    As an Illinois paralegal, I cannot tell you how bizarre it is to see my favorite British drama channel going over the IRPC (IL Rules of Professional Conduct). 😂 You and Runkle are right; my jaw dropped when as soon as you said “specializes.” He absolutely should know better. *I* know better and I’ve never been to law school, because the IRPC indirectly applies to paralegals too, and you memorize that sh*t just by sheer exposure.
    Also: in law, words mean things. In law, the definition of a word can completely change a law or a verdict. People lose cases based on comma placement. You have to be extremely careful, and if this guy passed the bar he has absolutely no excuse for that.

    • @usainengland
      @usainengland Před 2 měsíci +12

      Could you use a different word from “specialise” to indicate a particular area of expertise? I am genuinely confused. I know that many NYC lawyers specialise. My friend’s business card actually said “Music Law.” He was a very respected lawyer in a very niche field. I even asked him, “Are all your clients famous?” He answered, “ No,” with a good laugh. I miss him. He died,a few years ago but had a long joyful life. Thanks for answering my question. I did my MA in Chicago. I specialised in moral law. I’m a chaplain.

      @@usainengland Some states (i.e. Florida) allow a lawyer to list specialties (and those who do are held to a higher standard of care in their specialty areas than lawyers who do not designate it as a specialty) but most states do not allow lawyers to "specialize" or list "specialties" on their resumes/websites, etc.. Lawyers can state that they handle matters in specific areas of law, but cannot say that they are "experts" or "specialists" - I know it seems like a distinction without a difference and is just parsing words, but parsing is exactly what lawyers are trained to do on a daily basis.

    • @JuliesManyHats
      @JuliesManyHats Před 2 měsíci +11

      I'm not even sure they're crooked, as much as they are stupid. Had her lawyer only done the false copyright claims, I'd be inclined to agree with you.
      But putting their licenses on the line in a state with anti-slap laws just signals to me they are very deluded and stupid. As a college student with a single semester of media law I wouldn't touch this case with a ten foot pole.

    Saw this when it first came out on Runkle's channel, but it didn't occur to me now that the combination of naming his "clients" and saying he specializes in things like financial fraud, tax evasion and organized crime, would probably lead people to believe that the named clients had to defend themself against these same crimes, since that is his speciality.
    Otherwise we are left with him representing all of these clients, and separately gaining his "extensive" experience in white collar crime, all within in the span of 2.5 years- and that is disregarding the fact the attorney general's office prosecutes, they don't defend.

    I feel like the whole thing about name-checking 'clients' is a leaf taken out of the influencer book ... I redesigned a logo for Coca Cola in a graphic design course portfolio, does that mean I have worked for them (NO!!!).
    I'm reminded of the time I met some hustler who was trying to get people on side for a project of his - because he'd had conversations with a bunch of Australian orgs who had an employee who said said 'hmm, this sounds interesting' at a party he namechecked all of them as 'in-principle support'.
    Influencer playbook surely doesn't apply to something as highly regulated and rule-bound as the law, but I guess that's why they're trying to be 'innovative' in an influencer market

I can use creative ways around it, but I can't advertise myself as an architect because that title comes with certain expectations/responsibilities I can't do yet (I can't remember the punishment, but I think it would take me longer to get licensed). As someone that used to know him pretty well, I think the theory Janet wrote the complaint and he filed it is most likely what happened. It happens a lot when attorneys get sued because we aren’t dumb enough to do anything pro se. But I don’t think Janet understands that not being pro se also means not writing the complaint yourself
    For the two rappers everyone is focusing on, he was involved in the representation of the estate. I’m not defending him by mentioning it, you can find the cases on Justia. A lot of people are getting that fact wrong.

    i think it's pretty messed up to claim you've represented a dead person if you haven't. they aren't here to confirm or deny - though their estates can - and i think it's unfair. it's like invoking a dead person's name to defend your actions. gross.

    Hey question for the Commonwealth barristers out there.... How does jurisdiction work? Can a Canadian lawyer practice in England? Can a case move up from, say, local Australian court to the....i dont know what the High Court is called in England..... actually, it's probably High Court....can it move "up" in the legal system? Is the Commonwealth like the Federal and state system, where Federal supercedes state in sime cases?

    • @chickenlittle5095
      @chickenlittle5095 Před 2 měsíci +8

      Not straight off the bat. Moving from Aus to the UK as a nurse required me to register and prove my practice to be able to work in the UK. Due to the different laws ect ect you would have to study and prove you do understand the rules/laws in the country you are moving to. Even accountants can’t just move to another commonwealth country and just start practising so for lawyers, I would assume it would be a few years extra education to switch.

      @@chickenlittle5095 And for nursing between the UK and Australia it is easier that for a lot of countries as I know that Australia recognises UK education as equivalent. There are lots of countries that have to redo their education or for Drs at least redo their residency.

    • @HulaHula667
      @HulaHula667 Před 2 měsíci +1

      To answer your question about cases passing through local levels of Court to the UK? Nope. Once the British Empire became the Commonwealth each member ‘state’ gained its own independence and rule of law. Basically, the current Monarch - now King Charles - is the figurehead over the democratically elected governments of each members government. So for the vast majority of the commonwealth the UKs laws have no impact whatsoever. There *may* however be some members who defer, but they’re in the minority. For the most part the only cases the UK Court would hear would be related to UK law.
      Having said all that, I’m not a lawyer, just worked with the Crown Prosecution Service for a number of years and had a very good Modern History teacher who was passionate about the Commonwealth…. so there might be obscure times when it could happen, but they’d be very, very rare I think 🤷🏻‍♀️

    • @amandamandamands
      @amandamandamands Před 2 měsíci +1

      I'm Australian, going back yes it was that it was UK law and that even continued after Australia had its own constitution. These days we have the Governor General (each state has one and we have a federal one) and they are our figurehead (but not really cause they are assigned and keep changing, not really sure how they get the role) and they are now the person who does the final sign off of things that in the old days would have needed the Queen/King to sign off on.
      I am not sure if technically you can still appeal to the UK or not, it doesn't happen though and pretty sure if you did you would have had to exhausted all legal avenues here first.

    Specialist and specialized are different. You can't use the word "specialist" unless your state recognizes specialties.
    But to describre a past job and say "...where I specialized in BlabbityBlah law" is not quite promising a higher degree of skill than other attorneys.
