      +Thomas Nuckles Actually it is NOT. The filming of critical infrastructure IS part of the Terrorist preparation for attack. This is provable. To catch someone doing exactly this DOES give police reasonable suspicion for a detention. This was handled perfectly. This is no different then when an officer observes behavior consistent with casing out a jewelry store that of itself is perfectly legal behavior but leads him to suspect criminal activity MAY be afoot. Since terrorists drive trucks with bombs, does that mean that everyone driving a truck, which is "behavior consistent" with a terrorist driving a truck bomb has provided reasonable suspicion that they are a terrorist? Would you like to ponder how often and how long I could detain you if I used your reasoning and followed you around one day applying it to your every action? Do terrorists buy groceries, gasoline, attend religious services, fly on airplanes? Do you? By the way, there are thousands upon thousands of videos on CZcams of citizens filming the police, and his behavior is perfectly consistent with their perfectly legal and Constitutionally protected behavior. This encounter was about intimidation, not public safety, and to argue otherwise is dishonest.

Let's say there was a 30 something year old guy video taping your child's elementary school. No one knows him. Taping the doors, the playground, the busses. Should the Police be called?

      The police have the authority to "investigate" any thing they choose to, but they do not have the authority to detain, or in any way interfere with a law abiding citizen engaging in Constitutionally protected behavior. In this case it was absolutely unreasonable to detain the citizen, and there was nothing about his behavior that was in any way more consistent with a terrorist than it was with a police accountability activist. The cop absolutely believed he was approaching a police accountability activist, and you absolutely know it. Go on with your hypotheticals if you must, but this case is open and shut police overreach.

      reasonable suspicion of an ARTICULABLE crime. that means the officer that is detaining you must say exactly what crime he or she thinks you may be about to commit, whether it be burglary, assault, murder, terrorism, etc. simply looking or acting "suspiciously" is not a crime.

    When I called, the officer I spoke with said, I paraphrase, that the officers on site would have been justified arresting him for terroristic threat. And that they are looking into it. We spent the next 10 minutes or so trying with me trying to understand how filming and walking into a store is terroristic threat. Scratching Dallas off my list of possible relocation spots.

      Nah, that one is lawful. He stated what he thought it was and how it could be contraband so long as the initial stop was legit it's fine. He should have said something prior to reaching towards him but still it would hold up in court.

It was an unlawful "pat down" for two reasons: there was neither reasonable suspicion of crime, nor reasonable suspicion the man was armed and currently a threat. Police acted out of fear of the unknown, not rational and articulable facts on the ground. We can't be apologists for this unconstitutional conduct. Cops don't get to put the Constitution on hold because they don't like what a person is doing. I taught 4th Amendment up to an academy level, and it is the central theme of the book I'm currently writing. If a man wants to take a picture of a building from a public sidewalk in broad daylight, here in the United States of America, he shouldn't have to fear the police.

      Cops are allowed to do pat downs without consent or probably cause. I don't agree that they should be allowed to do this but they are allowed. Technically, pat downs are not searches. Again, I don't agree with it but it's the way it is. The supposed justification is "officer safety"

    After almost 30 years in law enforcement I cannot believe how bad some of these police officers are. For instance he appears to have used his personal iphone. You could file to get a hold of his personal phone as evidence of your possible civil rights violation. You never use your own phone on duty. He is going to get it subpoenaed.

    This cop seems to have forgotten that he is a public servant. We don’t pay our servants to investigate constitutional activities. I think it’s suspicious that a 25 year veteran police officer would be so confused about the law, perhaps he’s looking for an early retirement?

    I would have had that cop detained because he took your picture in public. that was "suspicious". Just want to say keep doing what y'all are doing because it really helps the normal law abiding citizens remember we actually do have rights.

    There is no such thing as detention, either you are under arrest or you are free to go. The SCOTUS could give whatever OPINION(opinions are not laws and the judiciary branch CANNOT write or make laws, only give OPINIONS) they want on detention. The facts still remains the State Legislator (ones who MAKE and/or WRITE) only have procedures on ARREST, not detentions. When the police makes contact with you, by the procedures set forth by the Legislators or the State, you are under ARREST and make be taken to jail, or released etc. If you cannot proceed forward or backward, you are "at rest/arrest". Same reason why the citation says ARRESTING OFFICER.
    If the police takes a picture of you on duty, always do a public records request for that picture. Also tell the officer at the scene taking the picture that you plan on doing a request for your complaint and you will need that picture as evidence and if it is deleted or missing that will be seen as tampering with evidence.

    I've always said, if you don't want someone knowing your security procedures then don't put it in the middle of a neighborhood! Put a damn wall up around the parking lot if you're that concerned about people seeing your cars.

    Here the world can still see how criminal officers behave towards the population, how they conspire against an innocent person moving in public space.
    The officer is not alone in this, he conspires with his superiors and he hears their approval.

    8 years later and cops still don't understand that filming in public is a Constitutionally protected right and, unless you live in a stop-and-ID state, you are not legally obligated to ID yourself with no crime involved. officer training in this country is an absolute joke.

      The video you posted has little to do with a first amendment audit. Any time a police officer pulls over a car he must take precautions obviously, but after he questioned this fellow, and frisked him, he should have left it alone.
      He was clearly harassing him because there was an incident with an officer he was there filming about, and they wanted him gone.
