    Once an officer is given the information about a penal code or a law regarding public photography if they pursue an arrest than they should assume some liability for a potential lawsuit. If you get some of these hot headed cops to start paying out of their own pockets or serving time, you might see an improvement in protection of rights.

      He didn't know any laws and he was so afraid he was screwing up, his voice was shaking. When asked for a penal code, he says, I'm not telling you that. Only because there wasn't any and he was lying.
      I hope the auditor sure! I wouldn't be surprised is Shell gives the money each time they illegally arrest someone for filming, doing their dirty work for them!

      Oh yes you are 100% correct. In fact they can and will be held accountable for their actions because once they are informed of the correct case law and they still continue to arrest you they will loose their QUALIFIED IMMUNITY and once that happens they can't Crawfish back out of everything they have done.

    The initial female officer said with a straight face that she was just making sure you were safe and not running into oncoming traffic. Now that you are properly briefed on the hazards of motorized vehicles running you over can I get your name? That's a different approach I haven't seen before.

    One of the teachable moments in this video (and other similar ones I have seen) is that it is obvious that the police often don't know legal basics as it concerns civil liberties and legal fundamentals (RAS, PC, detainment and search thresholds). There was a time when I thought the police actually studied law but more-and-more, I see evidence that they either ignore fundamental legal concepts, or don't know fundamental legal concepts.
    I am also seeing a trend of police officers likely knowing they are violating the law but conduct themselves based on an assumption that they are legally and financially protected (yes, the tax payers will pay for the mistakes they make), and that the citizen won't seek legal remedies after suffering violations of civil liberties.

    When any cop commits a crime they not only should be getting prosecuted under existing criminal statutes and punished accordingly, they should also if found guilty stand trial for treason, these people are required to swear an oath before being entrusted with power and authority beyond that of the average citizen. They exercise that authority over citizens and ANY act that is in violation of that oath must be treated as TREASON. The constitution demands a higher standard of accountability for those who serve the people. It is to easy for that authority and power to be abused and that is exactly why the constitution was written. If these clowns are not prosecuted for dishonoring their oath, our constitution, this country, and the inherent rights of we the people, then why bother swearing an oath to begin with. This is what the constitution demands and that is exactly why we have our current out of control judicial system. Judges and lawyers all know that if they were to prosecute even one cop for treason or dishonoring that oath it would mean they would be held to the same standard and face severe punishment should they choose to betray the people, country and oath they swore. Its not that complicated, they swear an oath to insure that they understand that they are being entrusted with powers and authority from the people over the people and that those people have inherent rights that must not be ignored or violated in any manner for any reason, to let these clowns get away with standing trial and being punished as if they are just a normal citizen is a crime in of itself. They are not acting as a citizen when they are on duty nor should they be standing trial and punished as a normal citizen. That oath demands severe, harsh, and swift punishment for those who betray this country and constitution. If a soldier dishonors the oath he swore he faces a court marshal for that very reason.?

      SCOTUS ruled that cops engaging in criminal acts such as unlawful arrest, false imprisonment, kidnapping, assault and/or battery, and more can be legally killed in self-defense by citizens. If that happened more, perhaps corrupt pigs would wake up and learn that their lives are more at risk when they engage in criminal acts then those that do their jobs with courtesy and honor.

      Totally agree , I think that laws should be put in place that officers can be personally sued as well for these ridiculous acts. I truly think that is the only answer to stop some of this shit. When officers are faced with the fact that they can truly be held accountable for making stupid irresponsible choices like this maybe they will start thinking twice because right now they can get away with almost anything. Between the inside buddy program and the fact that when someone sues them it's tax payers money anyhow so it doesn't bother them. It's clear as day when officers start making up BS laws and reasons to push personal agendas. It's crazy that someone's ego pushes them to this very point. Makes me sick .... I give this young man a lot of respect , and applause for doing what he is doing.

      +nlpjohn what are you talking about man there will be lawyers lined up for this easy kind of case. Not only did he spend a night in jail which as you stated $20,000 at best... then yes of course a lawyers fee is between $10,000-$15,000 but you forgot the most important payouts my friend.... This officer violated so many constitution rights.. Lets see the officer demanding to see I.D. without articulating if this man committed a crime which he couldn't prove... 2nd the officer pretty much grabbed the guy and had him on the fence so the officer can search him for recording on public property that didn't commit a crime... 3rd the officer again demanded to see I.D. with out providing what crime the guy committed which the officer couldn't answer... then finally arrested this man unlawfully AKA kidnapping and then also took his property without a search warrant on the officer to do so... So in my own opinion this man is going to get way more then just $20,000 with his lawyer fees as you said $15,000 and walk away with $5000... no lawyers look for these cases because its easy money. Real easy money.

    So @3:40 the officer is done with the investigation and safety check and we should be good to go.
    Ah...spoke to soon. @5:28 officer pork rind now has to make an issue, quote made up laws about photography and demand ID with no RAS.
    Now officer extra chromosome has to change the alleged violation from illegal photography to now trespassing.
    Now the offense changes from illegal photography, from trespassing, to now failure to show ID.
    Assault, battery, unlawful detainment, illegal search, and illegal arrest soon follow.
    And these cops want me to respect them? Fuck all.

      RAS, in Texas, isn't enough to require ID from someone. Now, the cops can "demand" you ID, all they want. Texas penal code 38.02 is VERY specific on that. UNTIL a person is ARRESTED for something, you don't have to ID yourself. Some people think part (b) of 38.02 requires a person to identify themselves. Not true. Part (b) states: A person commits an offense if he intentionally gives a false or fictitious name, residence address, or date of birth to a peace officer who has: (1) lawfully arrested the person; (2) lawfully detained the person;  or, (3) requested the information from a person that the peace officer has good cause to believe is a witness to a criminal offense.
      Note: As per part (b), you are not REQUIRED to give your ID, even if you are legally detained - only that you will be breaking the law IF you give false info.

    The fence line parallel to the curb is the property line extending across the driveway.
    Step past the corner fence post towards the gate and you are trespassing.
    However, that driveway is "public place" and 1A applies.

      Look up trespass law. You are not trespassing unless someone trespasses you. You are allowed to go anywhere open to the public. If someone complains and trespasses you and you continue to stay then you are trespassing. Anyway, get informed, it's fun. (Not speaking to anyone specific just in general)

    have worked in petro chemical plants, nuclear plants as a pipe fitter/welder. I have built those structures from the ground up, literally, and I personally find it pretty silly that all this precautionary paranoia exists.     Please post a composite update video of all the times you've been arrested and the outcomes of each. It would be interesting to see a timeline of where you were when arrested and whether you were prosecuted, charges were dropped, if you sued, outcomes, etc. You are one of my top 3 auditors and I'd like to know how you fared.     Excellent, excellent, excellent. I spent my teenage years in Deer Park and most people don't believe how fucked up these police are when I tell them about it. The fact you were streaming this is soooooo great. Thank you for doing this. I was in photography class at DPISD and people had their cameras and film taken for taking pictures of these places. I had been pulled over MANY times for merely walking down a sidewalk on my way home and searched without due process, and I was a middle class white kid. Kudos man, this isn't even the worst of these crooked cops. Gotta love cameras. These cops need body cams at all times.

    Good job. Shell is obligated to provide a sidewalk. This land goes under a double classification as private/public, but pedestrians are legally allowed to walk there. That is the law.
    Like everywhere. Private and public land. 10 feet from the road is city property too, Shell is obligated to protect pedestrian, not the obligation of a citizen. Shell responsible for endangering you by not building a walk area.
    They should place a sidewalk for its employees too. THAT IS WORK CODE, which they violated too.
    People do not have to drive to work, and it is the obligation of the company to unsure the safety of its employees along with the public. At least mow the lawn and clean up.
    Shell is obligated to mow the lawn and pick up the garbage, they have violated CITY CODE or STATE LAWS. All lawns must be mowed and garbage must be cleaned. That is the law. You can use this against SHELL, they have violate more than one LAW. Go read CITY CODE and you see that you have the right to walk there and it must be mowed and cleaned. LOOK AT THAT GARBAGE. That is a violation of the rules. HOW IS IT THAT HOMEOWNERS MUST DO THIS< BUT NOT SHELL? Homeowners pay a fine for not cleaning up and mowing. 150$ FINE.
    POLLUTION AND UNSAFE WORK CONDITION AND A PUBLIC DANGER TOO. THOSE ARE JUST A FEW OF THE RULES. WORK CODE ALSO MEANS THEY MUST HAVE STOP SIGHS AT THE EXITS, THEY do not have these. AN ORANGE LINE ACROSS THE PAVEMENT TO IDENTIFY THE STOP LINE for vehicles pulling out. THEY are breaking many WORK CODES, you can dig them up with ease. COMPLAIN TO THE WORKERS COMPENSATION BOARD ABOUT THE DANGER, they must follow up and reply to you. THAT IS LAW. LEARN IT!

    If the officer was correct about it being illegal to take pictures of this chemical plant, than he had every right to ask this guy for ID.

    Looks suspicious to me. And if he was breaking the law, it was the cop's duty to arrest him.

    This is the shit that makes people assume all police officers are criminal. If you go along with another officer doing illegal shit, you are complicit and therefore should also be charged with whatever crime you allowed to happen.
    18 U.S. Code § 241 - Conspiracy against rights. It is a real law that should be used to punish police officers and all conspiring with them. The law is the law is the law. period. It is also clear that there is no law prohibiting filming of anything that can be seen from public view. Arresting someone for doing so is a crime.

Just this year alone, we have heard over and over about 'bad cops' who have many lawsuits and complaints against them, and the news reports (some national) lament how the 'warning signs were there' about the 'bad cop'.
      Many agencies large and small are under federal oversight because of the number of complaints and lawsuits.
      To claim that lawsuits and complaints achieve nothing is just flat out incorrect.
