  • The plaintiff brought his car into the defendant’s shop and insists the mechanic overcharged him and didn’t properly fix his vehicle, so he’s suing. The defendant, a mechanic of 30 years, claims he fixed what he was hired to fix and owes nothing.

    The funny thing about this case is that the plaintiff is a retired detective and came to court with no evidence to back up his story. SMH.

      Maybe he's a "dismissed" detective and that's why. A lot of these people always want to talk about how they used to be a lawyer, they used to be a judge, or they used to be a cop. But there are a lot of them who like to lie and say they're retired but the truth of the matter is they were really fired.

      Well I hate to say it but this is how cops operate. Most criminal cases settle with a public defender that is so overworked they can’t really do a good job. If you just force the person to plead guilty to a lesser charge you never have to present a case.

      It gets worse at 10:10. The plaintiff is a Sergeant. Normally I'm impressed with detectives in TV interviews (like 48 hrs) mostly great honest work and integrity but that doesn't include the plaintiff. Hopefully he was only chief coffee maker for the Lieutenant. He definitely threatened the defendant.

      NYS inspection requires a test drive of the vehicle to access for proper braking or test brakes with a certified brake analyzer. Repair shop was negligent with the NYS inspection as far as failure to test drive.

      ​@@jessejames96there's no proof that they didn't test drive the car. The guy drove the car to the shop and didn't complain about anything having to do with the brakes so obviously they worked on his drive there. He claims it was shaking 300 yd or something like that from the shop but then drove it home 30 MI. He clearly could have happened during his drive home and later he said it started shaking immediately. If it starts shaking immediately as you leave the shop you bring it right back to the shop and then have them test drive it then.

      NYS does not require a test drive. I lived there for many years. They pull one wheel off and look at the brake pads.

    You know damned well that 'retired detective' was trying to muscle the defendant. You pay $1600 for a 13 year old car that 'needs work'? Hell, the tires on my vehicle cost more than what he paid for the car.

    As someone who recently got their mechanic apprenticeship, I'd hate to do business with the plaintiff. Everything he mentioned when it came to repairs didn't involve the wheels, so if it needed new brakes the mechanics could've easily missed it. While the defendants are also shady (it's extremely easy to figure out if you have warped brakes/need new rotors), the guy clearly came in wanting as much free stuff as possible.

      Congratulations !! Awesome achievement. You know people want everything free. Mechanics should have x ray vision in order to see everything about the car. Also, once the car leaves the shop, automatic lifetime warranty because it has to be the mechanics fault. Things don't just break down. Lol 😊

    The Retired Detective/Plaintiff had no written proof on anything. He continued to request for car work, yet had no proof that the Defendant destroyed the Plaintiff's car. I wouldn't trust him, either!

    Sure.. My mechanic does an oil change for free all the time and if he forgets and i have to get my car somewhere else and pay for it, i send him the bill. He actually went to court, stood in front of a Judge and these words came out of his mouth.

    I can't believe that the plaintiff actually came into a courtroom seeking compensation with absolutely no evidence that he was financially damaged. The plaintiff is a former police detective & if he went into criminal court with the same "evidence" that he brought into this courtroom, I would suspect that he wouldn't win his case. On the other hand, most cops who appear in court are usually taken at the word by the judge simply because they are police officers, as though every police officer is an honest & trustworthy individual, NOT, & I think that this former police detective was expecting the same the same unconditional treatment from this judge. Thankfully, she is an entirely "different animal" than her judicial counterparts.

    You can’t damage a good rotor after one drive lol, you also can’t see them unless you take wheel and brake pads off. Brakes are cheap, but you don’t wanna mess up rotor. You hear it grind when you brake, you change brake pads asap. I used to be a very bad driver from 16 to 30 😂, thank God my dad was a mechanic. Parts are cheap it’s the labor that costs you, because it’s a 🤬to do.

    Harvey act like a 13 year old car is automatically a lemon. Some people take care of their vehicles.My last car I bought was almost 10years old. I've been driving it for almost 6 years and I paid 2700. No major issues. Great car Thank God.

    Toyotas, Hondas, Kias are all great cars. I bought a used 2001 Toyota Corolla with 170,000 on it in 2017 for $1300, drove it for 6 years with zero mechanical issues. The exterior and interior of the Toyota started falling apart. Like almost every door handle cracked or broke, the cloth ceiling was coming down, the driver's seat broke on one side but for 6 years I didn't have a car payment and zero mechanical problems and sold the same Toyota for $1000 after putting 70,000 miles on it.

      At 10:10 we find out he was a Sergeant. Hopefully he was only in charge of making coffee. No question he threatened the defendant. Most detectives on 48 hours with Paula Zahn or Peter Van Sant are impressive honest with integrity. This clown is the exception.

    I am a new york state inspector. Theres something i don't like here.as part of an inspection you HAVE to test drive it, you have to take one wheel off, at least. Ehen you take that wheel off you have to check the brakes and thats more then just pads. Even if the pads are healthy id never pass a car with frozen pins. Frozen pins are unsafe. For inspection you look over EVERYTHING as w moral duty AND to CYA cuz when you let stuff "slide" you get people back the next day with BUT IT JUST PAST IM NOT PAYING A DIME. be a good mechanic, and have some pride and thoroughness in your work. Planitiff is a jerk. A serious jerk. He tried to throw his weight around like a jerk.

      Why in god's name would one have to take at least one wheel off? Can't you just test it on brake performance? And a test drive? really? What do you pay for such an inspection?

      @@namnack in NYS, Its $10 for a car that's 2 years old or newer. Cuz that's just a safety inspection, valid 1 year. For a car older then 2 years old it's $21, that's safety and emissions. You have to take at least one wheel off, it's state law as part of the inspection. Think like, if there's a crack in the upper part of the frame you couldn't see cuz the wheels in the way. Or a twisted suspension component you couldn't necessarily feel on a test drive. So ya gotta get your eyeballs on it. I take all 4 tires off after giving them all a Spin to feel for brake hang and wiggle them all to feel for worn components. I feel my customers deserve a thorough inspection, it's one thing I very much do not care if i lose a little book time. Safety's worry it . Usually pays sbout .7 of an hour on average

      @@namnack sorry, didn't answer your question about the test drive. Thats also law, it's part of the procedure, you can look as the NYS inspector manual is available online, it's usually a version or two old but if you wanna get an idea you can look

      @@lewydmusic Hey, thanks for the elaborate response. I guess it's just a very different procedure where I live here in Europe. You might find this interesting:
      Here, inspections/needed repairs take place at regular auto shops, done by mechanics. It's mandatory every once a year.
      When the car is cleared by the auto place, it goes into the system for clearance. Then randomly (1 in 20 cars, say) a government inspector is tasked to do a definitive, additional inspection of the car.
      This does not include the taking off of wheels nor test drives (which seems to be a questionable thing to do, what if you got into an accident and totaled the car).
      It's just a regular inspection involving the breaking, the lights, the condition of the overall carriage and chassis, perhaps emissions, not even sure about that one.
      If inspection fails, it is on the car place and they might loose inspection privileges as a result.
      Guess it's different in China too. :)

      Lol a car as a teen is a luxury. $1600 plus $1600 to do the repairs... that's a better car than my first car was. I had a $500 Oldsmobile and I was appreciative to be able to drive as opposed to taking bus. And it was old car bit it was well worth it for a year driving it at $500. Love your children and bring them up with rules and stability.. that is a good parenting. Cars have zero to do with it!

      @brickstine202 well i am actually the eldest of 9 kids and I didn't have much of a childhood.. my mother gave us away into fostercare to keep new husband and new babies and abandoned us to strangers seperated... my father was alcoholic so he didn't retrieve us from the system either.. my brothers were shuffled to a few homes.. and my sister and i were emotionally abused by our foster mother who played games with our emotions and had us up at 5am daily to do 2 hrs chores before school.. she wasn't all bad but it was tough.. my foster mother had me picked up from highschool with zero notice to be moved out to group home when I stayed out too late the night before with my boyfriend.. my sister had run away... my brothers ended up being molested by a foster brother that was adult in the home.. my mother ended up divorced from new husband and gave those 3 new babies up to be with a new man.. he was abusive to the younger 3 and social services told her to either remove new man from the home or loose custody of the 3... so she chose new man. And ended up having twins by him. I graduated highschool worked and saved money from 16 to 18 while in highschool and moved from group home to apartment of my own when I turned 18. I took in siblings from time to time as an adult and I had 4 sons.. my struggles weren't over... I was diagnosed with cancer at 29 yrs old. I begged my mother to come help me for a couple weeks with my sons ages 1 yr to 10 yrs old while I was on chemo and radiation... she told me she couldn't come help she had too much going on... I lost my brother to heroin overdose that same year.. so many hard times... actually, the car I spoke if above was a bit of help from my dad when I was 21 yrs old and a new mom on my own... prior to that I took bus with my baby. I actually embrace my tough times and got through them with faith and personal relationship with heavenly father and I can see where the hard times have made me who I am and an example for others.. I think parents tend to spoil children these days especially and it's OK to teach them to be appreciative and humble and to take responsibilities... as long as they feel loved and safety that is what benefits children the most. This is why I don't feel buying your teen a $1600 point a to b first car makes one a bad father... most families can't afford to buy new cars for their teens.. and if teen has a car in mind encourage them to get a Lil job so they can pitch in on it and learn from the rewards of a little hard work and commitment.

    NYS inspection requires a test drive of the vehicle to access for proper braking or test brakes with a certified brake analyzer. Repair shop was negligent with the NYS inspection as far as failure to test drive.

    The girl that says "I'm going to assume it was well taken care of" 😂 she's putting a lot of faith in people. So many people neglect their cars and run the crap out of them. Aside from the everyday things like gas, oil changes, brakes, and tires, most people don't worry about anything until a small problem becomes a huge problem. What could've been a $200 repair turns into $2000 repair because it doesn't affect the way the car runs and drives until it's too late. By the time this happens, people claim the car is "junk, or a p.o.s. or unreliable etc" because they skimped on a $200 fix. It became a major issue that gets band aided together to run decent then put up for sale so that someone else can dump the 2k into the work needed to make it right.

    Detective is shady AF. What is scary is that he has likely framed and sent people away. His ego is massive and his IQ is low. Mechanic seemed very reputable. Gave free labor on brakes. Good judgement.

    They scammed this man. He got the car inspected before purchasing “which the judge always tell people to do” their inspection was crap and now he’s stuck with a hunk of junk. They should have told him about these issues prior to purchasing which is what he paid for.

    I believe that the plaintiff would definitely be the kind of person to "threaten" someone, especially considering the job that he's "retired" from. The defendant needs to move...far away...from this thug.
