Live Coverage: WI v. Kyle Rittenhouse - Kenosha Shooting
Day 4 Jury Began Deliberations at 10:15am ET
REMINDER of the judge's ruling in defense use of force expert testimony: Schroeder told the attorneys that Black wouldn’t be allowed to testify about what Rittenhouse was thinking when he pulled the trigger or whether he definitively acted in self-defense.
Assistant District Attorney Thomas Binger said if Schroeder allowed Black to testify only about the timeline of events that night he wouldn’t call his own expert to the stand. Defense attorney Mark Richards agreed to the deal.
    Charges:
    1. First Degree Reckless Homicide, Use of a Deadly Weapon (Joseph Rosenbaum)
    2. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (Richard
McGinnis, reporter for Daily Caller, not injured but near Rosenbaum when Rittenhoue
    fired)
    3. First Degree Recklessly Endangering Safety, Use of a Deadly Weapon (unknown male)
    4. First Degree Intentional Homicide, Use of a Deadly Weapon (Anthony Huber)
    5. Attempt First Degree Intentional Homicide, Use of a Deadly Weapon (Gaige
    Grosskreutz)
    6. Possession of a Dangerous Weapon by a Person under the Age of 18 (JUDGE DISMISSED THIS COUNT ON THE DAY OF CLOSING ARGUMENTS)
    7. DISMISSED AT THE END OF STATE”S CASE. Prosecution failed to put evidence in front of the jury that there was a lawful curfew in place (appears to be an oversight by prosecution) Defense moved to dismiss, judge agreed. Fail to Comply with Order of Local Government - Emergency Management Activity (citation, carries no penalty) - everyone present was breaking the 7pm curfew issued by the sheriff.
Possible Sentence: Max: Life in Prison Without Parole (WI does not have the DP)
JURY CHOSEN IN ONE DAY. 20 jurors have been selected in WI v. Kyle Rittenhouse. 9 men and 11 women. (8 are alternates)
Rittenhouse shot and killed Joseph Rosenbaum, 26, and Anthony Huber, 26, and injured Gaige Grosskreutz, 27. Prosecutors say that Rittenhouse, then 17 and from Illinois, was a vigilante looking for a fight. He, like other right-wingers, went to Kenosha, Wisconsin ostensibly to protect property. This happened as protests over police shooting local man Jacob Blake turned violent. Rittenhouse’s attorneys assert he was acting in self-defense. This case became a cause célèbre among conservatives.
Prosecutors have struggled in court, failing to introduce evidence of prior aggressive behavior. This included evidence showing him attacking a woman who was in an altercation with his sister. The other is that he was closely linked to the violent, far-right Proud Boys organization.
Kenosha County Judge Bruce Schroeder said an appellate court would reverse him if he allowed these in trial. The evidence was too prejudicial, he said. He left it up in the air whether he would allow footage showing someone identified as Rittenhouse discussing a Black man exiting a CVS pharmacy. Rittenhouse believed the man was shoplifting.

The only remotely valid theory of the case the prosecution had was to say that he provoked the attack from Rosenbaum and that was murder, which changes the context of the escape leaving him no right to defend himself from capture.
And the evidence for that was very weak. A blurry video with just a few pixels of supposed aiming a gun at Rosenbaum (the time he wasn't in floodlight).
I don't like how the prosecution wasted time on the idea that his mere presence there was provocation. How is someone going to sentence him based on that?

Especially at that time... We'd all been bombarded with so much venom and lies, I submit that we all needed to see justice and truth shine through in America at least a little bit. One thing i'm wondering is how on earth it took them 4 days to reach the blaring obvious decision that he's innocent. At least they got the right verdict in the end. Took too long though. This kid has basically lost a year of his life he'll never get back. I doubt he'll be compensated for that. There are no winners in this situation really. juries hold no power. 1st, they're conscripted, by force of law, against their will, 2nd- they're holed up indefinitely while they are told what to think by two sides for hours or days on end, 3rd-the judge manipulates or instructs them what to think and do & 4th-the judge can just ignore them anytime he wants and even override or redirect the verdict.
If "it's still the ordinary people who hold power" is true, then the people of Kenosha would have came out and stopped the riots in their city, instead they refused and let the vermin run wild. The only one who held power in this case, was Kyle.

      2. Jury duty is mandatory because it allows a random picking of real people that attend the court sessions in person to form an educated decision and provide the highest likeliness that bias is kept out of the case and the same people are informed through the case, all with the same knowledge. We wouldn’t want a jury that was alternating throughout the case
      3. The judge does not manipulate the Jury at all, the Judge however is in charge of making sure that the jury is aware of the functions of relevant laws.

@@bigdog91paper How far has the "logic" and "empathy" of the left got us? Let's not even just restrict ourselves to the US. Robespierre?
For the most part, people have or do not have empathy. They can develop it if they choose to, but without religion most don't choose to without obvious self-benefit (and then it is usually more a show of empathy than actual empathy). If they have it, great. That's necessary for a healthy society. If they don't, they have no reason to build it if they don't believe some form of spiritual growth or benefit is possible. But, fortunately, it is generally the norm for people to have a substantial amount of empathy before putting forth any particular effort. If that wasn't the case we would really be in trouble!
As for logic, by itself there is no connection in the animal kingdom between intelligence and benevolence. Chimps and baboons, in fact, are exceedingly cruel. Logic helps you get your way. It does nothing to enhance the benevolence of a society.
Religion, factually accurate or not, gives people a reason to develop their empathy with great effort. Seems to me atheistic states quickly fall apart precisely because there is more to be gained in a physical sense by sharpening the mind in areas such as education or cunning then there is to be gained by focused energy on empathizing with others. Atheistic states do not end well, let's not emulate them. That doesn't mean we have to be an Iranian-style theocracy or anything ridiculous like that. But religion is an aspect of culture to be celebrated, not distanced. Even spiritualism in a vague sense ends up far better than vague "logic and empathy."
