Kyle Rittenhouse prosecution accused of withholding key evidence, defense demands mistrial

  • While the Kyle Rittenhouse trial is in a verdict watch, the defendant's defense attorneys file a motion demanding a mistrial over evidence they say was withheld from them by the prosecution. The defense claims a high-quality version of the drone video showing the shooting of Joseph Rosenbaum was not given over to the defense until after all the evidence had been presented. Meanwhile, jurors in the case have asked the judge about whether they should view videos of the incident in the courtroom or inside the jury room.

      They used a Dropbox to send it on Friday, the lower quality video was already showen and the defense said Kyle pointing his gun was the Duramax turn mirror.

We can’t assume that we can count on him to make the right call, deescalate, and not accidentally shoot an innocent person in the face. Everyone that attacked him were also stupid. He had the right to protect himself and his own property but as far as I know it’s not legal to protect others with deadly force so I think the defense is trying to make it seem like that wasn’t the case. If he was at a friends or someone needed assistance I’m pretty sure that’s the exception. I think the fact he had to kill two people kind of proves this was dumb

      Would it have made a difference if he went unarmed?? Yeah, Kyle would've been killed. Gun or no gun he went to help anyone he could.
      Personally I feel he showed remarkable resolve & control. He didn't just spray bullets , shot only the ones pursuing him to either kill him or to grave harm...

      There wasn't any evidence withheld.. its a bunch of old people that don't know how technology works. The issue was a compressed file had diffrent levels of quality between the defense and prosecutors and no one knew until the day prior to trial... the title is framed for the algorithm and designed for sensationalism

      the evidence that is so call withholding is a a drone shot video released by Fox that has a higher resolution that the copy submitted to the court showing Kyle have all the empty space he could escape, but decide to loop back to the dangerous scene. Of course the defendant would like to dismiss the evidence.

    I hate to say it but it seems like there are two very basic strategies:
    PROSECTION: get a mistrial called (and then filing to retry the case with different prosecution staff)
    DEFENSE: get a mistrial called with prejudice (meaning the case cannot be tried again).

    This is an open and shut case of self-defense.     The video evidence should be seen in real time. Binger showing slow motion and freeze frame video makes it seem like Kyle had a couple weeks to react. In reality he had precious few seconds in a life or death situation to react.

We DO NOT want a mistrial OR a mistrial with prejudice. We want the jury to be allowed to do their job and hopefully they do their job correctly and Kyle receives a full legal acquittal.

    This is so illegal what the state has done here. It should be declared a mistrial with prejudice immediately. Withholding basic evidence clearly violates the defendants right to full discovery. If this was anyone else this would all be over.

    The entire prosecution team should lose their law licenses for clearly using political slant in their positions. I haven't watched all of the trial but have witnessed 2 speaking States attorneys acts of treasonous/unconstitutional accusations against the defendant In fact, one of the charges deprives the defendant of his right to protect himself.     Kyle is fortunate to have a judge that was dedicated to a fair trial and not trying to pander to a political agenda. The judge recognized and called out the efforts to discredit him and the process. There was a lot of pressure on the judge and he resisted it. Same way now with the Supreme Court.     There HAS to be a mistrial at this point, the prosecution has fudged this from the start, all the way through. Witness tampering, trying to use 5th amendment against the accused, and so many other things. EVEN IF a conviction comes out of this, the door is so wide open for a successful appeal you could drive a fleet of trucks through it.

    This is a good move by the defense. The jury has been out WAAAAAY to long to feel comfortable with an acquittal. Imho they were gonna hold this card in case of a quick conviction as it would play great in appeal court or wait until we got to this point in deliberating to make the play for a mistrial, hopefully with prejudice.
    Now from and America citizen standpoint.... a mistrial, even with prejudice, is not enough to feel comfortable in the 2nd ammendment and right to self defense. Not guilty please

      @Lone wolf I'm so sorry that your education system failed to teach you basic court rights.
      I'm not in America and this is basic to not bring evidence without stating it pre-trial, to not interrupt the judge, to not breach Right to Remain Silent, and importantly, misuse Public Tax for Kangaroo Court.
      Last time they jailed a grandma for stealing sandals (A single damn pair of sandals worth $2), the court got destroyed.

    As someone that has had jury duty more than anyone else I know I love how the judge addressed how jurors are treated. It interrupts our lives, we get screwed out of our wages and we get locked in an awful little room for hours at a time and we're treated worse than anyone who has committed a crime. Other than staying that. Kyle is not guilty!

      @Lone wolf Not a vigilante. Dude was armed, but so were plenty of rioters-were they all vigilantes? He didn’t fire his weapon to act out vigilante justice but to defend himself when he was on the ground being charged at by multiple ppl-that’s allowed.
      Really stupid kid for showing up at the riot at all, particularly with an AR. But not a vigilante in the final analysis. That’s why the prosecution is having so much trouble

      He would have been in that position anyways. He went there to protect his father's house from a fire. And because he was armed with a deadly weapon he thought he could intimidate people so he went around playing the Vigilante trying to protect other people's property. Riots are what they are people are going to destroy things in riots he had no business defending people's property that's covered under insurance. The Engage The Mob and then they chase them and now he's claiming self-defense he started it. He might be a serial killer he's 18 and handling a gun and now he's claiming self-defense. He's guilty clearly.

    The judge has allowed things in the trial against his better judgement. That shows weakness. It hurts Kyle's right to a fair trial.

      Got an example? He prevented the defense from showing a video of Kyle days before the kenosha talking about how he wanted to shoot looters which could have been pretty damning.

    Shouldn’t this be a mistrial with prejudice already???? Mr. Rittenhouse should be found not guilty but the deliberations is taking to long…a not guilty verdict which should have come out shouldn’t take this long….the corrupt prosecutor threw in extra charges which are lower level crimes but the prosecutor is reaching high….

      That’s not true. The fact that it’s taking so long I feel is a good thing. The George Floyd decision came quick and it was guilty. There are probably a few that think he is guilty and ones that think he is innocent. They have to convince each other.

      @@j.h.3927 Chauvin was most certainly guilty of second-degree murder. Rittenhouse is not guilty of the crimes charged, but some on the jury likely believe he should be guilty of something and are holding out.
