I think so too. When I started watching this episode I thought I was watching one that I had already seen before because of defendant.
Finally a plaintiff that got 2 warranties so when one didn’t cover the issue with his used car the other did. And he came to court with all his evidence and a witness that he could easily call that could talk to the judge and confirm what was written in the evidence.
I pray he’s been closed down by now.
Wouldnt trust any of the defendants car lots at this point. If he's been on peoples court twice, imagine how many times he's been in regular court! He buys lemons and barely fixes them.
This is why I like her she makes people stand up and take responsibility even when they’re trying to worm themselves out of it
she was wrong , she ordered the defendant to pay for a brand new motor with no miles on it when the plaintiff originally bought a vehicle with a motor that had 96 k miles on it . the warranty only covers repair costs to an old motor , which would be alot less than the cost of a brand new motor .
Finally a person that was sold a lemon car by a scammer wins! I feel soo bad when ppl get played out of their money and can’t get their money back. Good thing he got a warranty! 🙏🏼
Wasn't a lemon. Lemon is on NEW CARS. This was just a dumpy car that went bad within the first 30 days and the seller was a bum.
I'm a mechanic. A cylinder head will often crack due to overheating, a head gasket will fail very often due to overheating but I have never seen a cylinder wall crack due to overheating. They usually crack when there isn't enough antifreeze in the system to keep it from freezing. The outside temperature drops down too far causing the coolant to freeze and the wall cracks OR a defect during manufacture that produced a weak spot in the cylinder wall that took some time to show up. The defendant just seems really shady to me. While it would suck as a car dealer to have to warrant the engine it is your responsibility so just do it and don't be an ass,

Maybe he just hadn't lost enough coolant to notice the issue yet or possibly the cylinder wall was just reaching the point of failure when the man bought the car and it didn't actually crack all the way through until a couple of weeks after he took possession? That 30 day warranty doesn't just cover pre-existing problems though. If the bearings were extremely worn for example but didn't have an actual issue at the time of sale but 3 weeks later one of them failed it should be covered under the warranty. Since the first shop couldn't duplicate the overheating issue but the second shop just a few days later could I suspect that the problem was getting worse very quickly so it might have been fine the day it left the dealer but failed soon after.
A cracked cylinder wall is not something that happens over time. it is an even that causes it, so what was that event and when did it happen?@@1967davethewave
@@mexicanspec A cylinder wall with a defect in the casting can take many miles to show up. As I stated earlier the most common way is a crack due to freezing but when the compression and power events happen in a cylinder it distorts just like a balloon only in extremely small amounts measured in tens of thousands of an inch. A normal cylinder wall will never fail but one with a defect might. The heat in a cylinder is concentrated in the head and the cylinder wall stays 50-70% cooler. So if the engine is hot enough to cause a cylinder to crack then the cylinder head would absolutely melt down at the same time, especially with an aluminum head. They never mentioned which engine was in the car. I would assume the 2.7 since they are the most problematic of the engines available in a 2006 Charger but any engine with a defect can fail early compared with the averages. Maybe you have a different opinion but outside of a freeze issue and a casting defect the only other ways I've ever seen cylinder crack is too much boost, a broken piston where the rod slaps around and cracks the cylinder or excessive detonation caused by a variety of reasons but that usually causes a piston failure first. None of these seem to be the case in this case.

The warranty company is well within their rights to exclude damage from over heating. A smart person stops driving the car when it gets hot. People, like this guy, keep driving it and damage the engine then get somebody else to pay for it.

5:07 WRONG! Overheating means that gases are EXPANDING. That means that the combustion chamber is being expanded on beyond its normal shape... that's what cracks the metal. It has NOTHING to do with 'overwork'.
If the car had a cracked block upon purchase, and was overheating because of it, it would have been caught during the test drive/pre-purchase inspection.
In this case, it is more likely that the crack was a RESULT of engine overheating, not a cause of it. If the fault were there from the beginning, the plaintiff would not have driven the car for THREE WEEKS.

I would just like to point out the "Lemon Law" that so often gets quoted by people that buy a junk used car. The lemon law only applies to new cars. You might say why does a NEW car need a lemon law, there should be nothing wrong with it because it is new. This is the point... occasionally you may get a brand-new car that just was not manufactured correctly, and it has persistent ongoing issues. Meaning it was a lemon right from the factory. The lemon law states something to the effect that if a new car needs to have the SAME issue repaired by the dealer within a certain time frame this might indicate that it was not manufactured correctly, and it will continue to be a problem. The law allows you to return the new vehicle for full refund. Lemon Law does not apply to used cars.

For the record I'm a mechanic. I do believe that was the real mechanic on the phone, but he lied to do his customer a favor and also probably knows if the guy wins the money is gonna go to his shop to replace the engine. A cracked cylinder doesn't cause overheating. Overheating absolutely causes cracked cylinders. Guy probably had an intermittent fault like an electric cooling fan that sometimes wouldn't come on when it was supposed to. But when he brought it in to get checked out it functioned properly. When he got it back it started acting up again but he kept driving it. Then the cylinder cracked and he knew it was much worse and took it to his guy. He exacerbated the damage.

No, lemon does apply to used cars. However, it only applies to cars purchased from a registered car dealer, not from a private sale.

The plaintiff, Mr. Saparino proved himself to be no Sap. The defendant tried a lot of fancy maneuvering/dancing in an attempt to throw the judge off but unfortunately for him, this judge is not easily fooled or scammed. I will say that I definitely thought that the plaintiff was going to lose his case simply because a "used car" is basically sold under an "As Is" rule. Wow.
You can drive a car with a cracked head... I mean, it's not going to run great, and eventually it will cause more and more damage and will stop running at some point. But the statement "you wouldn't drive 20 or 30 miles" is 100% false.

The judge normally does an excellent job with the cases that come before her, but I have seen her do a terrible job with vehicle repair cases. The car could have been overheating because of a bad thermostat, a hole in one of the radiator hoses, a bad relay for the fan, a hole in the radiator, or a bad water pump. When the plaintiff continued driving the car when he knew it was overheating, he could have made the problem much worse which could have caused the crack in the cylinder wall. He said he used it for a couple of days and it started overheating again. She should have checked to see how many miles he put on the car after he bought it. This quite possibly was a bad verdict.

I agree. The plaintiff did drive the car way too much when it was overheating.... a sure way to crack the block/cylinder. The judge came out of left field with this one. But I do see commenters mentioning this defendant has been a defendant at least 3 times on People's Court. Maybe this time the judge got a sniff of something she didn't like. I still say there was no conclusive evidence that the defendant sold the car with the crack already in it. Zero

The defendants customers are all coming out the wood works on him 😏 but this one I think Judge got it wrong. Driving a car while running hot is what caused that head to crack. He said himself he kept adding water to drive it. He was at fault. The plaintiff just tryna say whatever to get that money back. Of course the shop gonna go along they want to get paid. That was a set up that phone call.
The warranty must state whether certain conduct will void the warranty. For example, selling or transferring the product may void the warranty. Having an unauthorized dealer try to repair the product may void the warranty. Using the product in the wrong way may also void the warranty.
I feel like they defendant was in cahoots with the Garage that car was towed to and they cooked up a deal where the garage would miraculously find nothing wrong with the car. That way the plaintiff would be driving it around longer and they could blame him for the engine. I am so glad that the judge saw through his lies and his scheme

I’m sure everyone knows this but the way an engine works is by pushing the pistons down making the crank turn. This is done by mini explosions when the air and fuel mix with a spark. So the engine will get hot the coolant travels through the engine and removes some of that heat keeping the engine at a stable operating temperature. If the engine block got cracked coolant can leak out and oil causing the engine to overheat very quickly. There’s no way that guy would be able to drive 5 miles his car would be toast with no coolant.
So explain how he drove it for 3 weeks then.

FYI, you can drive a car with a cracked head. I had a 1987 Sentra (that you didn’t even need a key to start lol) that had a cracked head. I’d have to put water in it when it would overheat in a drive thru but we drove it for awhile Edit: I would like to clarify that just because you can doesn’t mean you SHOULD. It was dumb on my part but I was a broke 17 yr old idiot

Great Ruling!! Seems to me the dealer knew something was wrong with that car, as to the reason he paid for the towing and everything else. And yes a cracked head will cause your car to overheat, and most likely a cracked head comes from driving with an overheated engine.
