WI v. Kyle Rittenhouse Trial Day 10 - Defense Closing Argument by Mark Richards

    REMINDER of the judge's ruling in defense use of force expert testimony: Schroeder told the attorneys that Black wouldn’t be allowed to testify about what Rittenhouse was thinking when he pulled the trigger or whether he definitively acted in self-defense.
    Assistant District Attorney Thomas Binger said if Schroeder allowed Black to testify only about the timeline of events that night he wouldn’t call his own expert to the stand. Defense attorney Mark Richards agreed to the deal.
    Charges:
    1. First Degree Reckless Homicide, Use of a Deadly Weapon (Joseph Rosenbaum)
    2. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (Richard
    McGinnis, reporter for Daily Caller, not injured but near Rosenbaum when Rittenhoue
    fired)
    3. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (unknown male)
    4. First Degree Intentional Homicide, Use of a Deadly Weapon (Anthony Huber)
    5. Attempt First Degree Intentional Homicide, Use of a Deadly Weapon (Gaige
    Grosskreutz)
    6. Possession of a Dangerous Weapon by a Person under the Age of 18 (JUDGE DISMISSED THIS COUNT ON THE DAY OF CLOSING ARGUMENTS)
    7. DISMISSED AT THE END OF STATE”S CASE. Prosecution failed to put evidence in front of the jury that there was a lawful curfew in place (appears to be an oversight by prosecution) Defense moved to dismiss, judge agreed. Fail to Comply with Order of Local Government - Emergency Management Activity (citation, carries no penalty) - everyone present was breaking the 7pm curfew issued by the sheriff.
    Possible Sentence: Max: Life in Prison Without Parole (WI does not have the DP)
    JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
    Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
    Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
    Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

      Not enough cops but that's why every state has a national guard. It's the mayor's and the governor's fault for not doing their jobs. Every piece of damage and life lost should be on their heads not on those defending themselves, they shouldn't have to defend other's properties or themselves if those in power actually used what is at their disposal.     The moral of the story is folks: kid shot at people attempting to assault him and went no farther in attacking any more possible victims, not one extra person was killed or attacked. He showed restraint, and only attacked when provoked. Don't assault people. Do not think you'll be invincible in a mob. You'll find whats coming to you if you do.

      The prosecutors closing statement was putting the whole case in a trial where there can't be reasonable doubt to convict on a incredibly blury video where you can't see anything, then told the jury Kyle should have just tried to fight off the armed mob with his fists.       @@kevhavard The prosecution has to prove beyond a reasonable doubt that he was there to kill people. Not only is there reasonable doubt, most would argue the defense met that unneeded standard. That Kyle was clearly there to help people, and was well trained and disciplined with his defensive weapon, unfortunately having to use it

      @@kevhavard Originally I thought as you do. Surely there's an element of luck, but if you watched the videos, he did an amazing job. He gets knocked to the ground, kicked and spun around, holds onto his weapon and shoots the actual threats. One guy puts his hands up and steps backward, and he immediately moves to the next threat. Guy has his gun pulled away, and he still has presence of mind to pull the trigger. He threatened no one who wasn't a threat, correctly identified who was, all with a ton of adrenaline and multiple threats, in the dark. He was absolutely well trained and had more presence of mind and control than 98% of American adults would have. It's not Kyle that should have stayed home, it was Rosenbaum et al.

      Nearest I could tell, he was sabotaging it unwittingly the entire trial and all the way through closing arguments. When the charges are false and political at the outset, it may have been asking a lot of the prosecution.

      This argument really doesn't hold up though, and it borderlines on conspiracy theory. If the Prosecution would have continued to make errors, the Defense would have pushed for a mistrial with prejudice, thus barring the prosecution from every bringing the same charges against Rittenhouse. Given the apparent poor relationship between the judge and prosecution, it could have been a real possibility.

People are political, do think and organise themselves for agendas (overtly or not) and (get this) people do organise collectively in an interest (they conspire).       @@MyDude57 Well the law didn’t apply to him, he was 16 or above years old. According to the law he has to be under 16 and not using it for hunting purposes in order to break it. It may have not been hunting purposes but he was 16 and older so the judge threw the charge out because the law didn’t apply. So regardless the case was on murder, which was a clear cut case of self defense.

      @@infobahnuser9450I do not have cable. Therefore, I have been trying to find other videos of the trial that I could actually see the video's from the riot's. The ones I found was not showing the evidence on the screen on CZcams. Therefore, I could not see what the defense or prosecutor was showing to the jurors. As a matter of fact. One of the video's stated it could not show the videos of the riot's because it went against the policy of CZcams. So when I found this one I was surprised because I was under the impression it was against the policy of CZcams.

What I could find was the defense using a pointer or walking up to the video of the footage of the riot. But I was not seeing the footage myself. It's as if the footage was not being shown for those watching on CZcams. Until I found this one actually showing the footage.

    Last night, I was pondering why it was taking the jurors so long to reach a verdict on the case, when the evidence is so very clear in Kyle's favor.
    And I thought, it's probably because they're spending most of that time trying to figure out how they're all going to leave the court house once they deliver the verdict.

There isn't any evidence to suggest that Kyle killed Rosenbaum in cold blood, and when he started getting attacked by other "protesters," it only makes sense he'd shoot. Maybe he shouldn't've been there, but I can't blame a guy for defending his own life.

      According to testimony the guy you say that was shot for just chasing, had made 2 death threats against Kyle. Kyle tried to get him to stop once, when he continued to chase and didn’t stop even after being shown the gun , he was shot.. that’s called self defense.. Try using logic the guy who started to chase Kyle did he have a right to chase Kyle? No he didn’t. could he have stopped at any time before he got shot? yes and because he didn’t stop and made those threats to Kyle he was shot absolutely legally. You do know that every person has a right to defend themselves no one has a right to attack someone seems your logic is flawed
      Seems you need to learnlearn the law. If you are legally carrying a gun and you are attacked, you can shoot to prevent being attacked that’s what the law say. Seems like your issue is with the law

    The 4 shots at Rosenblum happened in .75 of a second. The Prosecution then expects Kyle to decide to move away something that is impossible. I wonder why the jury isn't sequestered. I hope 12 jurors find him Not guilty.

    I think you can see what sort of character Kyle is from his actions in life and that night as compared to the violent rioters who who went out to damage destroy burn and seeming hurt anyone that got in there way. It’s self defence and the prosecution couldn’t prove day from night.

    I have very different political beliefs than Rittenhouse seems to have, but that is irrelevant to the facts; after watching the videos and hearing all the testimony, you can hardly find a clearer case of self defense than this one. I am concerned that the hype around this incident will prejudice the jury (let alone the antics of the prosecutor last week) and I hope they reach the proper conclusion. Yeah he was a dumb kid for being there unnecessarily, but that doesn't invalidate his right to self defense; he had as much right to be there as anyone else, and every right to defend his life from the people openly threatening him, chasing him, bludgeoning him, and pointing pistols at him.

      3 days of riots allowed to happen, but bring in 500 soldiers in case the verdict doesn't come in the way the mob wants? The FBI had a surveillance craft overhead the entire time, but NO soldiers were on the ground while the police did nothing. What other possible reason could the national guard's presence at this time be, but for sending a notice of intimidation to the jury?

      As a combat veteran, I didn't take it upon myself to travel to places without orders or direct permission from my superiors. Had I done so, I would have been court-martialed and faced serious jail time. I also couldn't join up without being old enough to be held responsible for my actions, which is why Rittenhouse shouldn't have been in possession of a firearm, been across state lines, or in a danger in the first place.

      Criminal idiots out to destroy property and terrorize the citizens of a relatively small town, over another idiot wielding a knife against the cops!
      They didn't get in enough destruction the two days prior and continued to escalate their non-peaceful rioting!
      The citizens are finally coming together, albeit slowly, seeing this utter disregard of law and order!
      It is an organized effort, openly exposed by Bernie Bros.! They said Milwaukee will burn, and they mean it!
      They've slipped back into the shadows of Obiden, and they will tear down society as we know it, they've openly stated it on video prior to 2016 when HRC stole the nomination from Bernie, and it has escalated since Joe was installed before him!!!!!!!!!!

    Solid closing argument by defense counsel; it's a shame the court is still using a 1980's Betamax as it's primary recorder. With the weapon charge dismissed I'm hopeful that the jury sees that this was clearly self defense and do the right thing.
