I love this judge. The ladder was not defective nor did it break, it was simply not used properly. The maker/ seller is not liable.

How many times do we have to explain this🤦♂️ this is a real case that happened in real life.... but these are actors who are acting out what happened in that court.... this case is real the script isn't fake.... they're not just gonna stick a camera in a real court so they'll just hire actors to act out the case....

Why should they ask him what he wants? Its up to him to ask what wants. I'm not babying customers into figuring out what they want. I have other people waiting to be served.

How this case should go was clear from the moment the plaintiff told the court how he was injured. Can't see how he thought it was the manufacturers fault. It would have been obvious it didn't have a shelf when he picked it up.
Nobody discussed how high the fall came from. Osha requires that your waste never exceeds the top. What I viewed was a twelve foot ladder at the Max. For him to tip and be thrown he was using the ladder improperly.

Wrong verdict. Customer service (AKA salesperson) was too focused on getting sale. There should be a standard list of questions for the customer so that they EXACTLY get what they need.

To prove the maker/seller was liable, he was close. He should not have mentioned the shelf, he should have instead focused his argument more on the fact that he mentioned he was a healthy sized guy and he needs a sturdy ladder, to which it was not as it could not support him. Furthermore, phones are not allowed in the courtroom here. The judge has broken his own rule in the courtroom and evidence was secured outside of means. This is unacceptable. That evidence is invalid.
the ladder did work fine for him, problem was he went up to the top with a bucket of paint and a brush and proceded to lean forward instead of going down and move the ladder. hence the ledder tipped forward / sideways and he fell to the ground.

Both sides should had been fined ten thousand dollars each for throwing tantrums like that in court. The guy getting louder so they couldn't be heard then being rude to the judge as well. Idk about you but, if i call customer service i would be very especific on what i want and if thats not what i get i would return. Seems like he didnt want to pay for the other ladder and just took a cheaper one. Also, i would look at the website for pictures to check if its what i need. Seems like he just called and asked for ladder so, he got one. Now leaning on the ladder. Idk about you but, even if it does not say it, it's common sense.

Any person that works with ladders knows to use a hook. You clip it on the paint can handle and then the other end hooks on the ladder rung

He shouldn’t have been holding the can of paint . He shouldn’t have kept from them when asking about ladders that he was a PAINTER !!! He should’ve told him what his job was and what he wanted the ladder for. But holding a can of paint while climbing a ladder isn’t safe !!! It doesn’t make u the smartest person to do that … use common sense. Ask for the ladder u NEED and if they don’t sell it then keep looking.
