    How is he going to put his daughter's injury on the park owner? He should have been watching her and followed the rules. I hate it when parents use there kids as a money making opertunity. It makes me sick.

      I think they both failed the little girl, I would never let my 4 year old on a 8 ft. jungle gym to start with and would of be there should she fall but also the owner had previously been warned there was more padding needed for this reason and failed to do anything about it. So I see they both should equally be to blame and share in on the bills created by this situation. Had she not been warned earlier then the dad should have been to blame. I bet she has since changed her signs and probably added more padding. If not the next time she should be held 100 percent responsible. Just my opinion.

    Kids have been getting hurt at playgrounds for decades and that is the hazard a parent takes. I wouldn't give him a dime and tell him to better watch his child

      Yeah, he let her play, and he was talking to other parents who are not watching their kids either. I'm a parent, and I hate people like this. Even no signs it's call common sense.

    I always love how Judge Gino explains how the law works and what is reasonable.I always stand near my 2 yo. The 8 yo is fine he can recognise dangers. Even from 1 meter my little still have slip ups. The dangers can be severe with brain injury and it could ruin the rest of their lives. Parenting isn't easy but if anything happens you'll regret not being there to stop it or at least minimising the impact. There two play areas should be gated. It wouldn't have prevented the injury but it would visually show they 2 separate play areas.

    My son broke his leg on slide in our local park. Did I sue? No it was an accident, the park were not responsible. He was on his dad's knee at the time and he moved his leg at the wrong time.

    When my ex who is from Europe said how come the playgrounds stink here I told her everyone is sue happy in this country. When I went there, I realized what she was talking about! Cargo nets, high rock climbing walls, zip lining etc etc. here you would have to sign like 18 liability forms before getting on them lol.

    Kids fall all the time. Unless the jungle gym is broken or falling to pieces then it's on the parents. It's not the owners fault. Might as well put no jungle gyms up if that's the case.

    When I was a teen I lived in an apartment complex and I would kinda keep an eye on the place. My friend (who also lived there) would sometimes go outside on the swings or be inside our apartments. There were parents there who let their kids go to the playground by themself as this was a pretty safe area. One time these two boys got into a little fight and one got hurt. The mom came out and blamed me because I wasn’t watching her kid. I didn’t babysit these kids or ever have responsibility for these kids. We only saw the end of this because we were walking out my apartment which is next to the playground.

    To the father why don't you just buy a house and put your own jungle gym up. It's up to you to keep your child safe. But I am sorry she got injured.

    I would of never of left my daughters at 4 years old alone on a jungle gym especially outside, he is 100% at fault and should of been by her side and would of noticed the signs that said what ages?

    It’s a common jungle gym park,,, it’s parent’s responsibility to look after the kids. Of course MR you can tell your kids which gym is designated for her age. No park that has a barrier for age limit park.

    If he had paid attention to his “4 year old” closely than he wouldn’t be in that situation. Children are so quick to move , almost like squirrel syndrome. You got to be alert at all times.

    I survived metal slides, carousels, swings with no seatbelts, hanging upside down on rickety monkey bars and other kids. It never would be the playground owners fault if I was injured .

    I agree with the ruling. She was only 4 years old and he should have been right by her side as she played on the jungle Jim to insure her safety.

    Dads fault here , who lets their 4 yo on the bigger park . Even if she makes a fuss it’s your job as a parent to say , no! You are too small for the big play structure

    Children have accidents it is part of life. Parents should take responsibility for their children. I would be right beside my 4 year old on any climbing equipment. Even then there can be accidents but parents are there to break the fall.

    I used to take my grandkids to a park like that and had absolutely no idea that it was for two different ages. My grandson who was older than my granddaughter would go on the lower side and my granddaughter was the Tomboy she was always on the higher side, but they were always enough adults there to watch them on both sides or if I was the only one they only went on one side at a time. I never sat on a bench and watched them I always stood by them while they were playing. At least until they got old enough. ✌❤😎

    Obviously yes playgrounds need to be in safe condition BUT the parents should be watching the children and they should be on the right play set. Not to mention we all know kids may get bumps and bruises and breaks.

    i say its not the farther fault at all the women of the park is highly responsible for that dad daughter injury's in that park i feel so bad for the dad and his daughter that park women should have being putting more safer stuff to the park so no kids get hurt this makes me sad that the women of the park wins the case not the dad and his daughter should of win the case and shame on the park women for not keeping the park safe for kids

      I strongly disagree with you Misa, the father should have been keeping an eye on his child. The playground meets the safety standards there for she dose not need to modify it any further.
