I'm sorry but no. 4 years of riding, only riding twice a week does not make you an experienced rider. I have been riding for over 20 years and I can't even count the amount of times I've had falls exactly like that.

Exactly. She's not an experienced rider, an advanced beginner or very low intermediate.

Yes same here! I’ve been riding since I was 7, had all kinds of falls on different horses for different reasons. She’s a spoiled brat who doesn’t want to take accountability and should never be left alone on a horse ever again
And this is why I tell my students that jumping bigger fences takes a lot of skill. Everyone wants to jump big but if you don’t have the experience listen to your coach.
If she is an “EXPERIENCED“ ride with 4yrs. Why does she need a trainer her side?
When you hear ‘trainer’ you automatically go to a teacher of sorts. With horses, the teacher is an instructor, not a trainer. The trainers aren’t necessarily there for actual ‘training’. Yes, they help the rider but they’re also the ones who get the horses ready to work. They also help the rider and horse prepare and maintain a proper exercise regime to compete and show to the best of their abilities. Kind of like a golf caddy. The players are professionals and some with many wins or long careers but their caddy is there to not only help with equipment but also to help the golfer decide how to approach their next shot and give other advice like when and where to take drops or look up rules when an issue arises. (Hope the explanation helps 😊).
Horse back riding takes years/decades to get to a professional level. People need trainers/instructors for the majority of their riding careers.
Because proficiency takes a lot of training. Even the biggest music stars have vocal coaches.

If you watch closely. Right before the horse reacted she pushes her knees in. Pretty sure that’s what caused the horse to react.

You can literally see the horse not having enough speed and is not in the right position/distance - it had space for two lengths after the first jump, and especially without being pushed to make the 2nd jump you are set up for failure.
The rider did not push the horse forward, and she was not in position. This makes the horse refuse because it would not be able to make the 2nd jump mainly due to rider error.
Even if the horse had done the jump, she would have most likely fallen off from sitting still and stiff like that 🤦🤦🤦
I’ve been riding since I was 4 years old (25 now) and I would only class my riding ability as novice/intermediate 🤣 so I dunno where she got “experienced rider” from 4 years
This is so ridiculous! The horse refused the jump and the rider lost balance and fell. She wasn’t “thrown” off the horse. She should have been aware that her trainer was leaving. Paying attention to him as well, listening for instructions and guidance going into the jumps. She is a big baby.
He is the kindest most heartfelt judge I've ever seen. It hurts me when people shout over each other & shout over him.
This judge is pretty lenient on people interrupting when they're trying to tell what happened.. also your honor I I spilled a hot cup of coffee on my leg while I was jumping with the horse and burned my leg 😂
Not having enough time to read the liability form is a bunch of garbage lol they didn't hold you at gun point to sign it. If you didn't have enough time and really cared about what it said, you would wait until you're ready to sign it no matter what they're saying or doing. 😂 I'm just like seriously you should always read what you're putting your name on. The fact that they even entertained that segment blows my mind. Television I guess

This irritates me so much BECAUSE I have worked at MULTIPLE RANCHES with trainers and YES they do have insurance but YES they have every one sign a LEGAL DOCUMENT saying they are not liable for ANY injury because horses are unpredictable the most experienced horses and riders have nasty falls wayyyy worse then this. 4 years of riding IS NOT experienced there are signs posted ALL OVER ARENAS stating that " ride at your own risk! Not liable for any injury accursed on this property!"
When i went dog sledding i had to sign a waiver acknowledging the risk of a moose attack.
First time jumping and thinks a 3’ jump is where she should start.

This is probably a case that's been seen in American courts hundreds of times.
A friend of my aunt was a horse trainer and rode from time to time. He got thrown. He got hurt, but he was lucky and healed.
This has to be scripted. There's no way as an adult with a career that she actually thinks 4 years (and for the last 2, twice a week! :O) is "experienced". I'm 25, 26 in August, and up until last September had horses every moment of every day of that 25 years and I still wouldn't necessarily call myself experienced.
Edit: also she's not able to read her horse. Experienced riders not only expect to be thrown and get hurt (my mom has had over 15 broken bones from horse related injuries and she has ridden her whole life too, that's considered FEW broken bones), experienced riders also know how to read their horse. Riding is communication with your animal.

This is reenactments with actors. Some plaintiffs lose their cases.
I ride horses and sometimes they get spooked; they are unpredictable. Falling off is a risk of riding, horses are animals and can be unpredictable. This lawsuit is ridiculous horseback riding is just like any other sport, you knowingly run the risk of injury.
Question: why don’t any of these businesses have insurance.

I find it funny how the judge threatens to put someone in jail for not letting him speak but never says it when someone lies or makes up false cases and veteran watchers of the show can attest to this I'm sorry but last time I checked that's almost an automatic jail sentence

@thomaschoonhaurai4569 you don't have to be a judge to know that perjury is crime and in many cases you can be sentenced to up to 5 years you don't have to be a judge to know the law

Police do the same thing when they decide if they’re going to give you tickets for small crimes because you’re annoying them, it’s the same concept and it’s perfectly allowed
The acting is horrible. The barn doesn’t exist (if it were a “world class facility” a simple google search would find it, and it doesn’t) the video isn’t of this girl riding, it’s a video of someone else from CZcams. Which that is a real case because they are using someone else’s media to profit on a televised program. 🤓

I’m sorry, but just knowing how to ride a horse, and take care of, changing leads, cleaning stalls, even being around them 4 years, ect DOES NOT make you an expert! She was clearly not experienced, she pinched her knees in before the jump, she was unsure of it and the horse felt this, and bailed like she did. She didn’t know what she was doing, and shouldn’t have been jumping the way she was. Horses are huge thousand lb animals and can be unpredictable! Trainer with her or not, this is not the defendants fault. I’ve always been told, it’s not if you fall off, it’s when. Everyone will fall off at least once if you ride fairly often. Spooks and other factors can definitely can be a factor.
So at the olympics when a horse refuses a jump, who is at fault?

I’ve done horseback riding for about 10 years and this one was pretty obvious. Even if you are an experienced rider, which normally is after at least 3 years of riding, you SHOULD be one with your horse. If the horse can’t jump, then don’t do the jumps. Plus, when you sign a waver, you basically sign away your life and only have yourself to blame.

I think the trainer was partially at fault. When you provide a service, you have to make sure that all equipment is functioning properly and it’s a safe environment. Horses get spooked through no fault landing on a human all the time and that’s the premise of the Equine Law. BUT when another persons actions are the direct cause of them being spooked, they share the blame and responsibility for any injuries. I know it’s hard to control when you think there’s an emergency but had he slowed down just a touch, it could’ve been prevented. To me, that should be considered breach of contract because they failed to hold up their end of the contract due to unsafe conditions.
That jump was too big for a rider of her experience. Not saying she has a right to sue, I’m saying it’s a combination of whose at fault.
She shouldn't have been on the horse if she wasn't aware of the risks, but the trainer was partially responsible because he left her unattended.

Lady knows the basics of riding and thinks she is a pro. I grew up my whole life riding and breaking horses this woman knows nothing. This is absurd you never know how animals may react and loose it. I had a very very well behaved horse take off on me when I was 7 and I brought her under control as a child if you knew what you were doing you would have been fine. When you get on an animal you understand that you can get hurt

The rider is in the wrong, you walk in to horseback riding, you know the risks and you choose to either take it or leave it. The stable is in the wrong because the trainer is supposed to supervise at all time specially when its the riders first time jumping.

@@Chitown-Batgirl Thank you! 4 years is ample time to reread a contract and I'm assuming there wouldn't have been any fees to back out or anything like that. If you sign something it should be assumed you read it through at some point in time. And if you didn't then that's on you.
A waiver signed is a waiver signed. Ignorance of the content is no excuse. Even if you did not read it, you are bound by it. The legality the judge asserted is incorrect. You are bound. Period.

You get on a horse at your own risk. She is just trying to get money because she got hurt. I am sorry she got hurt, but she got on that horse. Also the trainer should not have left her alone as well, so I do think there should have been some penalty on that. That’s just my opinion.

The horse didn't feel it could make the higher jump and stopped the insanity. If humans want to jump over poles and ditches and other objects, let them do it themselves. Ridiculous to force horses to jump over obstacles with an extra amount of weight and trappings on their backs for human entertainment. No sympathy except for the horse.

Rider error 100%- 4 years is not experienced. Placing 2nd in a show means nothing. I've seen an entire class of 3 year old lead line riders all get 1st place....they must be experienced??? This HAS to be scripted, no one can be this idiotic.

She didn't do everything she was supposed to. If you watch her shoulders and weight are pitched forward after the landing from the first jump. she never sits back this allows the horse to turn and run out of the jump causing to lose balance and fall 100% rider error not the horse.
