  • The plaintiff says she hired the defendant to build a patio for her. All was well at first, but the steps cracked over the winter. She claims the defendant ignored her calls, so she had to pay someone else to fix the deck. She’s suing for the cost of repairs. The defendant insists that the plaintiff is confusing him with someone else and says he’s not the one who built the patio.

      I feel that Judy would’ve dismissed the counter-claim, actually. You’ll notice that the defendant didn’t bring any evidence to court. He didn’t bring printed pages of the trolls messaging on the plaintif’s Facebook wall, for example. Judge Milian had to fish out a confession out of the olantiff herself for that. Judge Judy would’ve just shrugged her shoulders and just say “I can’t help you”.
      However, if he did a better job proving his case, judge Judy absolutely would’ve had the plaintiff for lunch.

That has nothing to do with him seeing who she was after she sent him a friend request. Up til then, he knew some lady was calling him and texting him... even then she was still convinced he was lying.

She herself even told him that was the reason for the calls. The FB page even put a face and name to her. Why would he need to have done business with her to know what's going on? She was hardly "some lady" to him...she was very specifically a lady who mistook his identity as the scammer seeking money or completion of work in return. How is that having "no clue" who she was lmao

      On what grounds? Remember every case of people filing for herrasment and such:
      Nagging on the phone is not herrasment and he was able to resolve it by blocking her number.
      Leaving bad reviews on public domains is not herrasment as people are free to have their opinions.
      There was no physical altercations to validate any threats, more the need to get a restraining order to keep her in line.
      All in all, the plaintiff's actions were shitty, as well as morally and ethically wrong, but from a legal standpoint, she simply exerted her American Rights to Complain... against the wrong person.
      Because of the lack of legal aspect, Judge Milian can be disbarred as not being impartial if she awards a notable sum as she hasn't accepted "nagging" as legal herrasment before.

      NO one uses yelp anymore so he didn't lose any wages. Begging for $5k was just sheer greed (even he chuckled along with the judge and audience, as if conveying "Hey, gotta shoot for the stars!"). So what if she got the wrong man? He got paid didn't he? What's $500 for fielding what was likely 3 or 4 calls before the blocking? What makes him so superhuman that he really took 30+ calls before placing the blockign? Are you that gullible? Isn't it more likely that he inflated numbers to increase the chance he would secure thousands in damages (something wise judge Milian saw through)?

THis is also the reason why the judge refused to reward more than $500, because his true character of greed came out when demanding $5k, while she wasn't being greedy but made an honest mistake. For this to be ironic, the actual scammer would have had to received more business, not this gentleman

      @@daveb2280 ..and it's the producers who serves the summons since it's TV court (they scour actual small claims for interesting ones w/ potential to be highly dramatic) so it's not even her fault. THe judge knew the crew made the mistake, and she honestly thought her review and calls were directed at the right person, while he was likely being dishonest since admitting to "blocking" (something most people w/ common sense would do after 3 or 4 calls). This is why she refused to reward him any more than $500, because of his dishonesty compared to hers.

My uncle was part of a mistaken identity (let go cause the guy of the same name and description had been on the other side of the country a day ago, proving his innocence)... But that was the cops making a mistake due to an APB that went out 30 minutes ago.
      Where this lady went too far is that she knew the two men were from different cities, she was shown doubt that this man was the right guy, and if she did proper research, she could have done her research by:
      1. Contacting the business registries and inquire on the man's business (discovering he was a painter)
      2. Ask for the worker's contact info *when he was doing the repair work*
      3. Contact the town she believed the worker was from, asking if there is a concrete worker of that name.
      4. Find the closest concrete supply company to her worker's town and ask, "my sister had some amazing work done from this concrete guy who lives in ____, and I would like to hire them, but she cannot remember his name .. something like___? Anyways, she said he (describe looks), do you know any contractor fitting that description?"
      5. *At Worse*, call the local police from the plumber's town and explain you've had bad work done by a man calling himself ____, and in tracking them down, it appears they might have been posing as another worker. Then ask if they could verify that the worker from that name is not 5'8 with thinning brown hair.
      Mistakes are mistakes, and sadly he had no actual legal claim of harassment, but especially when she stalked him on Facebook, she had enough reasonable doubt (as photo stalking on Facebook would verify his claim) that court and public shaming should not be her first legal recourse.

      I get why he asked for $5k. The judge can always lower it, so ask for the max and get the max she is willing to offer.
      But a day away from work, nagging, and being unremoseful cannot be too high, as it is not legal threats, legal herrasment, and he did not have to even file a police report.
      Given that, I think $500 is a generous amount in a legal standpoint when normally such a countersuit is dismissed as there is no legal bearings.

      Not an apology at all. Not a word in the lexical field of being sorry until asked. Then she pauses and answers "yeah, a little bit". That pause was when she realized that it wouldn't look good if she said that she wasn't sorry in the slightest.

    This is actually scary when you realize that this could have gone very badly for the defendant. Imagine how many people get into serious trouble or even lose their lives because of other people’s ignorance.

      Exactly, seems like the plaintiff gave him the job without checking if he was licensed, business card, referrals, etc. Defendant should have got $2500 not $500.

    That poor defendant, that would be a miserable situation! I hope he didn't lose any business over it, I think she should have had to edit the Yelp review to admit she made a stupid mistake, it would be more humiliating for her & funny for anybody who reads it.

      The sad thing is that contractors get screwed for no good reason sometimes. My dad's a contractor and a good one. Several months ago he did work for a woman who was his mother's best friend. He's literally known her all of his life. He's done work for her before and she's even recommended him to other people. So this time there was some flaw in his work supposedly. He thinks someone got into her head probably another contractor who wanted the job. Long story short he agrees to come back and fix it sends her paperwork and everything. Literally the Friday before he's supposed to come back she files all sorts of complaints against him and no longer wants him to do it. She's STILL giving him all sorts of hell about this!!! Then a couple of months ago she texts him begging him to come back despite all of the hell she's put him through but he directed her to the lawyer that he hired because of all of this. It sounds like she's STILL escalating the situation to this day!!!

    Honestly, if I were the defendant I would be checking up on my identity. Irregardless if this "karen" was lying, the idea that someone with your name is out there doing shoddy work would be terrifying especially if you had your own business.

      Eh, many people share names. There are a lot of Seth Browns out there. Even your name is shared by multiple people with a quick google search.
      We like to think ourselves one of a kind, but as far as name goes, it’s unlikely. Unless it’s some insane crazy madeup name for attention like the woman who named her kid ABCDE (Ab-city). 🙄

    I liked the defendant! The plaintiff comes off as very arrogant and obnoxious. Such a shame that she doesn’t see the damage she has done to his business and showed very little remorse and refused to really acknowledge that.

    Typically, the judge sides with who's been wronged. The woman was not wronged by the defendant & was a real jerk to him. If there was ever a case where pain and suffering should apply, it's this one. $500 was nothing. The woman showed her true colors when she said she felt a little sorry for him. Then she's prompted like a young child to give apologies & without feeling says, "apologies". Yech!
