t think anything had happened, person blatantly lies to the cops and they believe it. Then fast forward you find out that this person should’ve gone straight to jail but he didn’t bc you didn’t know your own rights. The reality is that yes! There are nasty, vindictive people out there, but some of us just needed protection and that never happened. You’re focusing on one side only, when there’s tons of victims who never get the justice they deserve.

Unless you're in Virginia... i went to prison on my first ever felony charges. I didn't even live in the state. I was traveling through it. But it wasn't DV. This is a "unique" channel, but everyone deserves a fair trial regardless of guilt.

It's truly disgusting to hear about judges railroading these cases since it can often destroy an individuals life & livelihood. Our legal system being overburdened is not my fault so I should not be denied the opportunity to defend myself & see that justice is done.

At around 6:45 you mention sometimes the judge may have already decided against the pettitioner before hearing the respondent. I don't want to waste the courts time any further than my wife already has with this bad faith filing, but if the judge has already signed off on a hearing (though not an ex parte), and the petitioner gives the narrative & evidence as stated in their affidavit & then some it sure seems odd they would reject the DVRO without hearing at least something to counter the claims from the respondent. After reading these comments it seems much, much more likely the judge would be just railroading the respondent vs rejecting the restraining order.

So, all solid advice here, although I’ll admit I’m much more curious about the personal ethics involved in specializing in DV defendants. Do you need to depersonalize the relationships and cases? Has it changed your understanding of DV over time, and if so, how? Have you ever successfully defended someone only for that to enable worse abuse that caught you off guard? I don’t understand what you mean by “filed.” A court date is set but it hasn’t happened yet, so is that “filed?” I’m the victim and am on his side, the DA won’t talk to me and the state took up a felony charge . Do I go in person to state attorney to persist that they listen to me that the cops tricked me into pressing charges , since they won’t answer me either and all my motions to modify the protective order got rejected by the county clerk’s? I did file to dismiss the case with the court appointed attorney but the sister got involved now And I don’t think she understands that I’m trying to get it all dismissed and he did alienate from her and his family for a reason some years ago. So I’m kind of boxed out

Can you please make a video on the rights of the alleged victim (me) to have info on protective orders? The cops told me they’d only take this drunk veteran in to get help if he “did something physical” despite manyyyy phone calls by myself and neighbors that he clearly needed help. I’m his landlord and yes he did actually put his hands on my neck that day, but I definitely did my part to get the situation to that point because otherwise the cops refused to take him to get help at the VA . I signed the affidavit by the public defender saying what you said in this video - it was a bad night etc (yes we were “involved” the last couple months but he was still always on a lease and had his own space). The cops never told me there was a protective order and it’s been a month and he’s going to trial for a felony in about 1 week , but I am not allowed to contact him nor him me. He’s distant from his family on purpose and so am I from mine and I am in fact assigned a court ordered fiduciary because my family is not bad people , they just don’t align with what I feel is best for me, and I see it a mile away why he chose to separate from his family. Since the courts would not let me communicate with him, and I happened upon his sisters phone number I texted and the 1 sister and now she’s essentially making it even worse because she’s acting like I’m the enemy and I’m not sure she’s equipped to wisk him away (he is schizophrenic which I’m ok with). I’m female and 20 yrs older than him, no kids, and I’d never impose my will on him but I don’t know if anyone has let him know that 1. I didn’t terminate his lease so if the state would drop the protective order he could stay here for as long as he wants to 2. The cops told me they were going to get him help and I was never informed and even now nobody will give me a copy of this restraining order. He was considering a gender transition, myself am an artificial intelligence engineer so I spend my days working from home talking to synthetic humans that I cook up or my ai agent, so already neither of us has a particularly normal life. He talks to invisible people, I talk to synthetic people, I’m probably on the spectrum and he definitely needed help with alcoholism. I just wanted the VA to be able to help him, because when they dragged me in to get help it changed my life 100%, but charging him with a felony after repeated calls to 911 where they refused to get him help and kept pressuring me to evict him or to build a case against him and get him committed was too much . We are in Texas … I’m supposed to get to file pro se but the clerks have rejected every single one of my motions to modify the restraining order or to clarify it. I feel so defeated. I know you’re in cali but I do think this is a very different case and I know they are trampling my rights as the victim and his as someone with mental health, starting from the police dept’s failure to keep this from escalating by taking him to the designated city mental health professionals … maybe I’ll never see him again and that is what it is, this is kind of my last ditch effort

Im going to court for this on the 5th of this month i hade no idea any of this was happening i only found out because my 2nd job background check cane back in i hade a felony charge with a arrest warrant out for me because they sent the court letter to my okd address im wondering if the warrant made it a felony ?

Can a restraining order be made to penalize anyone regardless of the situation? For instance, if the person filing it was the one who is aggressive and destructive? My neighbor called 911 and told them I attacked her. She is now filing a restraining order. The thing is I showed the Police a video of what happened and it was in fact her attacking me*. You can even see her smirking at me when she was lying to the 911 operator about me grabbing her(she doesnt know I have cameras in the area). The video shows me as I backed away from her with my hands in the air. I also have several videos of her destroying my raspberry and blackberry bushes(talking to herself as she stabs at the branches to cut them away), destroying one of my vegetable gardens by crushing my plants with the cinder blocks used in my own compost pile(we are in a land dispute and the compost pile was in an area they claim as theirs). There is another video of her and her husband killing our 19 year old mulberry tree(although I dont think they did it on purpose. They pruned it to death right as it was coming out of dormancy)...but Im getting the restraining order placed on me? I dont go near her, talk to her, or even look at her, her husband, nor her kids. When we see them, we just go back in the house. We are kind of scared of her, she's unstable(her husband even said she was once, in confidence, back when he and I got along. That "she could be vindictive and aggressive". That she "cycles" through emotions. Whatever that means)..and she has (subtly)threatened to harm my puppies.< but I cant prove that. She is a Wealthy Pediatric radiologist and Im a struggling artist. I cant do a long, expensive court battle. *apparently it wasnt a crime for her to grab the hose in my hand use it to push me back and then throw the hose to the ground..I was following a court order to remove my raspberry bush and needed to loosen the soil by watering when she went off on me.

The way you word the beginning is pretty disturbing. You’re taking joy and describing “absolutely destroying” someone at the initial hearing, who very likely is a victim of abuse just trying to get some protection from the court..
