I'm also an employer and think non-competes are anti-competitive. If my employee has a better opportunity or thinks they could build a better product/service, more power to them to start their own business and compete with us. I also think a lot of folks conflate non-competes with solicitation of clients and stealing trade secrets, which are different. I feel like most libertarians would have the exact opposite opinion at 6:14, non-competes are a restriction on an individual's autonomy. You can't uphold someone's right to put another under duress.

The best non compete for an employer is to treat your employees well. They won’t want to compete.

Thank you for what you do! There's a large percentage of the population that cannot see Orwellian ramifications of certain acts. We may never be able to anticipate these. It's not that we're stupid. We are simply experts at other things. We need public sentinels like you to do exactly what you're doing. I understand needing the code to unlock the bootloader. There's a lot of legitimate security principles behind having a locked bootloader and secure hardware that's been trusted. Which I'll understand because of some grad coursework I've taken recently. However, I still unlock my bootloader and everything. I hate when companies do crap like this and I don't think the terms of service are enforceable with regards to the warranty but I'm no lawyer.

Louis, these non-compete clauses within contracts have traditionally been regulated by the States. A number of States have declared them illegal. But the laws regarding these contracts have evolved as a function of state legislation and case law and bounded by the US Constitution and Federal Law. Corporations are creatures of a State. You should be asking why three (3) unelected people within the Federal Trade Commission in Washington can tell you, in Texas, what can or cannot be in a contract between 2 parties. The FTC can just as easily create a rule that you don't like. And what recourse will you have? The process is important. The States gave birth to the central, Federal Government and limited its scope of authority with enumerated powers. Section 5 of the FTC Law of 1914 provides thin cover for this end- run around the prerogatives of the States. Best wishes!

They should only be allowed to have you agree to an NDA so you can't divulge trade secrets. But non-competes, yes are BS.

I am completely in favor of any law that protects the freedom of individuals to compete in the job market.

I was really confused about the FTC banning non-compete agreements. After listening to this for a few minutes I was blown away. I've never heard of an employer making someone sign a non-compete agreement as a term of employment. This is the kind of thing you sign when you leave a job, usually lasts 5 years and the employer typically pays you a signing bonus equal or greater than 5 years salary. Entering a job under that restriction should only last as long as you're in that employment, else the non-compete should be illegal.

I've come to the conclusion that libertarians are as delusional as marxists. Companies will always be as evil and sneaky as possible, and over time the entire market will be full of scams by default.

I hope they also address the issue with 1:1 applicant to hire ratios being against regulation. It seems like every job I apply to, I have to go through a gauntlet of resume submission, interviewing, in competition with a bunch of applicants, where in the end it's a number's game and even if I get invited for an interview, my chances of getting an offer is still maybe 1:5 at most because of other applicants. There aren't any jobs where they are lacking people so they're willing to hire anyone qualified without having to go through all of this extra bureaucracy - this reality TV series where winner takes all.

I agree with you, Louis. The problem with the "Libertarian" position is that employers have this really nasty habit of telling you about the non-compete only AFTER you have spent a lot of time on applications and interviews and (usually) accepted an offer and quit your previous job. In this case, they essentially got you to sign the form by "deception by omission" - you made decisions to invest your time with them, and often forgo other income, without being informed of the agreement. Same issue with forced arbitration - they often give you an offer without telling you about the forced arbitration, and then hit you with it after you have quit your previous job. Because they induced you to enter the contract by deception - even deception by omission - it should be unambiguously legally null and void. Libertarianism should not mean that one private party can take away the rights of another - and yes, getting someone to sign their rights away by deception IS violating their rights!

5:35 It's the classic problem of evaluating risk vs ease of use. An example would be Apple's advanced data protection. It does zero knowledge encryption to all your data in the cloud and is turned off by default. Why is it turned off by default? Because it's zero knowledge, if you lose the key the data is lost forever. No one and nothing can recover it. For most people the chances of them getting hacked by the copy of the key apple stores is WAY less than the chance they will lose the key and not be able to recover their data. Basically, if you aren't rich or involved in a government investigation... Apple keeping the key copy is your best bet. I personally turned on the feature, but that's entirely based on principle. I am ideologically against the government going through my stuff, without my knowledge/permission, when I have done nothing wrong and am not accused of doing anything wrong. But my position is ideological not logical. I would have the best user experience & security compromise by letting apple keep the key.

Non-compete sounds like a city thing. How would a company know if I signed a non-compete? I'd go to court and say I was drugged. Is it notorized, then I guess I win. Best of luck next year.
