      Choice is often a luxury to those with time & energy to invest into researching every damned decision they make, and if the company changes the facts 'after' you purchase, you aren't exactly able to make an informed choice anyway are you?
      People as a whole follow the path of least resistance & corporations do whatever they aren't either legally or commercially prevented from doing. This is why legislation with consequences with teeth is the only mechanism to prevent many awful practices in businesses. Do you think companies would do things like issue refunds, disclose warnings for allergens & hazardous materials, give detailed & accurate nutritional information on all their food products .etc if they weren't legally required to do so? If you relied on individual consumers to refuse to buy from companies at point of sale until they did all of these things, none of the results of consumer protection law which exists would've ever come to pass.
      TLDR: "Critical thought" from individual people resulting in individual boycott action is never going to change what companies and the market as a whole does.

      @@black_dragon274 The reason why we live in a society with money or some form of currency is because there's no better alternative, until there's a better alternative then money then it will become obsolete, there will always be some form of currency weather you accept that or not, the idea of money has been a thing since the beginning of man to say that we need another alternative would probably cause some type of anarchism. Its just the nature of the beast to want said currency and always will be. To say that money makes you a slave is a really bad analogy logically because that would mean that everybody is a slave, just some people have more money then others doesn't make them a slave, most companies give you 30 minute to 1 hour breaks, top it all off anyone has a right to start there own company and be successful in many different ways. The way you are thinking is the main issue, now if you want to tackle a better issue tackle issues like why aren't people susceptible to change?

      "Legal" and "enforceable" are different. Whether this is enforceable is an open question. In the past, as far as I'm aware, you have not been able to force people into arbitration; there's always been an "opt out" option that was usually a pain in the ass to use but it was there. As far as legal, it's legal to put nearly whatever you want into a contract, it's just that it might be invalid and unenforceable.

      This is spot on. It made me think, alot. That line was put in the movie to kinda shock people and reveal just how evil and corrupt Darth Vader and the Empire were. I bet back in 1980, when that movie was in the theaters, that line sparked a feeling of outrage and resentment toward the Empire in everyone that saw the movie. How does it hold up today? Do people today just think "ah, what can you do?" Do people still breathe a sigh of relief when Lando tells his cyborg security chief to stop what is happening.     I said this a few times before on this channel, that stuff seems to be largely US-specific. In the EU, you can click “Agree”, but it has zero consequences. Terms of Service cannot be enforced if you purchased a product and you can only learn about the ToS after the fact. Same goes for EULAs. Those are null and void in the EU. In the EU, a subscription service (think Spotify or Netflix) cannot change the ToS without giving you an option to cancel the subscription. This is largely unimportant as those services tend to have a pay-per-month and cancel-any-month policy, but others like telecommunication services usually bind you for 2 years after a contract, and only after those 2 initial years, you can cancel any month. However, if they change ToS, they must either offer to cancel immediately or offer to continue the remainder of the contract under the old ToS.
    If you purchased a piece of software off the shelf (I mean literally, a box in a physical store), the only terms and conditions that can apply to you must be printed on the outside of the box.

    The answer I think, is to be what I call a "neo-Luddite": Just don't buy things you can't fix. Do you really need fancy razzle-dazzle made-to-fail junk? The less you need it, the more it costs and more failure-prone it likely is. Isn't it better to be thinking about how things work, and continuously honing your troubleshooting skills than to while-away your time looking at even jazzier graphics and fondling spiffier hardware?
    Pride your self on what you know, not the recentcy and priciness of what you own.

    That is happening to me right now. State Farm jacked up EVERYONES insurance rates and then created this Drive Safe and Save program to lower your insurance back down to what it used to be IF you install their beacon. You turn a corner too hard? It dings you. You slam on brakes to avoid a crash? It dings you. A deer runs out in front of you and you slam the brakes and avoid it and veer off the road? It dings you. Someone pulls out in front of you and you swerve hard to avoid them? It dings YOU. It doesn’t take into account what other people do on the road and punishes YOU for THEIR actions. Your kid calls with an emergency and you answer the phone? It detects you using your phone. It dings you.

      Either you can afford to pay for damages if it happens or your not allowed to drive.
      SInce the US has been built around cars for the past century you need one to live a life if your not in the centre of a major city so its pretty important to not fuck over someone elses life.
      It differs between countries. From what i understand, in australia your only required to have Compulsory Third Party insurance (paid up front with your cars registration fees) which only covers injury or death to other people. From what i can tell you are not required to have coverage for the vehicles themselves.

    Lawyer here from another country: Here in our office we literally have a suit where there's a forced arbitration in a renting contract. We are simply treating such clause as a abusive, one sided, adesive clause that holds no water.
    Of course, our courts are very consumer friendly, but forcing arbitration is a abusive clause, and since EULAs are not legally binding, they can write whatever they want, it won't hold water.

      If it makes the court it probably wouldn't hold water in the United States either, the problem is in the United States and most place involving lawyers the law of favors whoever can afford a lawyer the longest. Companies who sell directly to end-users like game companies have realized that most consumers cannot afford a lawyer or even court fees therefore by making any abuse a legal matter they can get a default win.

    It's true what you say about them pushing a limit an inch at a time and I've tried to warn people about micro transactions for years and leasing in general. When so many people are just opening a subscription here, and another there and just leasing things, they won't know what is happening to things you could own instead simply because they do not have to.
    We live in a time where it is promoted to be careless and sadly most people fall for it.

    So I spent 15k on a EDL11000 generator and 8k on an EDL 8000 (CAD). Both developed injector issues before they ticked over 1000 hours of runtime. (one is at 500 hours, the other is at 250 hours).
    Take em into the repair shop, and they find out that only yamaha can get access to the new injectors. They won't ship them, sell them, or send a tech. These generators are essentially unrepairable now as I am VERY far from their certified place. Indeed that's the whole reason I needed a large diesel generator anyway.
    I hate our brave new world.

      Here is a doozy, covid pretty much shut down my business, so I went and got a job driving at a car dealership, well as the terms of hiring me I had to sign forced arbitration or guess what no job, this sucks so the company can screw you over and you cannot take them to court. There needs to be a law that says you have 2 options arbitration OR you can go to court, this one sided crap sucks.

    Today, I opened up my xbox 360 guitar so I could replace all the innards with a single Pi Pico and convert it to a Bluetooth controller to play Clone Hero. But, when i noticed that the issue was due to a mechanical failure, I decided to make a model and print my own replacement. I don't know how some people could even begin to defend a company like Microsoft from calling patent infringement on such a thing. A repair is a service, not a counterfeiting scheme.

      To be fair many of those are probably for EU consumer rights compliance... and there will be more as time goes on. Frankly the US has become a cesspool for consumer protection and has ceded almost everyone's rights to corporations (WHO ARE NOT PEOPLE). It is the EU that is slowly taking on these things... like universal charging ports and data privacy disclosures and maybe even right to repair. I believe those efforts in the US have been stalled by Lobbying and Lawfare for too long. People like Louis and Cory Doctorow and others will keep fighting the good fight, but I believe ultimately it will be the EU that legislates and the US will follow and benefit from the EU hard work.

    This is the reason why I do not have a subscription to a bookkeeping program and Microsoft office. I'm glad I'm driving an old car with none of those high-tech stuff.
    From my favorite artists I still have Cd's. In the past programs like Spotify have proven themselves to be unreliable partners in safekeeping your songs library. Same goes for movies I really really like.

    My company recently added an arbitration agreement which is automatically agreed to if you dont opt out. They send an email to confirm you read the document and stated there would be a follow-up email for the opt out, but that one never came. I had to send an email to a ghost person, whose email I would not have known without my boss sending us their contact info, in order to opt out. Basically makes it impossible for you to sue anyone in the company, because an arbiter from the company will handle the case.

    I demanded a refund from Blizzard for each game that I ever paid for, and for my ill-considered pre-purchase of the latest WoW expansion pack. They came back and just said that none of my purchases are eligible for a refund, including the expansion that isn't even out yet. They literally stole the products that I bought from them years and years ago, including Warcraft 3 which was not an online-only licensed game when I bought it, and now they just refuse to do anything related to giving me my money back for it. How is this not theft?? How can they legally take back a product that a consumer purchased over 20 years after the purchase and then not give you anything in return, then (also post-purchase) change the EULA to remove your ability to take legal action against them? That's like if a car manufacturer repossessed your car after you paid it off and then just said you can't sue them because they decided that your continued ownership of the car somehow constituted an agreement to forfeit your ownership when it became convenient for them. If that was in the agreement when you purchased the car, then that's legally fine. But how can they change the agreement after your purchase was finalized and then somehow hold you to it?

      Yeah Australian consumer protection law was the reason Valve even had to implement its Steam refund policy. As much as you have had people big-up Valve in the years since for their refund policy, they didn't do it out of the goodness of their hearts. They just aren't so psychotically resistant to doing the right thing like some companies are apparently determined to be.
      Unfortunately I'm not sure sufficient legislation or precedent exists in the EU or Australia to specifically address the issue of products accessed via a service like this.

    I bought an American brand Vinyl turntable here in the UK. It's high end true Hi-Fi and still for sale on many websites. Unfortunately, the drive belt got damaged and looked for a replacement. It was shocking to find that the company (Fluance) do not provide any spare parts for the player, and it proved impossible to source one from the UK. I went to their U.S. site and saw a belt for about $13. When I went through to pay, they were asking for over £100 postage, basically for a rubber band. I contacted them and they said it was due to customs etc., which is ridiculous. So my expensive vinyl player is currently driven by a drive belt, cut to size and super glued together.

    When I was a kid I had one of those snack lunch kits that I'd take to school almost every day and one exploded in my lunch box. My mom ended up calling their questions and concerns number. Next thing I knew, we got a big gift basket with stuff from all kinds of brands, Koolaid and life savers being two I remember, and it was great. I still have the koolaid spoon that was in that basket. You will never see that out of these big corporations ever again with the way things are moving now.
    Usually when relationships are this one sided all your buddies are in your ear telling you that you need to leave him/her, but I don't know what any of us can do against these sorts of problems in this age.

      Companies still do this. I got a huge chunk of rubber in a hamburger helper packet last year and they sent us a ton of coupons for heavy discount on their products. I also got an oatmeal cream cookie that was missing the cream and they sent us a bunch of random snack boxes. They're just bribing you so you don't sue them in the end its a gross practice.

      Louis, there's a similar topic you might want to look into.
      - Riot Games, devs for League of Legenda are adding their proprietary Vanguard anti-cheating system originally used for Valorant to League of Legends.
      - it's kernel level and this was announced mere months after a massive hack/data breach. Kernel level access for hackers would make hacks even worse.
      - Due to its nature, Vanguard runs on boot and is always running in the background, regardless if you're playing their game or not.
      - The main League of Legends subreddit which is under Riot's thumb was heavily censoring all dissent. All independant subreddits had a majority of negative opinions about this.
      - Players who may have played the game for years and/or spent money will not be able to access the game unless they install the intrusive spyware/anti-cheat
      - League of Legends has at no point ever had any issues with hackers/cheaters and the measure is unnecessary
      - Vanguard also breaks modded clients (for content creators to have better camera controls) and minor mods like custom skins.
      - Riot is owned by Tencent
      - Vanguard also means that a game that previously was widely accessible on a global scale will now lose a decent chunk of its users due to requiring TPS 2.0 from what I recall. Many people have no financial stability due to place of residence to even purchase a Win10/11 ready machine. Lots of people were running the game on decade old laptops.

    I can tell you when it happened. It was back in the late 90's when virtually all software became subscription based. Finding a proprietary one time payment license on software today is unheard of and even if you do pay for one at a massive amount they have features that are locked unless you pay for a subscription or sign up for a newsletter/club. This is something that has been going on for 30 years that basically limits your software and support and increases potential payments at any time to whatever they think they can get away with.
    Nothing like have tens to potentially hundreds of hours into a game or software platform then they change things. I don't want my freaking cash back I want the time I have into the thing back that my "grandfathered" agreement should honor.
    You don't want to honor that legal grandfathered agreement? Fine then cut me a check for minimum wage in the state your based for every hour I have using your software/game.
    They would go bankrupt overnight.

    Bottom line: many companies have switched from selling you a simple product to selling you a product with an integrated non-negotiable subscription service without which the product doesn't work.
    Solution: refuse to buy into their new business model, and hold onto your old stuff as long as possible. Or ignore the warranty and rip out the "smart" stuff. Many appliances under the hood still use motors, solenoids and switches and can be made "dumb", forgoing one or two "smart" options.

      But you are right, it is not really "new". I remember in 1988 Minolta coming up with their "Creative Expansion Card" business model to help photographers deal with the "insurmountable" problem of setting focus, aperture and shutter speed; I though that was a slippery slope then 🙄

    I dont pay Apple TV, Netflix or any other crap yet I watch all the top shows and movies the moment they are available.
    I never payed for any game, just for hardware.
    Software is free for me, well actually I use to buy empty DVDs to burn stuff or memory sticks ectr.. But again just hardware.
    I watch all the content, played all the top games and never payed a cent for it.
    I am serbian, so it comes natural for me. It is not about the money itself, I can afford to pay but I decide not to because there is another way.

    As Temple Granden put it years ago, "when bad becomes normal". As time goes by, people are no longer taught why they stand up for their rights. Corporations have always been scumbags until the courts forced them to work within the confines of the law. The problem today is we are back to something similar to the turn of the last century and lawmakers are letting it happen since they are as corrupt as they come as well. Lawsuits are the only answer to this and I hope some class actions start taking place. Thank you for the updates.

      Luckily I don't give a single microscopic f==k about any company at this point. (10 years or so)
      I got locked out of Steam few years ago and it was the best day ever, the 1st day it felt like the world fell apart more because I wasted time trying to get back into it through different means so I can play some s==t with one person online but the next day or two later when I overcame the fact I am wasting my life, I had an awakening and realization that I got rid of one of the horrible addi==ions and burden in my life and I have no more excuses to come back to PC games whatsoever.
      Years ago I had to make up long stories why I don't play some games anymore and why I avoid "friends" who still play them, ever since I lost access to Steam I simply say it doesn't work on my old PC and I wont buy a new PC so that is all.
      Additionally I add "I dealt with the facts you should too".
      My suggestion is deal with it and move on ... Never repeat the same mistake. From one of which is support idi=tic corporates who f==k you over daily, stop funding this pointless trash and rather do something useful with your money and more importantly with your time of life since life is too short!
      Even calling it trash is way too generous because I tend to find good things in trash ... but that is a story for another day ...
      I am now broke too, but even if I would not be, I am honestly done wasting time and money on these things.
      When ever I had extra money I donated it to someone who actually is struggling.
      On a related note I even got banned from gaming groups and official pages etc whenever I said that I don't buy games or support "gamers" and instead donate the money to charity and people in ACTUAL NEED ... they kicked me out with nasty messages as a follow up ... yeah you have to realize who these "people" are and what they do ... they are parasites and most of them run fake charities too so be careful who you donate too!
