  • On December 4, 2023, NY v. Jonathan Majors kicked off with opening statements and its first witness testimony. This is the recap of Day 5 of this trial, which includes testimony from Grace Jabbari, the ex-girlfriend and alleged victim in this case, as well as Holly Blakey and Officer Brendan Swayne.
    FOR CONTEXT:
    New York prosecutors allege that on March 24, 2023, actor Jonathan Majors physically assaulted his then-girlfriend, Grace Jabbari in the back seat of a hired driver's car before throwing her back into the car after she tried to get out. Jabbari says that as a result of this altercation, she suffered a fractured right middle finger, a cut to her right ear, and bruising to her head. Majors, on the other hand, disputes the characterization of the altercation: he says she attacked him, and that he suffered scratches on his face and body as a result, and that he threw her into the car so he could get away from her before she tried chasing him down on the streets of New York.

      I'm not sure what the verdict will be. I'm just curious to see how Disney responds.There's a report suggesting this drama could potentially be bad for business and they may move away from Majors and recast Kang.

      It seems like she is a drunk, they have physically fought before and he has hit her in those instances (because of the texts). But also, in this particular day, she blacked out drunk, hurt herself, and then, kind of coherced by the police blamed it on him. I think at first she might have genuinely thought it was him, but after realizing it wasn´t, felt justified in accusing him, due to past instances, and due to the fact that he wanted to end the relationship. I don´t think he is morally innocent in general, it seems plausible that he has hit her before, but he is innocent of this accusation for sure. She is just a crazy drunk girl that anyone with 2 brain cells should keep away.

      Just like Johnny Depp will always be associated with Amber Heard. For him he is now at the start of his career so that truly sucks for him. She is not a victim of DV, just a woman scorned. Look at the size of Jonathan Majors and the size of her, if he punched that woman, she would be in a lot of pain. I was a ballet dancer and while it's true you endure pain, the idea that a man that is Jonathan Majors size could beat her up and leave no bruises is absurd. The women that he dates they know he has unreasonable expectations of them but they will indulge him and once he decides he does not want them, they then say he is abusive. This case is morally stupid because the Prosecution failed miserably to show he used any unreasonable force against her. Her finger may have gotten broken because he was attempting to take back his phone from her. He had a right to do so. She walked into a wall after drinking with strangers and probably went home and continued to drink and passed out. The shirt she was wearing on the night of the incident was white and no blood was found on it. She hugged the other woman and no blood ended up on the other woman shirt. My grandmother used to say there is nothing worse than a woman scorned. He should have gone to another State or Country and have his Lawyer and people end their relationship for him. Some women need to be dealt with in that manner. While she was gone during the day, he should have had his people pack up his apartment and left her stuff in it and then break the lease and have his attorney notify her that the lease will be up on such a date and she has until then to move out. They could have told her that after they moved out his things they documented the condition that the apartment is in so any damages she would be responsible for it. I am sorry but this is one of the dumbest Prosecution in History. Hopefully he learns a lesson from this.

    If I am afraid of a man why would I run after him. This is so absurd. She literally went into a Club with Strangers while being afraid of her abusive man. This makes no sense. Even if her finger was damaged she took his phone and he had every right to get it back from her without using deadly force. Nothing that they presented shows that he used excessive force on her. This is so ridiculous it reminds me of Amber Heard all over again.

      Exactly! If you're being assaulted and you're scared of that person, you will do everything to get away from that person. You don't chase after the person capable of harming you. She didnt call the police after the incident. Didn't file a restraining order. Didnt tell anyone that she was afraid for her life. You wouldn't go out your way to project someone trying to harm you. Majors trajectory was becoming a mega superstar. Possibly one of the highest paid actors of this generation. He didn't want to be with her anymore and she couldn't take that. So because of a broken heart she is willing to ruin Jonathan's entire life. Sick

    Looks like a mutual fight, definitely started by her when she wanted to see his phone. There's no way you can assign criminal guilt to him, even if her finger got injured during that fight. She started it and neither the testimony of the driver nor the surveillance camera showed anything that would exceed proportional response. As for the ear, my guess is that happened when she fell or banged her head at the apartment in her drunken state. I keep wondering why the prosecution brought this case.

    She's a binge drinker and partier. That's how this comes off. Plus she was prepping by getting recordings - whether that was due to being afraid of Majors, or a break up. I mean people are complicating a standard situation here. She did not want to lose this relationship as he's a celebrity. And I'm sure she loved him as he her. However, it just wasn't meshing and they had a bad break up, fight with some tussling. JM probably was already into Megan Good and was trying to get out. Jabbari being pissed she was going to make sure she wasn't just discarded and in her drunken state made some bad decisions. Yes, they cared for one another, but it is what it is. Simple. This should have never been taken to court its ridiculous. A waste of money.

    My ex punched me and broke her finger in the same place, she TRIED to lie and say I squeezed her hand but her brother saw the whole thing and did not lie for her💪🏾so a broken finger doesn't means the other did it🤷🏾and a punch behind the ear would not cut the back of the ear, swelling of the ear will happen first

      ^ Nobody said otherwise. But this trial isn't _about_ abuse in a relationship, just one specific alleged violent incident. Majors can be an asshole all he wants, that's not a matter for the justice system.

    I just don't see her being afraid of majors at all. Like relentlessly chasing him. You don't chase someone you fear physical harm from. I'm still unsure why she's not getting prosecuted. Lack of merit? I see otherwise

    Why was grace Jabari naked from the waste down? Your supposedly in fear of JM but yet you go to the very place where you know he'll be at some point and your naked. Something is not adding up. Why was she on the phone if she's supposedly unconscious?

    The thing is that her testimony is that she sustained her injuries when they were in the car before they exited. According to her own sequence of the events the assault did not occurs when he was putting her back into the car, it had already occurred so the part the driver actually says he saw wasn’t part of what is the alleged assault.

      The text message is what caused things to escalate and I believe that happened in the car. She has no right to take his phone from him and let's say her finger was injured when he snatched his phone back that doesn't make him a monster and he has every right to be angry and take his phone back. A man should never put his hands on a woman the way he would a man but to expect a man to be a gentleman in this kind of situation isn't very realistic. I saw a comment where a woman said he manipulated her into chasing him smh there's no scenario where witnesses see a man chasing after a woman and think yup she somehow manipulated him into chasing her that guy is a victim. We're all aware of fight or flight and he was running to get away from her there's not much else he can do there's another video where he gives her a nudge and takes off running around the corner so while he used force he also used restraint.

    Bruh 3-4 drinks a night and 6 plus in a sitting, this girl is an alcoholic. When you listen to that conversation between her and Majors you can tell its her drinking that he has an issue with its not like he's scolding her for her appearance or something she said its her actions while drinking. Which I think is pretty normal in relationships if this was a woman speaking to a man about his drinking we wouldn't bat an eye about it.

    That picture of the cut behind her ear is odd. I was thinking the cut behind her ear was more in her hair, like if he grabbed her and cut her with a ring or something. That cut is in the crease behind her ear, which is an odd placement when fighting with someone.
    Edit: The prosecution needs to clarify what they think she was cut with to make me believe Majors caused it. I can't believe a physical altercation alone caused that placement.

      It looks more like the ear was pulled, or the ear was folded and dragged forward in the opposite direction during a fall or slide along some sharp/edged surface. But it was large enough to have a good amount of bleeding, especially if you are drinking which thins your blood. Either way this did not come off like abuse and just maybe tussling over the phone or when she was in the apartment alone. The fact that she was recording conversations to me means she was prepping for something if things went sour in the relationship.

      The prosecution didn't clarify that because in essence they can't, i think they mostly focused on her finger injury.

      @@ephalanx1 I'm no professional, but to me it doesn't look like an injury from the ear being pulled. The cut looks really clean and I would expect a more jagged tear if it was pulled. It looks more like it was cut with sharp object.

      I also read that they found blood on the bed of the room but didn't find any blood on her shirt which doesn't make any sense to me. If I had a cut on my ear, wouldn't the first place it goes be onto my shirt if I am standing up and running like we see in the video?

    You conveniently excluded that on Defense Dr. Chiang conceded that her injury was not consistent with a twist or pull of the finger. Also, defense witness expert, Dr. Weiner concluded that it was not a spiral fracture, so it couldn't have happened by a twist or pull either.

    The jury very likely already made up their minds given the issues with her side of things. The injuries not being constant with what she said happened, the video, the witness and the little fact she was texting her sister 7 min before she was supposedly found unconscious on the floor. Like us they would have known early that something was wrong even if they couldn't've put their finger on it. As things went on and more evidence came out they would realize why and meaning this is very likely not going to go the prosecutions way.

      Not to mention on the body cam video upon the police entering the closet, they begin picking her up off the floor, and she immediately looks at her finger and draws attention to it, putting her hand in the officers line of sight. Essentially parading this probably self-inflicted injury for them to see, accompanied by a super fake look of confusion like she just wasn’t texting seven minutes earlier. Super bad acting!

    How is this case even brought when there is video evidence of her constantly grabbing onto him, chasing him, the ending up drunk and half naked in his closet where she probably got the injuries?
    Ppl are so focus on trying to speculate what he might have done to her when what she clearly did is on video and audio.
    She was getting the boot and couldnt handle being dumped. Yet y'all went after this guy like he was slapping her around.

    I found a lot of the evidence for the prosecution to be very weak for the charge of assault on that night. I also feel like a lot of the witnesses they produced really didn't do anything to really solidify the case. The witnesses did such a poor job of proving the prosecutions case that it almost felt like the defense had called them. The job of the defense to show reasonable doubt seemed almost too simple, where their only blunder seemed to be getting texts brought in that were previously excluded. I'm kind of stunned the prosecution took this to trial with so little concrete evidence, and witnesses, except for the driver and police, that were all under the influence of several drinks of alcohol.

      TBH, as Alyte said in the prior video, the only way to prevent those texts from appearing would've been to forego attacking Jabbari's inconsistent testimony, the prosecution used those redacted texts as a way to show to the jury she has a trend of "saving/covering" for Majors.

      The other day when someone in the court reported that the prosecution rested its case, I was like HUH????? All that was YOUR arguments and witnesses????? They were so bad for their case that I thought we were already hearing the defense.
      There is no way that they find him guilty, the system is really broken if they do.

    Something I realize after hearing the this time is the fact if it's alleged that he was throwing her around like some ball. How is she able to latched on to him when he finally left the vehicle. If you get thrown back it's hard to grab on to anything. But you can clearly see that Grace attached to Majors arm as he exits the vehicle. There's just so much inconsistencies in every part of the prosecution's case. 🤷🏾‍♂️

      Looking at the video carefully, it seems pretty clear that he picked her up and pushed her into the car, in a way that looks like he's worried about hurting her.

      Honestly, there’s so much media bias that I’ve been waiting out my work days (despite the continuous urge to check on the situation) JUST to see if you’ve released another video by the time I get home at the end of the day so I can get some objective news/analysis of the situation.
      There’s a chance a verdict will be passed down today though so I’m going to have to break my general rule on this one. 😆
      Keep the videos coming though! I’m still interested in a thorough analysis, even after the verdict comes down.

    I know the JD-AH trial was long, but again, only my first trial to pay attention to. I'm sort of astounded by how quick this is, both the trial itself and amount of time since the incident.

    I think Majors is probably a scumbag cheater, but I have yet to see any evidence that he hurt her physically. So far, all her injuries appear to be self inflicted by hitting him and drunkenly running into the corner of a wall at the bar later.

    Chipped nails while drunk and brushing her hair back? I have sliced myself with my own nails a couple of times. Skin behind your ear is quite thin and vascular.
    But still, I have no idea which side is the truthful one. All I can say is, it is not beyond a reasonable doubt.

    Majors running away saved him … The case is being over prosecuted , if he did not run away and stayed on the scene It would be very difficult , also if she had been cut in the car and her hand fractured the people who spent many hours with her after the incident would have noticed … They all confirmed she was okay 😂

    This case really should have not been tried. The fact that Majors was the one that called 911…I can see how she broke her finger, if he was prying her fingers off of his phone.
    But also the fact that she went out afterwards, injuries could have happened after the encounter. Idk this gives a toxic relationship that should have never been any of our business. They both need therapy.

    He was clearly toxic and manipulative in this relationship, very likely going into emotional abuse. Their text messages make it pretty clear, as threatening suicide over your partner wanting medical attention (and being willing to lie about their injuries to protect you) is not normal at all. It also seems like there was a degree of violence between them (both ways), but not enough to call him a 'wife beater'. Overall, this doesn't seem like anything worth going to court for, as being a piece of shit (not to say that she's an innocent angel) is not a criminal offense. The most damage to his public image was dealt by the text that we saw, and this is not something that she did to him. So, if his career wont recover even if wins the trial, that would still be on him and his team.

      💯 the texts and audio reveal Jonathan’s emotional abuse against Grace. Based on this trial it may be unclear for the jury to decide if he is guilty of physical assault that night. However many people in JM’s past complained about his behaviour.

    Pure speculation, of course, but maybe the ear laceration occured when she was pushed back into the car. It appears as the back of her head may have collided the upper door frame of the car. That laceration makes sense in the context of her ear getting caught in the door frame or pinned against her head and the frame as her head slid against the frame while being pushed back into the car. 🤷‍♂️

If the ear laceration had occurred during that altercation, not saying it did but if it had, the car door scenario makes more sense for that injury than a punch or hit. I'm no doctor, though.     not to take away from this topic, and i know this takes a very niche type of law, i would like to hear your legal takes The Completionist's charity scandal and any legal mistakes he may have made in his video titled 'My Response' because to me at one point sounds confesses to using charity names in his fund raising improperly which would be charity fraud so could the wording in his own "Apology/Response" be used as evidence against him

    2 things I find to be laughable from people and the media outlets that are struck on the text message and her injures they say they are evidence that he abused her but the lack of strong evidence is not there in the text smh , next have can we judge the text message without considering that its not the full text and it could be part of a different text message we dont really know so it shouldn't be counted as evidence of guilt and its no time stamp .The audio recording anti Majors folks would say oh he so controlling oh really so if your partner comes home everytime they go out and come back drunk and sometimes bring a stranger that they meet at a bar you wouldn't be upset with that person.     Jeeze that video isn't very strong to use as some sort of abuse. Definitely he was trying to get distance and get away from her. Looks like they were both pushing each other, or that Jabbari was grabbing him and he was trying to shove her off. I have no doubts that he was stronger and more likely to cause injury to her in a situation like that... He might have hit her head even when he tried to push her back into the car. I wonder where the line is between assault and a reasonable defense to free himself from her grabbing actions?

      Any use of force is justified in the eyes of the law so long as it is necessary to protect yourself. The driver testified that she was the aggressor so we already satisfied the most basic condition. Then we see video of him not punching her, not throwing her, not shoving her, but picking her up and pushing her into the car, and when that fails, he runs away. I believe any reasonable person would conclude that he did what was necessary to defend himself. In addition, him running away would fulfill the "duty to retreat" law that is in some states. So legally speaking, I think it's entirely self defense.

      @@sirflappington2484 Exactly. I can't help thinking if he was still in Texas and actually shot her while she was chasing him he could have done the whole "stand your ground" defense. Domestic violence is a horrible problem, but calling this domestic violence is utterly ridiculous. All this drama has been about a misdemeanor assault charge because she had a sprained middle finger and a cut behind her ear. Literally the only thing he did wrong was going back to the apartment before he called the police and I say that with the benefit of hindsight. There was no reason for him to think at the time he should be afraid to come back to his own home after spending the night in a hotel to diffuse the situation.

    The only proof of what he did is that he pushed her into the car, that's not up for debate, but it's also nearly certain that he did it in self defense, evidence by the testimony of the driver and the video of him running away from her. If what we have seen is all the evidence the prosecution has, there's no way the jury would find him guilty. The prosecution even tried to use the text messages to suggest that he's hit her before, but she testified under oath that this was the first time he touched her. In my opinion, with how little evidence they have, the DA should never have let this case be brought to trial.

    This trial is a JOKE. The videos show that _she_ was the aggressor. She even chased the guy for multiple blocks!! The "injuries" she sustained are minor bumps and bruises, and they could very plausibly be self-inflicted (especially since she was drunk and partying). How the hell can you convict this guy based on _zero_ substantive evidence?? The modern justice system scares me.
