WI v. Kyle Rittenhouse Trial Day 10 - Defense Closing Argument by Mark Richards

- Live Coverage: WI v. Kyle Rittenhouse - Kenosha Shooting
REMINDER of the judge's ruling in defense use of force expert testimony: Schroeder told the attorneys that Black wouldn’t be allowed to testify about what Rittenhouse was thinking when he pulled the trigger or whether he definitively acted in self-defense.
Assistant District Attorney Thomas Binger said if Schroeder allowed Black to testify only about the timeline of events that night he wouldn’t call his own expert to the stand. Defense attorney Mark Richards agreed to the deal.
Charges:
1. First Degree Reckless Homicide, Use of a Deadly Weapon (Joseph Rosenbaum)
2. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (Richard
McGinnis, reporter for Daily Caller, not injured but near Rosenbaum when Rittenhoue
fired)
3. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (unknown male)
4. First Degree Intentional Homicide, Use of a Deadly Weapon (Anthony Huber)
5. Attempt First Degree Intentional Homicide, Use of a Deadly Weapon (Gaige
Grosskreutz)
6. Possession of a Dangerous Weapon by a Person under the Age of 18 (JUDGE DISMISSED THIS COUNT ON THE DAY OF CLOSING ARGUMENTS)
7. DISMISSED AT THE END OF STATE”S CASE. Prosecution failed to put evidence in front of the jury that there was a lawful curfew in place (appears to be an oversight by prosecution) Defense moved to dismiss, judge agreed. Fail to Comply with Order of Local Government - Emergency Management Activity (citation, carries no penalty) - everyone present was breaking the 7pm curfew issued by the sheriff.
Possible Sentence: Max: Life in Prison Without Parole (WI does not have the DP)
JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

Not enough cops but that's why every state has a national guard. It's the mayor's and the governor's fault for not doing their jobs. Every piece of damage and life lost should be on their heads not on those defending themselves, they shouldn't have to defend other's properties or themselves if those in power actually used what is at their disposal. Why are we still paying these idiots?
I agree 100%
The moral of the story is folks: kid shot at people attempting to assault him and went no farther in attacking any more possible victims, not one extra person was killed or attacked. He showed restraint, and only attacked when provoked. Don't assault people. Do not think you'll be invincible in a mob. You'll find whats coming to you if you do.
Ranged level?
I can't even imagine the mindset of people in the mob chasing him.... "hey that guy with a gun just shot someone, I guess I'll go try to get shot too!" If he just "wanted to kill people" he could have turned around at any point and just started blasting every person there.
Moral of the story is don’t live in cities. It sounds stupid and simple but honestly every city is going to turn into Detroit at some point. You all know what I mean
Rosenbaum never touched Rittenhouse or anyone else that night. It's a sad day when Americans like CB are calling for pre-emptive execution for pre-thought crime. The right is dragging us into a fascist totalitarian state.

Mr Richards is and outstanding Defense Attorney! He proven his case admirably! I certainly hopes he prevails.
Sorry but those were the most disjointed and weak points to make in closing arguments. Compared to the defense's poignant points the defense did horribly.
He doesn't object enough. He should have played the video from beginning to end at full speed.
The prosecutors closing statement was putting the whole case in a trial where there can't be reasonable doubt to convict on a incredibly blury video where you can't see anything, then told the jury Kyle should have just tried to fight off the armed mob with his fists. They couldn't have made a worse closing argument if they tried
I do not know how many trials you have seen, but this is clearly NOT a well-structured closing. This lawyer clearly needs some lessons in trial advocacy…
@@nutsallinyomouf huh?
Thank you Richards for telling the truth, the whole truth, and nothing, but the truth, and exposing the corrupt DA's lies and shady tactics. SELF DEFENSE, NOT GUILTY
Absolutely well said Kristen, the conduct of the prosecution and tactics have been on the border and beyond of honest.
Bahahahaha Yeah the kid that wants to be famous with his ar15 was there to protect property. You’d have to be brain dead to believe that.
Pray for the jury as they deliberate, for clarity and courage
Can you guys imagine how different this trial would have went without the video evidence?

I'm not seeing it. Both sides have massive holes and both are not being honest.
@@kevhavard lawyers? not being honest?
@@kevhavard The prosecution has to prove beyond a reasonable doubt that he was there to kill people. Not only is there reasonable doubt, most would argue the defense met that unneeded standard. That Kyle was clearly there to help people, and was well trained and disciplined with his defensive weapon, unfortunately having to use it
@@jlheathfam2 I'd agree with most of that. But in no way was he experienced enough to walk into a bunch of nutty rioters on his own, that was his mistake.
@@kevhavard Originally I thought as you do. Surely there's an element of luck, but if you watched the videos, he did an amazing job. He gets knocked to the ground, kicked and spun around, holds onto his weapon and shoots the actual threats. One guy puts his hands up and steps backward, and he immediately moves to the next threat. Guy has his gun pulled away, and he still has presence of mind to pull the trigger. He threatened no one who wasn't a threat, correctly identified who was, all with a ton of adrenaline and multiple threats, in the dark. He was absolutely well trained and had more presence of mind and control than 98% of American adults would have. It's not Kyle that should have stayed home, it was Rosenbaum et al.
The prosecutor is a politician more than a lawyer. He tried to sabotage his own case until the judge got onto his antics.
Nearest I could tell, he was sabotaging it unwittingly the entire trial and all the way through closing arguments. When the charges are false and political at the outset, it may have been asking a lot of the prosecution.
This argument really doesn't hold up though, and it borderlines on conspiracy theory. If the Prosecution would have continued to make errors, the Defense would have pushed for a mistrial with prejudice, thus barring the prosecution from every bringing the same charges against Rittenhouse. Given the apparent poor relationship between the judge and prosecution, it could have been a real possibility.
@@meltee01 It holds up if it's a prosecutor that's used to getting away with crap like this, or one that's stupid. I think it's both.
@@meltee01 Consider not using the term 'conspiracy theory' as if it were a madness. It is an ad hominem in any case. People are political, do think and organise themselves for agendas (overtly or not) and (get this) people do organise collectively in an interest (they conspire). Our entire sad 'reality' today is as it is because very powerful forces argued, lobbied and organised to bring major aspects of it into being (think tanks, PR companies, corporate lobbyists, background lobbyists, strategists, political movements). Try reading a little of the entire oeuvre of historical literature or historical journalism. The phrase is a modern equivalent of tarring and feathering and is childish. So true..Many people would have shot way before that mob ever got close.Getting hit by a skateboard or kick could have resulted in him loosing consciousness and his life. But those lunatics must have been on some type of strong drugs to be chasing someone with a gun.
Pretty much the only one he honestly should be charged with is having a gun while under age. but the judge dropped it so he better walk free

I have very different political beliefs than Rittenhouse seems to have, but that is irrelevant to the facts; after watching the videos and hearing all the testimony, you can hardly find a clearer case of self defense than this one. I am concerned that the hype around this incident will prejudice the jury (let alone the antics of the prosecutor last week) and I hope they reach the proper conclusion. Yeah he was a dumb kid for being there unnecessarily, but that doesn't invalidate his right to self defense; he had as much right to be there as anyone else, and every right to defend his life from the people openly threatening him, chasing him, bludgeoning him, and pointing pistols at him.
was it necessary to have the rioters there?
3 days of riots allowed to happen, but bring in 500 soldiers in case the verdict doesn't come in the way the mob wants? The FBI had a surveillance craft overhead the entire time, but NO soldiers were on the ground while the police did nothing. @@jonathanhorvat2452 lol…k. Anyways I didn’t even say he was guilty, I’m just saying he’s an idiot for putting himself in that situation. That’s why there’s a trial. His actions seem to have effected him deeply, he took two lives that night after all, wether in self defence or not, that wasn’t no video game he took part in.
the deadliest shots are the ones that don't fire
Thank god for videos, right there.
The right to protect yourself.
I love Mr. Richards. Fantastic closing argument
If he is found guilty we are no longer living in the land of the free! End of story! Kyle is Innocent
If found guilty it means we truly cannot defend ourselves anymore
Binger does have a good poker face look at that snake lol
Man that prosecutor messed up big 🤣🤣🤣🤣🤣 this is one of the largest publicized trials in modern history and he completely botched this his career is dead
Its why he was chosen to be the fall guy cause the real DA didnt want to touch this case with a 10ft pole know they would lose.
@@davidmagee4468 And almost certainly knew that with BInger's political aspirations he'd jump at the chance of getting what I can only imagine Binger thought would be an easy conviction given the political climate in that area of the country.
@@davidmagee4468 wow didn’t think of that until now, but that makes perfect sense and I’m sure is what happened. Any prosecutor with a brain wouldn’t touch this case with a ten foot pole, just like you said. 👍
watch and see how it's not going to matter. they got an activist inside who will just hang the jury, cause mistrial and they will go again. state has unlimited resources, unlike Kyle. this is the current state of America, decline and on a way to disintegration. it will only end with big blood. the fact this clear cut case is even in court is a horrible sign of things to come. there is no compromise or political solution left.
Oh no!
....
Well anyway.
Why don’t they have an empty chamber flag in that firearm? SMH, bunch of simpletons. Goes to show you that the Law Enforcement in charge has no clue either. That is standard procedure at every gun range.
How the Police dealt with the case should tell you what you need to know about why they didn't! lol
As a former Deputy of 11 years, Kyle did and acted as we were trained, to stop the threat if you can't get away.
The Prosecutor looks like Little Finger from Game of Thrones
Haha … Little Finger and an evil, balding sidekick version of Samwell Tarley. You’re spot on with the Little Finger comparison … they look alike but, more significantly … the slimy factor.
Its Little Binger
@@WhiteRussianAK477 Lol!!
Lies must shout, the truth whispers.
He went to the protest with any Asult Rifle because he knew it would give him better protection.
There needs to be much harsher penalties for prosecutors that knowingly lie, misrepresent, and over-prosecute defendants. Possible disbarment is not a sufficient deterrent.
He really proved both how many lies Binger and Co had told and how much common sense they lacked. Not to mention how suspicious the state and FB.1 has behaved, trying to harm the case due to politics. Easiest verdict, self defense against a violent mob.
As tragic as the story is, he is innocent
Right, i'm not going to sit around the bush, before the trial I was disgusted by Kyle, and never understood why he put himself in that position. Now im disgusted with the prosecution for willing to lie despite the facts being against them, to attempt to lie themselves to a guilty life in prison verdict. That's pure evil. They are supposed to be the one's who are in favor of the law, not bend and break it. This trial will go down in history, and will be taught in law schools forever. Mark my words. Surely Kyle walks. Even if there is a mistrial no devastating facts will come out against Kyle.
What's tragic about it, other than Kyle having to go through this charade?
Criminal idiots out to destroy property and terrorize the citizens of a relatively small town, over another idiot wielding a knife against the cops!
They didn't get in enough destruction the two days prior and continued to escalate their non-peaceful rioting!
The citizens are finally coming together, albeit slowly, seeing this utter disregard of law and order!
It is an organized effort, openly exposed by Bernie Bros.! They said Milwaukee will burn, and they mean it!
They've slipped back into the shadows of Obiden, and they will tear down society as we know it, they've openly stated it on video prior to 2016 when HRC stole the nomination from Bernie, and it has escalated since Joe was installed before him!!!!!!!!!!
@@jleif7736 An honest.prosecuter would have dropped the charges.
I like Kyle's Attorneys.
The Prosecutors are jerk holes!
I was wondering if the jurors thought the same thing?
he's got the MyPillow attorney defending him
Slime balls !!!!!!!
@@chrisbea49 your pillow has an attorney? Is it suing you for biting it too hard?
not sure why Kyle is not even hailed a hero after this...
Solid closing argument by defense counsel; it's a shame the court is still using a 1980's Betamax as it's primary recorder. With the weapon charge dismissed I'm hopeful that the jury sees that this was clearly self defense and do the right thing.
Defense attorney: Hold my beer.
What a long closing argument for a case like this.
