    Live Coverage: WI v. Kyle Rittenhouse - Kenosha Shooting
    REMINDER of the judge's ruling in defense use of force expert testimony: Schroeder told the attorneys that Black wouldn’t be allowed to testify about what Rittenhouse was thinking when he pulled the trigger or whether he definitively acted in self-defense.
    Assistant District Attorney Thomas Binger said if Schroeder allowed Black to testify only about the timeline of events that night he wouldn’t call his own expert to the stand. Defense attorney Mark Richards agreed to the deal.
    Charges:
    1. First Degree Reckless Homicide, Use of a Deadly Weapon (Joseph Rosenbaum)
    2. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (Richard
    McGinnis, reporter for Daily Caller, not injured but near Rosenbaum when Rittenhoue
    fired)
    3. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (unknown male)
    4. First Degree Intentional Homicide, Use of a Deadly Weapon (Anthony Huber)
    5. Attempt First Degree Intentional Homicide, Use of a Deadly Weapon (Gaige
    Grosskreutz)
    6. Possession of a Dangerous Weapon by a Person under the Age of 18 (JUDGE DISMISSED THIS COUNT ON THE DAY OF CLOSING ARGUMENTS)
    7. DISMISSED AT THE END OF STATE”S CASE. Prosecution failed to put evidence in front of the jury that there was a lawful curfew in place (appears to be an oversight by prosecution) Defense moved to dismiss, judge agreed. Fail to Comply with Order of Local Government - Emergency Management Activity (citation, carries no penalty) - everyone present was breaking the 7pm curfew issued by the sheriff.
    Possible Sentence: Max: Life in Prison Without Parole (WI does not have the DP)
    JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
    Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
    Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
    Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

      @@lesliefranklin1870 Yes and no. 3 days of deliberation implies that they're kicking the can. I'm positive they already know what verdict they would turn in, they're just terrified of the mob literally outside the building, and the jurors have been doxxed so their personal safety is as risk too. That's why it's taking so long, and I honestly don't even see them turning in a verdict today.
      In the end, I actually predict a hung jury. They don't want to get killed.

      @@Nathan-dt2tu if they thought Kyle was guilty the verdict would’ve come out day one so I agree. BEST CASE SCENARIO for prosecution is hung jury. And the judge I believe can still declare mistrial with prejudice if they come back without a verdict. Otherwise the prosecutions case will just get a lot harder next time they charge him.

      @@Nathan-dt2tu I've been on several juries. They really don't want to be there. Despite the evidence, there's always at least one who wants to convict and at least one who wants to declare not-guilty. Plus, this really is a complicated case with several charges. The big question is "did Rittenhouse provoke those around him?" That is likely why the jury asked to see the video evidence again.

      @@lesliefranklin1870 In general, I'd agree with you. But there's a mob waiting to riot outside, MSNBC tried to doxx the jurors, and literally the whole country is watching, with implications on the president.
      I think this is a very special case.
      Oh my Jesus and they ended a 3rd day of deliberating without a verdict. Even more than this morning, I predict a hung jury.

      Unfortunately all the people who watch television crime shows which are filled with police and prosecutor misconduct believe that a person is guilty until proven innocent. And they fail to recognize that the judge has a higher responsibility to the accused, than to the prosecution. When a person is accused of a crime they have the resources of the state, which are enormous, against them. The judge is supposed to be at least neutral , or lean towards the rights of the accused.

      incorrect. it is not open a shut and the jury is doing their duty to make sure things are done legally. when you perform jury duty you want to do it right and make sure you have the legal reason as to that right or wrong count. they want to see the video as to make sure kyle was in fact matching his story as to what is seen in the video. its funny how we can say one thing but in fact via video do something else.

However, after watching the trial in it's entirety I have seen that there was a massive amount of misinformation on this case and right now as it stands the facts don't support these 3 people as being Victims. Which you're right was why we needed the trial. But right now based on what's been show IMHO these 3 look like they were assailants and the defendant did nothing outside of defending himself from imminent bodily harm.

      And the Jude, prosecutor and defense (who all have a degree and experience) seemed to be ok with making that call later or else the defense could have had complained, but he did not.
      So how are we to make a call like “OFCOURSE we do the prosecutor didn’t hand over that full video”.
      We should stay calm and keep a level head.

      No it would only be a mistrial if:
      1. The instruction actually says what the defense claims it says
      2. Enhanced footage was actually used.
      (3. I think there is a way you can retroactively delete evidence from the trial but I am not sure on that.)
      But I guess we will find out in court and not in the comment section of a CZcams video.
      Let’s all keep calm and a level head until we know more.

    Dismiss with prejudice, thank the jury for their time and stop this criminal prosecution. Remove Binger’s law license and charge him with any crimes committed by withholding evidence and his many other lies during this process.

      I doubt. Why was this mistrial being brought up now? How do they know the state didn't know about this footage? How many cameras and phones filmed this event? Who owns the drone? There questions to ask. This is why you might not be a lawyer. You see shear statement as truth. When most motion of dismissal are done early, and late dismissals are late attempts to "win" a case against you. The defense must know more information that could hurt their case, as they are also petitioning motion of dismissal with out re-file. This means the case can not go to trial. A filing of motion of dismissal is also a strategy a defense uses when they are struggling in case as they are looking for an I not dotted.

      The problem with that is that way, they can start new proceedings against Kyle whenever they want. A mistrial is not a declaration of innocence. A Declaration of innocence cannot be re-tried because that would be “double jeopardy”.

      @@MynameIsnotforsell It was brought up last week the judge hadn't ruled on it yet because the prosecution hadn't responded, probably because they have no justifiable response, they just hope the jury comes back with a verdict before the judge rules on the mistrial request. The defense brought it up again after learning the file was intentionally changed it has a different name, file size, and time stamp for its creation. If the judge actually puts the prosecution on record under oath they might very well get disbarred. Kraus stated he has no knowledge of video encoding or anything like that, but he has the encoder software installed on his laptop, that was displayed to the court when he showed the video in question originally, the app is in the same folder as all the video clips. They intentionally lied to the court and falsified evidence by changing the file size given to the defense, a file they presented at the last possible second when they had access to it for over a year. It appears the judge is allowing the jury to agree on a verdict; if not guilty as it obviously should be then he will do nothing which still is insane as these prosecutors should be held accountable, if they somehow come out with a guilty verdict from fear or as a hung jury he will declare a mistrial probably not with prejudice as he as stated he wants a jury verdict on this. The next major issue at hand is the FBI "losing" the HD video clips as well as the FBI contractor hired for recording all this closing his business and disappearing. If the FBI withheld some evidence and destroyed some to protect a narrative, which I think is clear they are fully capable of doing, there needs to be a serious congressional follow-up on this. This has gone way beyond this kid, this is the government acting outside the law in seriously scary ways.

      @@suspicious2delicious The entire reason a 17 year old kid was there in the first place was because public officials told the police to stand down, refused the national guard, and denied the violence was to advance a political agenda.
      Our media convicted the kid before he was even charged, spread lies to the public, and is now encouraging more riots if they dont get their way.
      The one who should be on trial right now is Evers and this worthless DA. The only thing Rittenhouse is guilty of is being a 17 year old in an insane society.

      @@TenderViddlez Rosenbaum threatened to kill Rittenhouse TWICE if he was ever alone. Well, Rittenhouse was finally alone. Rosenbaum saw this and clearly tried to make his promise come true. So, after having his life threatened TWICE, Rittenhouse tried to avoid the situation by 1) yelling "friendly, friendly, friendly, 2) running away, and 3) pointing the rifle at Rosenbaum to get him to stop chasing him which clearly did not deter Rosenbaum.
      He exhausted his options and then feared for his life when he 1) heard a gunshot behind him and 2) had his gun grabbed by Rosenbaum. Clear self-defense, so let's stop praising child molesters like they are heros.

That is what the judge was asking and the prosecutor answered a different question. Of course their evidence does not come with a disclosure that it isn't fit for forensic evidence.

      @@01FUMBLE Seems like people are quite polar on this, but I see a bit of where you're coming from. The judge has made some very good impartial decisions, however I do agree with the leftists that the judge is actually on Kyle's side on some of his rulings/decisions.
      My feelings aside (Kyle's innocent in my view, and in my view there's absolutely no doubt of that), this means nothing for the outcome of the trial. The jury is supposed to be getting the information from both sides. The judge is there as a babysitter to ensure proceedings are done properly.
      Some of his actions have been good. Others, I feel like he's gone beyond true impartiality and aligns with the defendant.
      If you feel like arguing real points instead of calling people jokes, feel free to share your opinion. I'll answer.
      Edit: To be specific, one of the worst things the judge did was to be completely oblivious to the fact that evidence wasn't submitted, and ask for the defendant's attorney to confirm such an allegation. Over a week after discovery. A full day after deliberation had started. This is 1) malicious from the prosecution but more importantly 2) This act alone calls questions about the legitimacy of the proceedings, unless a mistrial is declared. Judge has been overall solid, but a few of his actions have needed answers.

The state is the one that has to prove beyond a reasonable doubt and the judge is there that they do so fairly according to the law. The judge hasn’t ruled on anything egregiously in favor of the defense. If he was actually so biased, he would’ve already ruled a mistrial.

      It shows us exactly what happened.
      In the video you can see a mob chasing a kid who then attack the kid. Luckily though, he had means to defend himself.
      One guy kicks him while he fell on the ground, another hits him with a skateboard which can easily kill a human. And the third guy pulled a gun and aimed at him.
      It was an intense few seconds. But luckily for the kid, it was all caught on camera by the mob.

      @@MrSkrifle there's footage of the events leading up to the first shooting too, after the group Kyle was with put out the burning dumpster, Joseph threatened that he'd kill anyone of them if he caught them alone that night. FBI drone footage tracks Joseph leaving the altercation then waiting in Ambush as Kyle runs by, Joseph intercepts and starts to give chase along with 2 others one fires a Glock into the air behind Kyle, he turns around to see Joseph chasing and the 2 others and keeps running, joseph catches up and makes a lunge at Kyle. There was no time for Kyle to know if all three 3 were trying to rush him and with the gun shot fired just moments before Kyle's turns to see Joseph lunging and fires for fear of his life.

And that Rittenhouse would have had no way of knowing or processing that Rosenbaum was disabled within three quarters of a second. And that a 150 lb person at full run lunging at him would tackle him into a car and do considerable damage even before he was able to get his hands into position to defend himself. And losing access to his gun really wasn't a reasonable option given that there was a gunman who had already fired from nearby and Rittenhouse might have needed to defend himself against.

      The defense should have been able to review the footage, and they didn't get it until after they were allowed to bring evidence. This is shady getting shadier

      It's clear when you see video evidence. It's not clear without it. If it was shown in a screen and jury were not able see it from close enough or properly, then it's hard to know for them without checking it. That's basically the main reason how you know it's self defence, because you've seen it properly on your computer's screen.

    The back-and-forth in this trial is insane.
    The prosecution and jurors are clearly trying to get a mistrial declared, so that they don’t have to take any blame and can use the judge/courthouse rules as their scapegoat.
    The judge can see what they are trying to do and is doing his best to just get the just outcome from the jury - acquittal.
    I hope the judge doesn’t give in.

    Negative wrong answer. You do not bring them to court to view video under scrutiny of lawyers.
    Since the beginning of time jurors have been able to handle the evidence, examine it during deliberations.
    What complicates this is the prosecution's withheld high-definition video. Now you cannot show them the low-def manipulated video.
    But, you send every file into the deliberation room give them good high-definition fairly good-sized screens to view it on. Do not give them the low definition manipulated video, but rather Just a note saying it has a legal challenge and they will need to rely on memory on the Drone footage.
    Censure the prosecutors for withholding evidence.

      Yes I was on jury duty and the judge said ( rely on memory) the same thing to me on a fender bender case. Guess what I was against a high pay out. Went back in court said no, sent back to try again and less of 5 mins. Came back to court and I agreed with with everyone for a pay out of 250,000.00. guess I won't get called again. I told the judge and defense attorney what they did was wrong by not informing the jury on their duties step by step.

    This case is pretty cut and dry, but there is always one juror who doesn't seem to get it. This case should have never been presented. If he is convicted it is a travesty and miscarriage of justice.
