    ok, it is NEVER the horses fault.#1. #2 you NEVER get complacent around a horse, always, let them know where you are, touch them as you walk around. She was distracted about her cell phone, and not cautious. Period!

      But the thing is you still have to look at it bye, the other complaints in as well, due to the fact that we don’t know how far behind she was, and on top of that, but the second go, she was literally in front of the horse face and the horse track drowning still kick her in the face while seeing what happened

      I think she picked up the phone and either he saw the phone and got scared or the phone lit up and he got scared and kicked. I would have moved the horse before picking up the phone. She says she knows horses and yet says horses flee and don't kick. 😂

    been around horses her whole life but never learned not to put her face behind one's hooves, plaintiff talked herself out of a settlement by going on and on about how big a horse expert she is and how much experience she has

    I don't even ride horses but I've been around them enough to know you don't walk behind a horse without letting them know you're there and that they could easily kick when startled. Fight or flight goes both ways

    My daughter is now learning how to handle a horse. She always has to touch the horse as she walks around him to let the horse know she is there so the animal would not be startled by her. This is the way to avoid things such like in this case to happen.

    You ALWAYS take caution and gently let the horse know you're back there before going behind the horse. As an equestrian, that is one of the FIRST rules you learn. Even with my horses, being as gentle as they are, I still always take caution!

    I have always been told never walk behind a horse
    They can kick and if the horse can't see you it will make it panic
    I don't go horse riding anymore but I do remember
    The horse is a beautiful horse and it both situation are similar!
    Like when you feed a horse you keep your fingers out of the way and use the palm of her hand it's with all animals if they have teeth legs etc they can use them so be vigilant
    If meatloaf was a aggressive horse the horse would be rearing up on its hind legs and making noises it seems like a lovely horse that didn't get handled the way she should of been
    It's horrible what happened to them but they are around horses just be vigilant at all times

    I dont ride horses but I know you don't ever walk anywhere on their back side or you could get kicked in the face, chest or legs etc and could pass away from head or body trauma. Hello!

    We have a horse. Super gentle. I always touch her and let her know if i'm passing behind her. I'd never bend down behind her, or any other horse.
    I agree with the judgement, but the defendant should have at least given the plaintiff an FYI that the horse recently startled and kicked someone.

    You Never Ever walk behind a horse! If you walk behind the horse, you keep a hand on the horses back so they know where you are, and you DO NOT BEND down, for it scares the horse! Every single one who has been around a horse knoes this. This is the absolute first thing you learn about horses. Do not walk behind them.
    This is her own fault.

    A horse is like a plane propeller. You will never see it coming before it hits you. What was that lady thinking bending down behind a horse to pick up a phone? Total negligence and complacency through normalization of deviance on her part led to her injury. She should now have to pay her for filing such a lawsuit in the first place.

    i took lesson's as a kid and the first thing they told us was not to walk behind them cuz they might kick, i know this cuz after they told me i was too scared to ever go behind them

    I had horse who you give his food, and put down. He then watches you come up and he starts eating.But shake his food or tease him with food, he will give you attitude. Also your approach to a horse place a role. With Arab you get the attitude back.
    Sad hear she got hurt, but you speak to the horse feel the leg down slowly... then pick up your phone 📱

    I have been on different field trips to a farm and stables with horses and stuff like that and they don’t never give no caution with the horses they let us do whatever we want and she was lunchtime. I didn’t let us do whatever we want for another two hours and then it’s time to go home, but what I can say is the fact that one I’m pretty sure she has seen the video of the second one. The lady was in front of the horse, and the horse starts around and kicked her. Their first natural instinct is to run away, then on top of that only way they will kick is if they’re in somewhat of a close of Ireland where they do not feel like they will get out to the point they have to kick you for a distraction and then run.

    It might be common knowledge that horses can kick, but I've been around horses most my life too and they don't always show their true temperament until it's too late to avoid injury. I know the Plaintiff is a horse trainer and was working with the horse a bit, but she even mentioned she had only been with the horse for 4 hours which is not long enough to fully get the horse's temperament down. If the horse was known to kick by the Defendant she should have warned the Plaintiff regardless of if she was a trainer or not because, once again, four hours is NOT long enough for the horse to show it's full temperament.
    I do agree the Plaintiff shouldn't have bent down behind the horse whether to get her phone or not, so at the very least there should be 50/50 of the blame shared.

      Well, if you are a trainer and not familiar with the temperament of a horse, I would think that you would be even more observant of typical commonsense rules pertaining to handling and being around a horse ..... such as, do not put yourself behind a horse.
      As for the second woman, who also identified herself as a horse trainer, her kick came from an unfortunate slip and fall, spooking the horse, with the horse reacting naturally ..... which happened to be a sideways kick. It was an unfortunate occurrence, but a horse is going to do horse.

    Accidents happen. It's part of children growing up, learning risks management and decision making. You cannot blame the playground for your childs injuries, when as the parent you hadnt looked at the play apparatus and thought the risk was too great as to tell your child not to play on it. He can't cope with his guilt. Learn to live with it, part of being a father is deciding if your child is safe . Risk v fun........😢

    The rule don't walk behind a horse is a rule those who don't know enough about horses should follow. For those who have experience it can be done more safely. As scary as it may seem you walk as close to them as possible or far enough away where they can't get you. If you walk close they don't have the power in their kick. It's when your at a distance they can get the power. In this case both ladies who got kicked were obviously not close to the horse when kicked, as they got kicked in the head. The one in video the horse made its own room. However the plaintiff either has to be at far enough from the horse to get kicked in the head or she put herself low behind the horse to pick up the phone, therefore putting herself in harms way and not following the methods of walking behind the house correctly. Being an experienced horse person i can't see how it's not the plaintiffs fault. So judge got it right, in my opinion. Plaintiffv should have taken precautions with the house until she knew it.

    I feel like thier instincts in the wild are to protect themselves and same thing goes for domestic horses if that can’t see you or don’t know where you are behind them or at any angle around the horse of course they are gonna get scared as a lot of comments would state TOUCH THE HORSE AND MAKE YOUR PRESENCE KNOWN!! If your gonna be that close to the horse.
    After watching the other video: I believe the Horse needs more training by a more experienced trainer before putting it out to your clients.

    I do not like horses I feel so sorry for that lady she had to go to the hospital. Horses are dangerous animals. They might look nice but they have an aggressive attitude. You gotta be careful.

    Horses are not wild animals, they've been domesticated for 1000s of years. And horses are never at fault.

    horses are naturally prone to anxiety and stress it is survival instinct to kick and flee the moment they are startle, you never treat a horse like a house cat
    it is not random if in training horses need to be desensitise as the smallest can make them panic

    i Am no expert but watched cartoons when i was young where most of horse scenes ended up with kicking the person behind them
