    The lawsuit is for $100,000,000 and not $400,000,000. Basically, the damages listed here are what we call “compensatory damages”. This means that for various reasons the complaint is claiming that the tortious actions of the defendants have damaged Hans $100,000,000 (in the form of damages to income, harming his reputation, etc.) The compensatory damages are designed to make hans “whole” again, meaning not better off than he was before. The complaint suggests that any one of these 4 causes of action can fully account for the injuries Hans has suffered and therefore can be awarded the $100,000,000. However if Hans is granted relief under one of these claims he will not be granted the same relief under another, because the court will not double or triple compensate him for the same injury.
    In short, the claim says any one of these 4 wrongdoings could account for the full $100,000,000 harm done to Hans, so if we succeed on one or multiple of these, Hans should be granted $100,000,000 to compensate for his injuries.

    I think the biggest reason why this isn't going to go anywhere is that Hans has admitted to cheating. This means that it is entirely reasonable for someone to assume he could cheat since it isn't outside of his character. They could be wrong about it, but they have good reason to believe it possible.
    Edit:A commenter brought up some things that suggest that this might not be how the law works. As such, take what I said there with the grain of salt.. 😅

    • @Toastybees
      @Toastybees Před rokem +6

      Not really how it works. That would be known as prejudicial evidence with no bearing in the current case. Unless he admitted to cheating in every single game except the one in question, the existence of past mistakes is not evidence of anything. Weigh the number of times he has not cheated versus the times he has, he is much more likely based on that to not cheat.
      If you go to court for stealing a car and the prosecution brings up a Facebook post from ten years ago when you were a kid that you admitted to shoplifting, that's not evidence either.
      The fact that he has the capacity to cheat in the past has no bearing on the current matter, that exists in everyone.

      @@Toastybees sure but it would be jury trial correct? So, your credibility is incredibly important in jury trials. If there is proof that Hans cheated more than he admits now then that shows that he cheats and lies about cheating. It kills his credibility for the jury which would make it harder for him to get his money. Unless magnus just settles out of court.
      I could definitely be wrong but that’s my understanding.

      @@Toastybees hmmm... That's interesting bees and toast. So even though he's admitted to cheating in the past, that wouldn't go towards whether or not there's actual malice/whether or not a Magnus was purposely saying something that was false? Honestly, I didn't think about it until you said this but him admitting to cheating in the past only came out after he was accused anyways. So I suppose Carlson would have had to had known that he had been cheating for other reasons. Well, I'm not a lawyer..
      On an unrelated note, I'd be really curious to see Magnus and dude doing like 20 or so chess games in the room that blocks out any signal from the outside. I feel like you couldn't say this scenario that the other guy losing would be a sign that he cheated, but if he really lost. Like really really badly, and he didn't show his usual knowledge of Chess then that might be something else entirely. Still this is all just sort of a "Hypothetical and will never happen" type scenario. Lol
