The washing machine was faulty and the machine started filling with water and going around. Watch that and see who you think was in the wrong. I think the judge just about got it right. But being a disabled single parent. I blame the parent mostly. She should have been watching her kids. Infact she watched it happen and didn't tell them not to. Pretty neglectful IMO.

  • @johnniemccalister5386

    • @tsgrandma9837
      @tsgrandma9837 Před rokem +20

      Your right, it's not the businesses responsibility to watch your child. However, it is the businesses responsibility to place a lock on a faulty machine which they know works without coins. The owner also knew the machine locked when it started and would not unlock until it finished. A piece of paper with broken written on it is not enough. A parent could have their back turned long enough to pull clothes out of a washer or dryer and this exact thing happen. Mom was at fault as well because she saw her child climb on/in that machine and didn't stop them. I agree with the judge.

      @@Muncho_informationnot watching her child is 100% her fault. But the woman said she knew her kids would climb into those machines as they've done it before. So she should have locked this machine or disconnected it. If she's going to allow kids to run a muck around her business place. They were both at fault. I mean as a single mum of 2 with a disability, I watched my kids like a hawk. I'd have had them help me fold the washing. And they'd have enjoyed it. I would not be letting them run around climbing into washing machines. That's lazy parenting.

      And I did not need to hear that she's a single mother and that they all sleep together and are so close, etc. She tried to portray the laundromat owner as a horrible person, which she isn't, but she could have softened her approach a little. I agree with the judge. She’s not fully responsible, yes she should have been watching them. However the machine should have been shut down or blocked off in someway so a curious child can’t climb inside. The woman could have put duct tape or something else to keep the door shut. The laundrymat is therefore liable because they knew of the broken machine and what it was doing. The mother didn’t know, even though there was a sign. The sign wasn’t specific, so she couldn’t have known what would happen. The owner did. The owner should’ve have been a more responsible business owner. If I saw a sign that said broken on a washing machine, my brain would automatically think it probably just doesn’t work as in turning on. Not that the thing fills up by itself without you paying.

The lock wasn't busted. Those machines are designed for the door to remain locked until the wash completes. The woman was there with 2 kids. The kids area has 2 chairs at a table for kids. That's where those kids should have been. Or at least at the mothers side. I did laundry at a laundromat when my kids were young. I took them with me to do laundry every week. There were no kids play areas. They stayed at my feet sitting on towels on the floor. I took books, coloring books, crayons - stuff to keep them busy ON their towels. I come from the era where parents are responsible for their kids or got kicked out if they didn't keep them in line. The only thing the business owner did wrong was not taping the door of the washer closed. She should have been 20% responsible for the child's medical bills and no responsibility for pain & suffering going forward.

    If the balcony banister was just recently painted he should of checked for rotting. Any time we’ve ever repainted our balcony, we inspected and checked it for mites, and rotting beforehand. I also used to work in the hospitality industry and part of my job was making sure the property was safe structural wise. Because we knew if any of our guest got hurt by a broken floorboard, or carpeting that was pulled up slightly. We were held responsible because it’s our duty to provide a safe place for people to stay and enjoy their vacation. It’s really slumlord like to not make sure your properties are properly maintained, and that they are safe for any of your guests. Agreed. However, the owner should have locked up, (pad lock), the broken machine. I agree with judge on this one. The owner is 60% at fault because it was her property and her responsibility to protect her customer's, (including their children), and herself. The very same thing could have happened while the mother's back was turned taking clothes out of the washer or dryer; which is something you have to do when doing laundry. Broken machines always had padlocks on them in every laundry mat I've ever been to.
      What I do disagree with is the mother saying the owner didn't care. If the owner truly didn't care, she would have tried to stop the man from breaking the window on the machine. She didn't. At the time, she cared less about her machine and cared only about getting the little girl out. It didn't occur to any of them at the time to throw the breaker in order to cut off all power to every machine. The door would have still been locked but the tumbling would have stopped. Those machines should also have an emergency button of some kind for the possibility if this very issue.

      @BathWater0427 I completely agree that dude was cutting corners by painting over rotting wood. I'm just saying you shouldn't just trust that the building you're in is 100% safe. Always check things for yourself and if it falls, then slowly make your way down and call the cops or someone (idk who you would call to call him out on that). Easy thing to avoid getting hurt that badly. Even better, she can record checking everything for her fans to let them know that they're safe being there, so if he were to try and sue her for property damage she has the video that his building isn't up to code.

    In the first case, exactly how did the girl land when she fell? She said her backpack broke her fall, so you assume she landed on her back, but her face, head and hands are all messed up as though she landed face down. I'm a little confused. Did I miss the explanation? Can anyone clarify?

      One option: She said she was showing her backpack. So she could have been holding it in one hand and taking pictures with the other. She could have landed on her front.
      Another option: She said she landed on the wall. If her backpack was on and she landed on the wall she then could have rolled to one side and fallen from the wall

    I’m not saying that something more shouldn’t have been done to better disable the washing machine, but it’s every parent’s responsibility to keep their kids under control. I’ve raised four kids, and taken them to public laundry facilities, and many other places. I kept my kids close by me. The mom said her girls were fifteen feet away from her! That’s too far for anyone to act quickly enough to prevent a disaster!

    Gotta watch your kiddos. Especially toddlers... toddlers zip into things their not supposed to be in like the flash. My kid has me looking around like a crackhead sometimes because it only takes a moment for them to seriously hurt themselves, and they don't have the sense to not do things that WE find obvious like for example... CLIMB INTO A FLIPPING WASHER... so be aware, even if you look like a crackhead 😂. It's okay though, that stage can be exhausting sometimes but it's not forever.

    Why is it her responsibility to have a daycare in a laundromat? She was kind and generous by having a kid center. I’m so confused.

  • @tsgrandma9837
    @tsgrandma9837 Před rokem +3

    The Laundry Mat: That washer should have had a padlock put on it or some kind of locking device so it could not be opened. Mom could have had her back turned long enough to pull clothes out of a washer into a basket and her child could have done the exact same thing. The fact she was folding clothes at the time and she saw her child get up and start climbing into the washer and did not stop folding clothes in order to stop her child is neglect. Anyone who has ever been to a laundry mat knows those machines automatically lock and there's no way to unlock them until they stop, The fact that a sign saying broken was placed on the machine would have been enough warning for me to have a talk with my kids before even starting laundry. So I agree with the judge. 60% the owners fault, for not making sure the machine was secured until fixed and 40% Mom's fault for neglecting to stop her child when she seen her climbing on/in the broken washer.
    The banister case: The only way I could see this being the girls fault at all is if she was standing on the banister and fell off, or leaned over so far that she lost her balance and fell, or she was sitting on the banister rail and fell off. But just leaning against the banister and it breaking because of rotten wood, is in no way, shape, form or fashion her fault. The owner knowing that some of the wood on some of the banisters were rotten, he should have put up caution signs on each and every rail that it had not been inspected and please do not lean against, stand or sit on any railings and if you do it will be at your own risk and any injuries you sustain will be at your own fault.
