Way back when the Half Life 2 DM SDK dropped, myself and a ragtag group started a mod with it caked "QuakeSource", we'd remake the weapons, maps, and even things like rocket jumping with a small handful of unique ideas of our own. One morning I find an email from Todd Hollenshead in my inbox telling me to cease all activity in this mod otherwise Id Software would seek legal and takedown. This was my first time being approached by an industry professional but I took a moment to breathe and then replied back that my team and I had poured a lot if time and love into the project, and simply asked what we could agree on to change to let us continue working on the project worry free of litigation. Todd replied that honestly everything else was fine, it was pretty much just the name "Quake Source" that Id's legal team had an issue with. To confirm I asked if I simply changed the name that we could continue, he reciprocated that confirmation and we agreed to change the name to "EdgeDM" which was in honor of the name of our favorite Quake2 map and we were allowed to progress.
The mod never came out because my team got spooked and started ghosting, taking their assets developed with them. But at least I got to experience what it was like to work with someone on an identity copyright issue and came out the other end of it just fine. There are cool companies out there who just want to make sure their brand is protected but are willing to compromise with fans.

So they could let it slide and ask for an official excuse from the channel which made the videos with the official reason of which the videos were down once and for all or ask a license fee to continue the project.

If a copyright holder does not defend their copyright at all times, eventually they will lose the copyright. Person A slightly infringes on a copy right but the holder does nothing, person B infringes slightly more and so on down the line. The copy right holder then goes after person K for infringement. Person K says, hey you didn't go after people A to J. Court says we agree and the holder has now lost their copyright.

Im so glad you mentioned Bob's Prop Shop: Video Bob is a recaster who takes other people's hard work, recasts it and sells it at a lower price and often times must lower quality which is why he isn't looked on too favorably not only in the BTTF community but also the Ghostbusters Community and RPF community. The Back to the Future community is mostly bout giving back to charities but Bob is purely bout profiting off of other people.

There was a company called “Ronaele” that was building replicas after the Nick Cage movie. It’s Eleanor spelled backwards. I also have hatred for what Disney is doing. Especially after building their empire on public domain folk tales.

There are kits to make mustangs look like “Eleanor” but none of them are called “Eleanor” . For example, there is the Ronaele (read it backwards) and Cervinis C 500.

Surprised there was no reference to Unique Performance, a company out of Farmers Branch, TX who was producing Eleanors (gray) in large scale, in different performance tunes, etc. They were shut down by Haliki's widow also and a very large number of cars in various states of build, as you reference, were taken away.
Some vehicles are so iconic through their media that those vehicles are more known because of it. The Firebird from Smokey and the Bandit, TA from Knight Rider, Hearse from Ghost Busters, GM Van from A-Team. how many of these cars were toys we played with as kids? Then we grow up and want the real thing. NOPE says the lawyers.

This reminds me about one custom shop, I think it’s in Ohio that was recently in the news who’s licensed by DC Comics to build the original Batmobile.

Here in south of Brazil there's a company building Eleanors in fiberglass and the replicas are amazing., but Eleanor Licensing, LLC. probably won't sue them because of the necessary effort for this...

My guess is it was part of the settlement they agreed on. probably sued for every penny he made off the youtube videos and prevented him from making any more profit off the build, which would also mean he can't sell it, even for parts. So instead of being stuck with a pile of metal he can't make any money off of. He probably agreed to give them the car as part of the money he owed them. If your building cars for youtube views why finish building a car you cant profit off of when you can give it away to settle the debt then build another mustang you can make money off of.
@@DrTeeth609 The car wasn't finished, not even close and it wasn't going to be even close to the same colour as the movie car. Plus the movie car was 67 through and through Chris' car was 2015 mustang with a body swap. Any sane person could see that they could scarcely be more different but reality and law are not good bedfellows.

Yeah, that, to me, is what is the most f***ed-up thing. Like if you're just trying to protect your "intellectual property", just get the guy to rename it and paint it a different colour. Actually contrary to popular belief, B is for build was reimbursed for the car. (Not to the full extent I'm sure) but it was enough for him to give up and move on.

I think the biggest issue was broadcasting the entire build. Had he built it quietly in his garage, I bet nothing would have come of it.

Seizing the car was most likely the agreed upon recompense instead of taking all of the ad revenue from the videos, which was probably already reinvested in the build anyway.
The issue is not that the car was simply called Eleanor. They directly copied the design, naming, and heavily referred to the original movie in the videos. They then proceeded to use the aforementioned IP to create revenue via adsense and merch. This is no different than if they had made an Eleanor toy, and tried to sell it online. They were sued because Eleanor licensing sell licenses (duh) to companies to produce these products and had they not enforced this case it would have nullified the contracts they had with approved replica shops, who pay through the nose for exclusivity contracts (so they can charge you 200k for a car that cost 60k to make). Had the videos not been monetised - they would have most likely been allowed to continue as so many fan projects do.
Lawrence is probably right. They probably agreed (under duress) to turn it over to settle the legal dispute. They probably feel railroaded so I understand why they might say it was seized.
Lassi Kinnunen they had them bang to rights, they committed blatant IP theft, intentionally or otherwise, with the intent of generating revenue. 5 minutes on a conference call with the Eleanor co would have had Chris and co up against the wall agreeing to whatever to avoid a bloodbath in the courtroom.

No. It's specific to the movies/the car specifically as Eleanor is specifically the car used and referred to as Eleanor. The name in itself isn't copyright, it only comes into play if you specifically use a Mustang as that's the model used both times for movie and technically a character. It's a bit of a tricky path to walk to figure out.

Wondering how Gothic garage properly scaled the dimensions for the Batmobile considering that the Batmobile was based off of the Lincoln Futura concept car that only two or three of them were ever built and we're done several years before the show because anyone that watched it may recall that Bruce Wayne had a non-Batmobile Lincoln Futura on the show also even though it was never a production car. Pretty sure both of those went to George Barris after the show ended where they ended up past that I'm not sure
