      Your missing the point regardless of being there or not. The analysis the law gives states that the electrical wire or units have to be free from causing a hazard. Even if the person was walking along the fence and not trespassing the reaction that causes an explosion can still reach him and that’s the point.

    I totally disagree with this ruling. Not only should trespassers not be awarded for any injuries they get while committing a CRIME, but they should also be arrested. Everyone should know that railroad equipment and buildings (even if abandoned) are owned by the railroad company and unauthorized people are not allowed around them. Even with a hole in the fence, those kids know that they were not allowed in that area.

  • @hiltonlive32grnrngr
    @hiltonlive32grnrngr Před 6 měsíci +2

    The final judgement in this case should've been in favor of the defendant, not the plaintiffs. The kids had no permission or authorization to be on that property to begin with. Plus, he technically even admitted to having seen the "no trespassing" sign by claiming it was "on the other side". So to have known it was on the "other side" you would have to have seen it and ultimately choose to ignore it. So yes, the kid's burn injuries were 100% his own fault and should not have gotten a penny of the $400k he was incorrectly awarded.

    • @lunamelody2025
      @lunamelody2025 Před 6 měsíci

      Definitely true. But at the same, the reason it favors the plaintiff in this case is only because of the hole in fence. There was no evidence to prove the hole was covered or the fence was fixed with a new fencing. There was also no sign to show warning of what could happen to trespassers if they trespass, nor extra security around that spot. For example, Hacksaw Jim Duggan has warning signs for trespassers that if they trespass, they'll be shot on premises. With this case, there is only the authorized personnel sign, but there's no warning sign for trespassers if they were found on premises.

    This was an exciting case, but I'm thoroughly disappointed by the ruling. If these are the kinds of rulings the Court will deal out, then maybe we should turn our attention to Stand-Your-Ground laws. Under Stand-Your-Ground laws trespassers are the perpetrators & whatever befalls them is on them, not the landowner.
    Love His Honor's rulings and his intelligent and compassionate courtroom demeanor, but I would have ruled differently. This ruling was too arbitrary. In my opinion, the railway should have been held liable for ⅓ of the ask, the boy should have been held responsible for ⅔.

    I’ve watched dozens of these videos, and this is the only one that I can say. I totally disagree with the verdict . I highly doubt the Trainyard knew these kids were using it as a film set . The mother is just as bad ( and worse) as the son, condoning this behavior, knowing that he is flunking out of school. There is no parenting going on. She’s looking at the dollar signs that her son could bring home by his videos and now with this verdict. She is the root of the issue with her complete absence of parenting skills in this situation. What kind of future does this kid have if he can’t even make it through high school? High school is not impossible to pass for most kids. It’s just a matter of discipline, unless you have a learning disability, which appears he does not.

    I partially disagree with the judgement, but law is law I'm afraid. The only part of the judgement I can agree with is the literal hole in the defendant's case of the fence. The plaintiff mentioned he and his friends have been doing these stunts for the past couple months, with this railway being the recent target. So that means the hole had been there for multiple days. Or at least 14 days considering the recent fence inspection was at least 2 weeks ago.
    Plus, another problem is there's no warning signs on the property that trespassers will be forced out in some manner. There is the restriction sign saying the property is for only authorized personnel, but that's it. There is no warning sign of forced removal to reinforce that the property is private and restricted. Plus, there's no watchman, surveillance, or any kind of guard to show the place isn't abandoned.

    The woman had documents, evidence and more! They checked their property EVERY TWO WEEKS! How did the boy get 400,000 for trespassing and getting hurt trying to do his Jackie Chan movie?

    So really it's nothing nobody can do if someone trespass on your property and get hurt.

    The kid shouldn’t care about social media and if you get plenty views on your video, he got injured, but he was trespassing on private property. She better hope she has a strong document to back up her story.

    I don't agree with the jury's decision, that child will be harmed a lot more because he was favored and his mother was complacent, she didn't even preach about her son, so we will see that child again in court.

    Heavily disagree with this judgement. I live in nyc where teens ride on top of moving trains that go in tunnels all over bridges. It's stuff like this that make kids think its okay. He shouldn't have gotten anything

    Reminds me of a case where a guy got hurt breaking into someone's house and getting hurt. They actually made the homeowner responsible for the injuries. Btw that wasn't on this show it happened in real life I can't remember what state it was
