      Maybe not, but that's the most likely scenario. If he really didn't want to be a husband or dad, there's no reason not to sign the papers, unless he has reason to believe one or both kids aren't his. Even still, a paternity test would clear that up.

    Another thing is that she’s not going to be able to get passports and other important documents for the children that require signatures from both parents if he is on their birth certificates as their Father. I agree, I've seen a lot of men do this, and if she had actually gotten a divorce lawyer she may have had this wrapped up by now. Because if a lawyer serves someone continuously with no answer, depending on what state you are in, and you have shown that you have reached out multiple times a lawyer would be able to file for a marriage dissolution on the grounds of neglect or something like that, if I'm remembering it correctly I may have things switched, and she could have had the court draw out money from his paycheck for child support by now if she went that route.

    I don't have to imagine my wedding venue being closed on my wedding day because THAT'S WHAT HAPPENED TO ME. It's called The Creperie in Edmonton, Alberta, and we paid a deposit the year before and booked their private venue for 50 ppl for our wedding day. 3 weeks before our big day, my mother in law saw online that the restaurant was closed!! We had actually planned to talk with the staff that week since when I called a couple of months earlier, they had said to call 3 weeks in advance. I had to call a lawyer, and I did get my deposit back through my credit card company, but my husband and I were soooo stressed out and devastated. Luckily, we found a beautiful restaurant that took us in 1 week before our big day, stayed in our budget, and made us a beautiful cake. They even made crepes, which are not on the menu, just for us! Shoutout to Tiramisu (also in Edmonton). Their team was honestly the best, and we still can't thank them enough!

      Not sure if this happened when they had to close down and relocate (still haven't reopened) due to the building they were in being sold, but if it was that, it's kinda out of their control (obviously more communication was needed) and you should be going after the buidling owners NOT the business thats also suffering, sucks for everyone in the situation, imagine all the employees out of a job from that... I think it's been closed for almost 9 months now with recent news of finally finding a new location.

    • @VanillaflavoredSora
      @VanillaflavoredSora Před měsícem +7

      @JustAStump They closed about 2 weeks after my last conversation with them, and I know it sucks that the building was sold, but it was still the businesses responsibility to inform us it closed and to refund us. We would have completely understood and made other arrangements. (We booked in Oct 2022, they closed May 2023 and our wedding was Sept 2023) However, we weren't told and after a server on instagram apparently got ahold of the owners and said they would contact us asap to refund our money they never did. They didn't even reply to any of my messages asking. So, as much as it is a crappy situation, the owners are 100% at fault for not contacting us, following up, or even apologizing after the fact. I don't have much sympathy for them after the way we've been treated. And legally the building owners are not at fault. The reservation and deposit is a contract between the business and the client. The landlord of the building is not a third party to that contract.

      You actually don't have to use the newspaper. The legal requirement is simply that you post notice in a public forum. Every courthouse has a community bulletin board. Some states even recognize community FB pages as public forums, so a post there would legally constitute serving the other party notice.

Plus she had to sell their house before it got foreclosed on and she had to get an order from a judge to allow her to sign things in his name to sell their house. So lots of court fees and lawyer fees. He had also taken one of their vehicles. It was in both their names so she had to keep paying the insurance in case he got into an accident (not that he got it inspected or did any oil changes or anything on it)

    A divorce without a compliant spouse can be arduous because you have to prove you served them. It differs in various countries, but even in mine, I had to wait a year to start filing, serve him, because he dodged us serve his mother, have a friend swear an affidavit she did it and then also mail a copy certified tracked mail, wait 30 days to allow him to respond, then continue the process. And we had a signed separation agreement settling all our financials and no kids! She has children, child support and who knows what else? If he has a rich daddy and possible assets, he is dodging for a REASON.

    She said yes
    The woman explained how she and many other women had been trying to find him for years but he would disappear not long after whoever he's with was pregnant and they're looking for him to get the unpaid child support
    The woman even sent pictures of other girls with the same guy even a couple birth certificates

    8:30 There’s not. Unfortunately if the person is considered mentally capable of agreeing to the terms of the divorce there’s not a lot that can be done litigiously to get a signature from someone refusing to sign. My ex refused to sign our divorce papers for two years. We did have an open domestic abuse/spousal abuse case, which he was found guilty of in military law on two different occasions, but I never pressed charges. He was found guilty per military investigation but the statues had not expired and basically I said if he didn’t divorce me I would press charges with the state- which had he been found guilty in a civilian court of law he could have gone to prison. He then signed the papers.

      It depends on the location but you can divorce someone due to abondoment and also have them removed as a custodial parent for that as well.
      basically since they are not doing their part, they have forfeit being apart of it.
      Also if you had a lawyer, idk why they didn't tell you to use that open case to have him sign right away. You basically wasted at least 1 year.
      I had a friend that went through this. His wife was a total monster, no one believed him until there were police reports filed while he was away. They basically said, sign divorce and your rights way, or do 5 to 10 in prison.

    • @AnABSOLUTEBarbarian
      @AnABSOLUTEBarbarian Před měsícem +2

      @@RaizelSX Divorce by abandonment takes a while though. And in some circumstances abandonment can be criminalized which can extend the legal process. I was working with base or military legal and they encourage reconciliation or “maintaining” the family unity. We were already on a Family Action Plan per the investigation. I think we were all hoping it wouldn’t come to that. But he told me finally, he confessed to refusing to divorcing me, so I couldn’t “go off and marry someone else.” So when I finally realized he was deliberately refusing, not because he believed we could reconcile but because he didn’t want me to move on, I reminded him our case was still open. I was granted separation from the very beginning and my legal status was “separated” the entire time. And because of this once the divorce was granted the judge went back and ruled our marriage ended on the day I filed for legal separation. So on paper it shows our marriage ending the day I left.
      And I will say this- separations are fairly easy to obtain in most cases. I didn’t even have to appear in court to be granted my separation status. If someone is refusing to divorce you, GET IT because in my case the judge went back and dissolved the marriage starting at the date of separation. It doesn’t change anything but it is rewarding emotionally.

Even if there was a ruling in their favor, they could spend years and thousands of dollars trying to collect the money from him.

Also, the reason has to have happened within the last 5 years.

    In Massachusetts, you can get divorced regardless of whether your spouse cooperates. When pursuing a divorce, you first must file your divorce petition with the court. Once you have filed your petition, you must notify your spouse of the impending legal proceedings by serving them with divorce papers. If they refuse to sign the petition after receiving the divorce papers, you will be required to file for a contested divorce. In a contested divorce, the court will resolve issues regarding child custody, child support, spousal support, property distribution, etc.
    Although your spouse’s refusal to signal an acknowledgment or reciting the divorce petition complicates the process, you can still get a divorce if you can prove that you make a reasonable effort to serve your spouse. This usually involves hard evidence, such as delivery receipts. It is imperative to note that you can also request a true default judgment with the court.

For me, I do enjoy spending time with the kiddo and watching and helping her learn new things as she grows, but every week I need a nap as soon as she's back at her mother's house lol

    Wow… I’m so grateful for stories like this because I never used to do deep dives. And with a guy like this, I probably wouldn’t have.

    A divorce will actually go faster if the respondent, doesn’t respond. I’ve assisted with this type of “abandonment” divorce scenario. She does need proof of service that she filed, but that’s as easy as sending it certified mail vs paying your lawyer, to pay a company to do it, fyi. She just has so mail it to his last known address. This is not advise; just sharing in the process.

    And here I am trying to get to see my kid due to his mom being abusive and leaving once I pressed charges. She won’t let me see him and I will be taking her to court and putting myself on child support so I can get visitation.

    I still find it insane how fast a person can be found off TikTok. Like FBI CIA get a new section for TikTok investigators because they’ll find someone in 24 hours or less. It’s also weird he doesn’t wanna divorce cause what if he meets someone and wants to marry them and He legally can’t l
