State Farm and Carmax should be publicly shamed and reported to the police for this. She did her due diligence and they used a stupid, bullshit technicality to fuck her over. No one should used either of these companies.

That's always been my complaint about insurance. You pay for yrs without filing a claim even once then the day comes when you have to. Instead of doing right by their customers they do the opposite. Thanks to all of the law makers we have no choice but to carry insurance. Hmm, wonder why that is? PAC money maybe? Either way just know no one is going to be "on your side" but yourself. This is also another reason why some people refuse to get insurance on cars that they paid outright or keep the insurance once they drive it off the lot. Guess what happens then? You get into an accident with one of those people and you're screwed. It's just a vicious cycle that's never ending... 🙄

@tammiemartinez6485 That's why we have to have insurance. If you cause an accident, there can be hundreds of thousands in damages and medical bills, if not millions thanks to our healthcare system. Do you want that on you or do you want your insurance to pay for it? Yes you pay for insurance and yes your price can/will go up if you file a claim (usually). But $200 a month is a lot better than getting sued for $250k because you didn't have insurance. And it's definitely better than leaving those bills on the person you crashed in to when it was your fault.
Anyone not carrying insurance should not be driving. They are a liability on the road to other people and to themselves.

Where do they live that they don’t have to go down to the DMV and then register the vehicle in their name at the time of purchase. A stolen car transferring registration would throw up some red flags.
This should be carmax's issue. They are the one that sold the stolen car. It is on them. She needs to find a new lawyer. Have yet to see a case where a dealer sold a stolen car whether they knew it or not "it is legally their problem" and a good lawyer that specializes in auto law couldn't get them made whole.
It is so difficult to find a lawyer to do any work these days. We had an open and shut case and ended up having to defend ourselves in court. Of course, we won even without a lawyer.

It was never stolen, the ID used to lease it was; Months later CarMax realized their mistake when the criminal wasn't making any payments, so then CarMax had the local thugs come 'politely' ask for her car. It is quite confusing, the only winners are CarMax who got their car back and the criminal who made 30K.
Seriously, I feel so bad for this woman. She's tried to work her finances to help her with her medical bills and just ended up with more financial troubles, which isn't good for her health. I feel so bad - Carmax should be ashamed.

Yep. But that's the game. They will try until their is no trying anymore to put the blame and situation on everyone else. The insurance, the police, etc etc. They will have you call your insurance only for them to do the same. They say no, you need to deal with carmax. Carmax will say no, you need to talk to the insurance people. I'll be months of run around with them putting it on the other. But ultimately this IS a Carmax and police matter. Period. But ultimately she won't get anywhere there. It's all civil with crap like this! Takes a lawyer.

Also, she should call every local network TV station in San Diego and ask to speak to one of their consumer watchdog type reporters. Reporters calling and asking questions, especially investigative reporters who work for TV station, tend to get companies to start doing the right thing.

@@htowndood at least do some research to know your rights in your area, there are very few instances where the police could actually compel you to speak without representation present. and if they’re detaining you you have the right to have counsel provided at no cost (i understand this may drag the process out and cops will try all kinds of tactics to get you to speak to them).

@SpiffyPenguin in some cases yes, most cases they don't want to spend money if they can get out of it. I messed up my knee when I was 20 and had to get 3 x-rays before I was allowed to get an mri. After the 2nd one my doctor was confused as to why I wasn't getting an mri. It was because my insurance didn't think I needed one. Had to have 2 different doctors write 3 referrals before an mri was covered.

Do not dispute things with phone customer service. Always do it in writing. Also file a report with your state Attorney General. I don’t know about her state, but every single time a company has given me the run around, their story changes when they get contacted my the Illinois Customer Protection Division of my Attorney General office. 2 times they have given me a “courtesy refund” even though I was 100% in the right

@@devlintaylor9520 this isn't the case of a bad lawyer this is the case of the potential payout not being worth that lawyer's effort for the time invested. this is definitely an issue carmax will eventually fix, but it is also a case where they payout won't warrant much in the way of pay for the legal services. she needs to find a lawyer looking to make a name for themselves.

Carmax is notoriously bad at filing paperwork and selling cars that are dangerous to drive or just outright stolen, they have had their license to sell cars pulled in many states and have been fined millions of dollars.
Also passing you around from agent to agent, telling you to call back in few days, then just denying your claim for "reasons" is a common tactic that insurance companies use, they do it in hopes that you'll just give up long before they have to pay out on a claim.
Imagine if Carmax treated her completely differently and offered her a refund/got her a refund and a new car because of the situation. WOW! That would be so much *positive* exposure...Not totally negative, as it is now.
Carmax did not have a transaction with her....why should they give her anything?
@ChupaA Exactly. The person/entity she needs to go after is the person she bought the stolen car from, not that she will get anything out of them but that's the only clear course of legal action that I see in this situation.
State Farm tried to make me pay my medical bills out of pocket when an 18-wheeler hit me and ran while on the highway. They expected me to fork over tens of thousands of dollars to hospital and doctors, then, they would reimburse me for the payments I made. I didn't have medical insurance. I think they were expecting the health insurance company to pay for the injuries sustained in the accident. I had to sue State Farm to get medical attention for my injuries. They are not good neighbors, at all.
I hope that you recovered okay. Jeez, the US medical system blows my mind. I'm in Australia and we have healthcare for all covered by our usual income taxes. It's for everyone, working, students, retired, disabled, unemployed etc ... I've had genetic breast cancer 3 times and every aspect of my treatment from oncology teams and treatments, hospital stays, surgeries, pathology, nuclear medicine etc... was $0 at the point of service. I can't believe you had to sue to get care! Crazy.

I would've gotten more had the trucker not left the scene, but with uninsured motorists, they cap payments to $30,000. They owed me the money, but they didn't want to give it to me. I had to get an attorney. They (the attorney) paid for my doctor bills. Then, they took the majority of my settlement, as they paid the medical bills, but I received $10,000 for pain and suffering, which State Farm made no mention of, and had no intentions of, giving me anything for it, until my attorneys brought it up. It took 2 and a half years to settle, as well.

Yes, the healthcare system here sucks. Healthcare is pretty much a privilege for well-to-do people. Yeah, there are free and discounted insurance for low income, but the care is crap. And when you're middle-class, it's still difficult to pay the high prices of health insurance, amongst all the other rising costs of everything else that needs to be paid. America is only great for those who are born into riches (or for those who weren't born into it, but rather made their riches participating in illegal activities), in my opinion. 🤷🏼♀️

State Farm sucks. I filed two claims that ended up not being my liability (HOA/condo issue) and they never paid anything, just sent a letter that I was not liable for the damage. Then they canceled my policy for too many claims 🙄
As someone who works for mortgage companies. Most times bs like this happens because people are uneducated and refuse to educate themselves on what is covered or when their policy renews what is different. People make a payment for a policy and think they’re going to get their hand held and treated like a child. Ask fcking questions. Understand your bills and what you’re paying for.
I got rear-ended a month or so ago, the guy who got me has state farm insurance and it's been hell getting them on the phone even.

This is just a time that happened to someone able to speak out to an audience. This happens to people silently all the time. Insurance companies absolutely do not care about you. They're sales companies.
Honestly, I refuse the majority of insurances right down to phone insurance. We are privileged enough to have savings so, we created multiple savings accounts (through UP) for things like funeral "insurance", "phone repairs", "pet insurance", "medical expenses", "appliance expenses", etc. I refuse to get insurance for anything but home and contents because the benefits outweighed the cons (for example, if our house burned down, we would be covered regardless of whether it was one of our appliances that malfunctioned and caused the fire, bush fire, any kind of flood damage, etc. We made sure to ask LOTS of questions for that one, and although privileged, we're not privileged enough to have hundreds of thousands in savings to rebuild/purchase an entire house and its contents 😅).
This is why I'm so grateful to have USAA. I absolutely hate banking with them. It's been a nightmare. But their insurance cannot be beat. They paid me more than my device was worth, and took the (very reasonable) deductible out of what they paid me. Just mentioning in case anyone sees this that has the option of using USAA. I do not care to hype up companies unless it's for the good of the user, and this one is.
That said, always make sure you know your coverage. I paid extra for drops/damage I did. If I hadn't I would've been SOL.
I’m not surprised about State Farm in the slightest. Our home was leveled by a tornado in 08 and it was absolute hell trying to get them to pay up for anything. They were horrible during the most difficult time of my life.

The annual tax exclusion limit in the US for 2024 taxes for gifts is 18,000. Carmax could have gifted her the cash for a downpayment and that's 18k they don't need to pay business taxes on. They are just being ridiculous.

Hi, tax accountant here; the exclusion for cash gifts only applies to transactions between individuals. Gifts from a corporation, LLC, or partnership are limited to $25 per transaction unless donated to a certified non-profit organization. With how often Carmax and Carvana knowingly sell stolen vehicles, the real big brain move would be for them to set up a non-profit entity as an intermediary to distribute funds to affected customers.

This is why I know multiple disabled people who want to marry their partner, but don't. Just so they stay in the poverty bracket that lets them keep Medicaid/disability. In all of these cases, they'd make too much jointly to qualify for benefits, but much too little to actually pay for treatments and such

Like, I get $900 to survive for a whole month, that doesn't even cover living expenses. If I got married, I would get maybe $400 and a medication plan. As for my health insurance, I could kiss that goodbye.

Exactly! It isn’t just State Farm. I work for State Farm and if carmax reported the car as clean, State Farm wouldn’t check. And stolen cars are iffy. No insurance will pay for that. Again, stupid but that’s how insurance works. Dragging along for two months isn’t super fair. I’m sure the adjuster had to go back and forth with their manager and the policy. I guarantee it was someone way higher that said no. Unfortunately State Farm is extremely Extremely understaffed. Is it because they won’t pay more or offer fair benefits? Probably but either way everything is sooo far behind. Normal accidents are taking a month or two to handle. It’s chaos. The problem is, there is a team working the claims. Hundreds of us. And we don’t have authority to do anything in this case. It would be her specific adjuster who is probably handling 50 claims at once. They are making changes to try to help this out but. Insurance really can’t do much here. They can’t sue carmax. Sounds like this is on carmax. Again, sucks insurance can’t do anything in these cases, but all are like that. Just how they work.

a lot of attorneys (at least in my area) call State Farm "Cheap Farm" because they are cheap and shady as all hell. my personal injury lawyer said they are the worst insurance company to deal with. for both clients and those injured by SF clients.
they ARE bullies. i was nearly killed by a SF client in an accident and they called me two days afterwards to try and get me to incriminate myself and fuck up any potential case i'd file. my boyfriend is an attorney and he is going to donate to her and using his network to hopefully find someone licensed in her area who can represent her pro bono. this is not surprising to me, but still disgusting nonetheless.
Somebody at Statefarm won’t give up their vacation bonus this year so this lady can go without a vehicle. This is how rich people keep their lives rich. They don’t care about anyone but themselves. It needs to become illegal to be too greedy.

Technically, Carmax is responsible. If they refuse to pay, State Farm pays the claim and sues Carmax. They’re all doing a whole lot to drag out paying for their f up.
What’s super frustrating too is that she gave the car over, when that previous owner probably was paid out by insurance. So that car didnt go to the previous owner, it went to that owner’s insurance company for them to sell. The cops should know better…

What's particularly sad about State Farm is they charge like a premium insurance company but no longer provide premium services like they used to.
This really goes to show that even if you're careful and do your due diligence, things can still go wrong because of factors you can't predict or are out of your control.

no matter how in the wrong they are state farm is never going to give her money without a fight and a court case. the publicity may seem bad now, but state farm is basically a monopoly people aren't going to stop using them. what they are scared of is if they give in people will take that as precedent that these claims get approved and that social media is an avenue to getting through to them. insurance companies in america are designed to deny as many claims as they possibly can and they will never jeopardize that.
Ugh... i used to work for Carmax's sister company and still work in the car loan industry. This happens a lot more than you would realize. People shamelessly commit fraud KNOWING that the person who they pawn the car off on will be the ones to pay for the crime. It's horrible.
Im guessing these people label the cars stolen AFTER it gets bought. That way they get the money and the car.
As a former independent adjuster and contractor, I can 100% say that State Farm is crap! The denials I've seen are both unethical and self-serving. They treat their customers so poorly. I tell people all the time to avoid them like the plague.
My heart breaks for this poor lady. The technicality is absolutely not meant for a situation like this.

@Rjj2797 All-State is just as bad. In Alabama, we have Alfa, which is amazing. If you qualify for USAA, I'd jump on it. Travelers is another good one. Countrywide, if they are still around, is terrible.
Insurance companies will look for any "loophole" to deny a claim. Most of the time, these denials aren't valid, but they know their customers can't afford to fight back. If this happens, you need to sue your insurance company. That's where the big bucks are. #notlegaladvice

I am curious if she has filed a complaint with the California Department of Insurance. I work as an adjuster for a large insurance company and in my experience DOI complaints are taken seriously and given a lot of attention.
In case you didn't notice, insurance companies NEVER want to help you for even a fraction of a second. They are there to take your money and then show you a bunch of loop holes that mean they can tell you to just F-off when you need the help you are _actively_ paying them for.
My aunt and uncle had State Farm when their whole town flooded and their house collapsed from water damage in the basement about a decade ago. State Farm refused to cover anything for anyone in town because of some loophole they were able to find

This has been happening to quite a few people, the ones that I mostly heard about were from Hertz car rentals. If you start diving into those poor people's cases, and there are quite a few, and what they've been through is absolutely insane. The horror stories are absolutely crazy.

My granddaughter got hit by a guy who missed his exit and he totalled her brand new car. She's ok, they kept her overnight at the hospital. Thank goodness she had a dashcam, but she's fighting with Geico over the amount of her claim.

Because both her AND CarMax were scammed. CarMax actually doesn't owe her anything because they were scammed and had to release the funds they received for the stolen vehicle. The difference is that they are a large company and she is one person. It sucks but that's why you never buy private party.
Legally, Carmax should be 100% responsible for this because they are the ones who sold the car. She very likely has a strong case against Carmax in this case. These insurance companies are a colossal scam; they take your money as a way to have peace of mind for an unforeseen circumstance, and yet, when you do have an incident, they will quantum fold over inside out to avoid paying up and it's disgusting.

In certain states if you start your policy and discover the mold later they claim its something not previously disclosed and therefore not covered

It can be blamed on lack of cleanliness or and/or not treating promptly. They also live on a boat so I found found this:
Boat insurance generally won't cover maintenance or general wear and tear, including gradual weathering and deterioration, insect damage, mold, or damage from animals or marine life.
Two trash companies in cahoots for sure! Known they were garbage when they cancelled all those policies in south Florida. CarMax is just as bad

She being treated disgustingly, wish I could help her, I got screwed over by AA insurance last year in the UK, my first accident in 40 years, they found a 'technicality' cancelled insurance, repaid my payment cancelled policy and that was that, luckily no other vehicle was involved BUT I was saved from drowning when it happened by a policeman so that's a plus I guess..
Today I get a bloody letter from the AA asking if i want insurance as mine must be up again..... FFS Never again they can Fu£k right off, I had 16 years no claims now that's down the pan.
The fact that she's gotten NOTHING after all this social media tells me the companies know they have a solid legal claim and they're willing to fight for it. Usually if something goes this viral a company will send a settlement/non disclosure agreement so fast to shut up any further critique, it's crazy shes got nothing.
The second regular employees stop being able to comment on a case, the companys lawyers are already involved.
In Australia, we have a process wherein if you don't agree with your insurance company, you can lodge it with a governing body who are independent of the insurer.
To me, with the fact that this is so viral, State Farm could have just paid it out and looked wonderful for paying out against a technicality.
What an incredibly terrible situation, leaving an individual to suffer through no fault of their own while the big companies get to keep theirs. Pathetic.

I used to work in an insurance call center (not State Farm) and their whole system is designed to be so frustrating and impossible to navigate that you give up. They will delay, delay, delay as long as they legally can. Really the only way to get through to them is to lawyer up and hope to settle for a fraction of what you’ve paid

I have state farm and I'm literally changing it after I fix my car. I asked my agent to file a claim and he tried to persuade me not to and have the other person file. Because they might not do it. Then I tried to complain about him and the customer service line routes you to your agent. So I couldn't even tell someone how shady his actions were.

Corporations have insurance of their own for sht like this. They couldn't have less of an excuse not to step up and save their reputation but instead both companies rather play hot potato with responsibility and ruin her financial life over what's equivalent to pocket change for them both.
State farm also only gives you a 3 Strikes and Youre Out Policy.
House Fire and 2 Battery Jumps per my insurance and they threatened to end my insurance if I did another claim.

Carvana scammed my dying father out of $500 to take the car. They originally offered $500 for a 2018 chevy trax which we really needed at the time. My uncle had to carry my dying father out of the house while he was in immense pain, to go to carvana, only for them to say he owes them $500. My father passed a week later. Were still living paycheck to paycheck.
That last video was heartwrenching, I feel so incredibly bad for this lady. That could have happened to anyone, it's insane these big companies seem to get away with this. I really hope this matter gets resolved, she must be under so much stress.

In the US in a lot of states it’s legally required to have car insurance so car insurance places take advantage of this and hike the prices up so extreme that even the nicer expensive packages won’t cover Jack shit. Car insurance is a joke here

For anyone who isn’t already aware… this is how insurance in America works and is profitable. We pay premiums whether it be monthly, quarterly, so on. Insurance companies make money by accepting payments and then finding “technicalities” to deny your claims
I work in Insurance and have to deal with State Farm car insurance FREQUENTLY. They handle things on a team-level meaning they don’t just assign one person to the claim who is the expert on the claim, it belongs to a whole team and when you call you get routed to whoever on the team is available. Needless to say it’s a crap chute. No one owns the claim so no one cares or feels ownership to the outcome. They just pass it down the line etc. So I am not surprised she has had to deal with this. Policy interpretation can be complicated and I have had to deny coverage for things like this before and it’s a rough conversation to have. But they can absolutely make a business decision to eat the loss and help her regardless of the terms of the policy. Especially since it was not by any fault of her own that it was seized. It should have been escalated for her months ago and with higher-up approval they can just pay it out. When she said it was classified I absolutely laughed out loud. Just another way to pass the buck. If it’s at the director level (aka adjuster’s manager’s manager’s manager) it could be solved in like 2 seconds. This is an absolute joke tbh.

Honestly this seems typical of American insurance, and not just car insurance. They'll find any reason they can to deny paying out money because that's more of your money they get to keep. The people who fight back are rare, and those that win are even rarer, so facing a lawsuit over unfair denial of claims is a calculated risk they're happy to take.
Carmax is the liable for this mess and Statefarm should have covered her issued. What crap poor lady. She is so so lucky she didn't face jail time for buying a 'stole car'..
Also, this is the BEST CASE SCENARIO. They could have found her on the road, initiated a high-risk/felony stop, and if she was scared/jumpy and one of a the cops had a heavy trigger finger…well, we may have only been able to watch archived footage of Brooke.
someone once swapped my plates with plates from a stolen vehicle and i got surprised by three city PD and three state patrol officers pulling me over and pointing guns at me and my friend because they assumed i’d stolen my own car. i was very lucky to get out of that situation unharmed.

I cannot express how much I relate to this woman right now, I’m currently getting flucked over by State Farm… my family has been with them for over 30 years. I’ve been in 1 accident that wasn’t my fault in the past and recently got into an accident when this psychopath literally tried to run me off the road causing me and 4 other cars to crash. It wasn’t a road rage back and forth thing either, I lost control of the wheel avoiding them trying to ram me into the divider on the highway. The police report was on my side despite them never finding the driver.. but State Farm found me 51% at fault and gave me 10000 dollars less for my car than I should receive. But that’s nothing compared to this woman, we need to have some means of holding these huge companies accountable. Its not just gross negligence it seems like straight up fraud on behalf of State Farm just to avoid a payout. That’s bs they’re an insurance company what do they think they’re job is?

I've been with State Farm since I first got licensed, and my parents have been as far back as I can remember. When I find a new insurance company, I'm going to let my State Farm rep know that I'm leaving because of this horrific situation with Brooke.

They didn’t even give her money back for the stolen vehicle that she bought from them. That makes no sense this poor woman.
So I had State farm for two years. Every month it would increase by 10 to 20$ because of "inflation" went from 90 a month to 140 after two years.
And I tried to get life insurance through them but I was denied because I have autism. And yes that's legal.
Just kind of looking at her Tiktok content, looks like she is quite aware of scams. Selling masterclasses about "how to manifest your soulmate", calling herself a "medium". But the mold inside her body thing is super weird. Trying to find her explaining more because while mold toxicity is a thing, it is covered by health insurance. But from my interpretation is she's going down the the chronic lyme disease/mold inside my body pipeline of non scientifically supported alternative health treatments that obviously are not covered by insurance.

The mold test for my body was done by a licensed Dr and I underwent 6 months of treatment. What was not covered was the remediation costs of getting rid of the toxic mold in my home. State Farm didn’t cover fungus
The crazy thing is both those companies have probably paid out more than the $30,000 in employees time, admin, resources, etc vs just taking the hit themselves. Also, in this digital age, Risk Assessments now need to heavily focus on "risk to reputation" as the internet has the power now to absolutely destroy organisations. There should have been an internal Risk Review of this to go "what is this realistically going to cost us if we do X, Y or Z..." Unfortunately though, Insurance companies etc aren't actually out there to help people. They're a risk gambling business, and their only goal is money, money and more money.
Yes, corporations are not your friends. You are just a number, and they hope that you cannot afford a lawyer.
The problem shes running into from my understanding is she needs to file an appeal which is a form that you have to get access to through the portal but you have 30 or 60 days from the time the decision was made which she didnt do so the company is taking it as the appeal period is close and shes just upset at their decision.

US car insurance is honestly such a scam. It punishes you for having it with insane prices, and they never pay out what they should. I know a lot of people who just don't carry it anymore because the ticket you get if you get caught costs less than even just a month of insurance.
Some states now take your car if you're caught driving without insurance. Also if you get into a car accident that is your fault you'll be sued. Which could be costly. I definitely agree that car insurance can be awful but there are severe consequences for driving without it

State Farm stole money from me as well. They charged me insurance on a truck I had sold and informed them about. They then charged me 2 months later, on schedule like they usually did and then refused to reimburse the charged amount. I had several policies with them.
I am no longer insured in any way through State Farm.

Completely on her side but an insurance company that’s worth billions (I’m assuming so) isn’t going to budge for a single tik toiler getting maybe 5-10 million views. It’s not a fast food chain where the majority of people who go there and have influence are technologically literate people. Most people are just ordinary old people tbh. Even if a couple gen z’s and millennials boycott them, that’s not their main business. Also if the budge, it sets a precedent that anyone can complain about their case outcome and get what they want. So from a business perspective I get it. The world is unfair and that a fact. But there are people that like to cushion that fact and that’s a good thing. I hope that she can raise the money to get a new car and I hope this is a warning to everyone to check and double check because companies cut corners and will screw you without batting an eye.
