  • The prosecutor and judge in the Kyle Rittenhouse trial had a full blown argument in the middle of the courtroom over the prosecutor asking Rittenhouse about a prior incident before the shooting that was not supposed to be brought up to the jury. The judge screamed at the prosecutor for violating his rulings and warned him about the ramifications of continuing along this path.

    Trying to use the defendant's right to remain silent as an indication of guilt should automatically have that prosecutor disbarred. That is blatantly unconstitutional, and any lawyer should know better than to try that.

    I guess the right to remain silent shows your guilt according to this prosecutor. I guess when cops tell you you have the right to remain silent as anything you say can be used against you in a court of law means nothing to this prosecutor. This prosecutor outright violated Kyles constitutional rights via the 5th amendment. He should be disbarred and held accountable.

      Yep. And any lawyer worth a penny will tell you that talking to the police aside from giving your name, age, address, ID, your lawyer's business card, etc. can only get you in more trouble. There are countless innocent people who have talked themselves into criminal charges. Often they're found not guilty in court. But still if you've just defended yourself against a would be murderer, you're already in enough trouble in the eyes of the police. And you don't wanna make your expensive criminal trial even more expensive than it has to be by making the police believe you've done a bunch of other illegal things. For example: "I've never done anything wrong! I'm innocent! I may have pirated some movies, but I'm no murderer!" See what you just did there? You admitted to engaging in piracy.

      Murder is not permitted, killing in self defence is. There are multiple instances of people killing others in self defence or in battle within the Bible.     His intent was to provide the jury with his opinion on a matter that he knew he was already instructed not to bring up. The jury doesn't know how these procedures work and even if told to ignore it they will still have heard it and won't forget it.

      I agree, I def. didn't care for this prosecutor's actions & attitude either! This prissy(or should I say, down right pissy!), condensending, arrogant prosecutor was treating the defense wittness's, w/ a totally different attitude or sometimes in an unlawful/unconstitutional way, then had a totally diff. attitude/approach, towards any state wittness's! Not a good look, esp. on TV, or to the jury! This is a trial, everyone is presumed innocent, until found guilty! He should've had the same attitude & approach with everyone! I sure didn't see a difference in the defense attorney's manner of questioning towards state or defense wittness's! I was totally disgusted watching, at times, but, sadly, it happens in court all the time & most judges let them get away w/ this behavior! 😣 Actually both prosecutor's acted this way throughout this whole trial, but, Binger was 10x's worse! 😝

    Our Justice system is broken, the fact that I can get into legal trouble for pointing a firearm at someone destroying my property and possible livelihood not knowing if this criminal is hiding a gun is absolutely ridiculous.       I come from a family of hunters and gun enthusiasts. I do own archery hunting equipment but do not have any firearms in my house. What went on in that city where Kyle was forced to act could easily have been my brother protecting my family and property. That was one brave American, more than likely scared but no less brave.     I LOVED every second the judge yelled at him. I was absolutely thinking the same thing judge argued about.
    DA was such an easily hated man while being very disrespectful to the magistrate.

      You think it’s fair if say someone made a comment back in high school saying they’d shoot someone if they tried to steal their stuff then say 15 years later they end up shooting someone under different circumstances? You think it’s fair a jury should hear that in an attempt to bias them in to believing this guy wants to shoot people

      Too minor at this point for a mistrial and judge will likely explain they are to disregard the line of questioning the prosecutor was saying. If the prosecutor keeps it up though these minor things combine together to be considered enough to suggest prosecutor is doing it intentionally to sway the jury then like the defence said they’ll ask for mistrial with prejudice which means mistrial AND the case can’t be retried. (Aka prosecutor is on thin ice cuz if that happens he’s probably getting fired so he will likely stop these shenanigans now)

      Greusskreutz (probably misspelled... don't care) lost the case. There's no coming back from that picture where his arm is being liquified and he has his gun pointed at Rittenhouse. That picture illustrated with zero question whatsoever "Kyle's life was in danger. He was almost killed." Once a Jury knows that, you're no longer trying for conviction. You're trying to split the jury. There ain't no damned way you're getting 12/12.

    That man knows procedure. Prosecution was trying a dirty tactic he saw on a movie somewhere, and was attacking character of Rittenhouse prior to the crime in question. What a scummy tactic. It is like saying you said this or that before the incident that must be the reason your did it then, so you have to be guilty. The state never had a case from the get go and they were running out of steam at this point.

      Rather than taking a stand for a defendant, he is doing what a judge should do and that is as an umpire and applying the Courts Administration Rule of Law, he could rule for either side depending on who is breaking the rules.

      It actually not as unprecedented as you think. They used that argument in the Columbine shooting case as well. The idea that kids play these violent games and then try to act it out in real life with the idea of actually hurting people.

      Judge is suffering from some degree of dementia. 75 years old? The research that they have now done shows that process can actually start happening when people are in their 30s. So he's probably well into it. Confusion, memory lapses, lapses of logic, irritability. Prosecutor is much more with it, regardless of whether you admire his prosecutorial approach or not. That's besides the point. He's much more with it. Judge needs to retire.

      As a former criminal attorney's paralegal, I agree 100%. Never say that phrase. Never interrupt the judge either, or get a smirk on your face when a judge is already mad. I've seen some things in courtrooms, and those instances were always the wildest.
