Second story : just exchange the names on the containers and she would have chosen the right one. Writing the name and then Do not touch gives double messages, confusing.
Or change the lids if you don’t have pen or in rush to leave , Literally same containers. Or rather than do not touch note put peanut butter,

on the second story, she realized she put the names on the wrong container. why not just switch the names? if she had time to write the note, she had time to put the correct name on the correct container. something seems fishy. i'm surprised nobody brought up this point.

The lids would have been contaminated already. However, she could have easily crossed out the wrong name and explained to the friend as soon as she got to work.

#1 The defendant shouldn't have allowed the plaintiff to put that turkey inside that deep fryer in the first place knowing that she never cooked a turkey that way before. I would have just shown her everything. Always be concerned for your guests safety, no matter how long you know them.
Actually, anybody with a brain cell knows NOT to put a frozen turkey in HOT oil. It's her own fault.

I just want to say even preparing both of the chili containers in the same area she could have dished up the non peanut chili with the same spoon...why take that risk??!!!
The woman had absolutely no business bringing a dish with peanut butter into a peanut-free environment, especially since she knew her friend was allergic. She could have brought sandwiches or something else. It's also highly suspicious that Tanya's name was on the peanut chili. Ms .French was totally careless.
I worked in a frozen fish factory. Nutfree. We weren't even allowed to bring anything with nuts in it into the canteen for ourselves in case of potential cross contamination, because all it takes is a small trace amount to get itself onto your clothing and fall off into the food and someone with a nut allergy buys said product believing it to be completely nut free and your company is sued into oblivion, and someone has potentially died.
This is why food made in factories that do have nuts in them must contain "May contain traces of nuts" or whatever allergen is potentially in said product, because people with severe allergies read these and avoid them to stay safe.
I'm with you 100% with or without knowledge of her friend being allergic, she had no business or legal right to be bringing said dish into the factory, even if just for herself.

One time, my father had told me "When the landscaper comes, make sure you pay him." He came three days later and I paid him... for nothing. My father was peeved out of his gourd and tried to get the money back, all because he didn't say "If the landscaper comes today, make sure you pay him." I was led to believe that he made the arrangements for him to come on a particular day. What a difference one word would make. The same holds true in the case of the turkey fryer. If Mr. Robinson said "Put an EMPTY can on the turkey," there would never have been a $650,000 lawsuit.

I agree with you to a point. The first case: She was a teacher & an adult; therefore, she should have known NOT to put a full can of unopened cold beer in boiling hot oil! The only reason she won was because it happened at her neighbors house and for that reason alone, they were legally responsible.
Second case: This is where I sort of disagree to a point. All Ms. French had to do was change the names on the containers. She admitted to fully knowing she labeled the containers wrong and instead of changing the names, she choose to put Tonya's bowl on top, tape the containers together, and put a "Do Not Touch" yellow sticky note under Tonya's name. All of which took a lot more time than switching the names on the containers and did so fully knowing Tonya had a peanut allergy. IMO, something isn't right about that. Tonya trusted her friend and didn't so much as smell the food before hand. I can also understand why Tonya would think the note was everyone else but her and Ms. French. I could be wrong, but dang if her actions speak loudly to her intentionally trying to harm Tonya. Why else would she not have changed the names out?
Look, if something could cost me 650000 id be doing it with a lawyer.

Second story had my eyebrows looking surprised the entire episode.
How does anyone expect someone to pay these crazy amounts. 😮 Just crazy. But they argue that they thought it would be common sense, but that's definitely arguable. Not everyone has that understanding.😊 But this turkey brings back memories. I was a campout with my gf, and our 2 horses we were settling down and we were going to heat up supper, we put hotdogs and we were going to have baked beans. Not thinking we put the can on the rocks to heat but we forgot to open it and without notice it exploded with beans flying all over. The horses bolted and we had to go after them. The next morning we had to brush out beans from their manes and tails. Poor babies😊

The lady who brought the chilli said that when she made it & was putting it in the containers that she realised that she had put the wrong lid on it but could she not have took the lid of & washed it then put it on the right 1 if she hadn't found her pen then she could have died but the other lady thinks she's overreacting 😡😡

Don't be sorry and why would ppl think your disrespectful? Most people enjoy the smell of food and will often smell it before eating it. I always took it as a complement when anyone smelled my food before eating it. It means they enjoy the smell as much as the taste.

Sorry 6 months late to the party. 2 questions, the Plaintiff said they work in a no peanut facility, so the defendant technically had no business bringing peanuts into the building so isn't that an issue already? Also, why didn't the defendant just switch the names on the containers?
If the container said “Tanya’s do not touch” then it would be safe to say it belongs to Tanya. But the wording is different and I would have waited to enjoy with my friend as planned. She was presuming it was hers.
