  • The plaintiff says he hired the defendant to put a new engine in his car, but the man screwed up the entire electrical system. Now the plaintiff has to pay thousands for repairs, so he’s suing. The defendant says he’s a master mechanic, and he says the car’s computer system was already fried.

    If the engine is missing then it needs more than a computer diagnostic test to determine if the engine has a mechanical failure or it's something electrical. There is something wrong with this case. Either something is being left out or the mechanic jumped to a conclusion about the engine that was wrong. I've been a professional mechanic for 36 years and I have seen some pretty awful and wrong diagnosis over the years.

    All of the sensors on a car (including those in the engine) communicate with the PCM (Powertrain Control Module) through CAN bus. Unless the replacement engine was a Ford engine that used the exact same CAN message IDs for its sensors, it is NOT gonna "talk" to the PCM in his car. ANY worthy mechanic KNOWS this!
    His point (after the verdict) that the "money he spent on tows" [and diagnostics] is not only moot - the guy has a right to find out what's wrong with the car after it was supposedly fixed - it's also incorrect; the total judgment only went up by $377.80 accounting for all that - a far cry from the $940 additional dollars (beyond the $500 mechanic's concession) it would of cost him to buy a new PCM.

    A mis-fire does not equal a new engine. Few different reason can cause a mis-fire. Change spark plugs would have been where I started….but what do I know? Besides doing a few rebuilds on my own vehicles

    Just cause an engine misfires dose not mean you need a new engine just means one or more of the cylinders is not contributing to making power just gotta find the problem and fix it. Usually a bad spark plug bad coil or wires or a bad injector not firing or the timing could be off.

    Damn, does she listen to what these people are saying. He stated that he sent the codes to Mieneke, that's how they would know without having the engine, idiot. That's how the guy that suggested buying the new engine went by. "Well, they didn't have the engine so how would they know?" Well, if they had the old engine they would have done the same thing the other guy did which is get the code off of the car. Listen. She shot that entire thing down because she didn't listen. Typical of this judge.

    • @googleyt2622
      @googleyt2622 Před 2 lety

      Just getting codes is not how you diagnose vehicle problems. The codes are just a tool to help isolate the problems. The defendant had access to the vehicle when he diagnosed it and recommended engine replacement. Meineke only had the list of the codes that were kicked out. Plaintiff claimed that Meineke told him that the codes do not indicate a faulty engine. The problem here is 1) Meineke cannot certify that previous engine was serviceable without looking at the old engine, and 2) Meineke did not provide any "expert opinion" in the form of a report that the plaintiff could use to impeach the diagnosis made by the defendant. The bottom line is that the plaintiff trusted the defendant's diagnosis and chose to go ahead with the work. He should have got a second opinion about the codes before he authorized the defendant to make the repairs. Without actually taking the old engine to another mechanic there is no definitive way to determine its condition.
      The story gets more interesting when we discover that the issue that developed was indeed a known issue that can result from engine replacement. This judge went above and beyond to ensure that the plaintiff's interests were properly represented by seeking an expert opinion on the plaintiff's behalf.

    Cylinder misfires does NOT mean the engine is shot. you need to diagnose what is causing the misfires. Simple plug change , coil change, possible sensor change all could be a root cause of a misfire. I wouldn't trust this "master mechanic" to put air in my tires.
