      ***** Couple of things. The person recording wasn't on the base's property so they had no authority over. Nor should the military ever have any kind of authority over civilians.
      You say the uniform, rank and badge gives them respect. Why and how? A person can have the cleanest uniform and shiniest badge but if that person is an incompetent buffoon they don't deserve respect. They have to earn it.

      They can ask a person anything they want unless they see a crime being committed they cannot do anything if they don't answer. If asking is investigating then they can investigate I suppose.
      However. It may be illegal to film ON a military base but it is not illegal to film FROM a public road or sidewalk anything you can see. So they have no business telling him he cannot film what he can see while standing outside their jurisdiction.

    I saw a video once where the young MP, after the videographer denied all requests to stop filming and declined to ID, the MP said in the radio “he’s refusing to give up his rights”. He knew the videographer was legal, as do all cops, but cops would NEVER admit a citizen has rights.

I spent my entire military career, even on deployments, on Air Force and Army installations with SCIFs (secret compartmented information facility), aside from going outside the wire. 90% of my MI company held TS clearances. We had MPs headquartered at our base in Europe. Almost all of my Battalion held secret clearances. I took an oath to defend the Constitution against ALL ENEMIES, both foreign and domestic. The only enemies are those who would wear a uniform and attempt to violate the freedom and rights of the PEOPLE. Those who trade their freedoms and constitutional rights for security deserve neither.
      I sincerely hope you will reconsider your opinion on the matter.

      Its almost as if there is. Since this isnt a main gate, theres no signs. But theres a sign thats just a blank white sign that marks the boundary for MP/County.
      This looks to be an impromptu gate, probably because another nearby gate is being worked on, and with how close it looks to be, and I could be wrong since its a video, but I think their jurisdiciton extends to the road, and probably over to the Exchange Gas Station. Not sure where it would extend to on the other side.

Watching this only drives home the point that people not only don't know the law and rights under the law they don't even know the scope of their own authority.       This is not really the same thing. Basically this becomes a security issue. This guy could be filming security procedures with the intent to plan an attack or something. Remember that the folks at hood have had some serious incidents I recent memory. Filming an ECP is a federal offense.

      we have a jurisdiction line, and from my prior MP time, I can make an assumption that they were allowed to have Jurisdiction out to the road. and MAYBE 50-75 FT in each direction of the enterance, maybe 100ft.

      I'm an MP myself. Those MPs were just doing their jobs. It's so easy to say for those people who are trolling and not in the military to say police men or us military service members don't know shit about the federal government law and state government law to do our part or at least to serve our time we've given for y'all. Did they abuse their authority ? No. Did they ask you to do something more than once ? yes even POLITELY, but you have every right to ask military members question about State property vs. Federal Property. This man whos been recording and being cynical to prove a point. Please don't record MPs in the field or on base. Keep your phone's to a minimum of military police exposure to social media. It may be part of an ongoing investigation. For your convenience.

    I like the way you intelligently dealt with those MPs at the end of this video, you really made them look like idiots...simply masterful! Even though that deputy's attitude wasn't that bad (imo), he still unlawfully detained you and threatened to falsely arrest you for "Failure To ID". I don't know what it is with some cops that think they can just run up on you and demand that you assist them in violating your 4th amendment right. Even though he didn't try to press you for ID, these Texas cops should know by now that TX is not a "Stop and Identify" state and they can't just lock somebody up simply for not identifying themselves (Brown v. Texas 1979, Dutton v. Hayes-Pupko 2008). Glad you got your phone back, glad it still worked. Be safe bruh!

    AR 190-11 Chapter 4-15 Restricted Area designation
    part (a) spells out that the facility commander's authority for enforcing the "Restricted Area" is, "derived from Title 50 United States Code section 797 (50 USC 797) (Internal Security Act 1950), implemented by DODI 5200.08 and DOD 5200.8-R".
    (NOTE: AR 190-11 Chapter 4-15 part (a) can be found at

    I'm not going to look up Title 50 United States Code section 797 (50 USC 797) for you. You are on your own to do that - and, to decide whether it applies to (a) what you are doing, and, (b) the facility you were at. Again, I haven't read (50 USC 797), so I don't know how/if it applies. It could be quite possible that it's a federal offense to photograph that facility from a mile away (even if you were on public property. You'd have to read/decipher the U.S. Code to determine that. You mentioned your "rights". As we all know, there are restrictions on some of them. It's the old "don't yell "FIRE" in a movie theater thing. Yeah, we can certainly do it, but, we can all be arrested for doing it. This "photographing a military facility might be one of those type of restrictions.
    Good luck, Phillip. Oh, yeah, I had to laugh when the cop said, "It's my responsibility to determine whether or not I think an offense has occurred. If I believe an offense has occurred, and you fail to ID, I'm going to place you under arrest". Well, that'd work - IF he has "lawfully arrested you and requested the information" - but, not for failure to ID. I'm guessing that's why he told you that you were free to leave.
    If they've got so many MP's that they can devote to you, why don't they have some of them pick up all the "shit" I see laying on the ground?

      These MP's definitely need better training. I retired from Ft. Hood in 2009, (1st Cav), and most MP's are better behaved than that. Most MP's go through a "Homeland Security" training briefing as well and I think this buckethead crossed some of his policies. They DO have authority off post due to local SOFA policy and it also gives civilian police authority on post as well.

      Liberty Village is off post military housing, so going in transit to and from is allowed. If I recall correctly, there is a buffer zone outside the gates that MPs have jurisdiction of, so they may be playing off of that. Not justifying what they did, please don't think I am.(Stationed on Fort Hood 2009-2017, NOT a MP)

"The facilities" includes the gate and the entire fence line. This jackass was violating federal law. It doesn't matter where he was filming from.

    I don’t think I’ve shared this, but I’m retired Army. These ass clowns. I don’t fund government activities so their agents can come to me supposedly operating in an official capacity to cast disparaging comments and presume that I should get their approval on what I choose to do with my time. The base commander is quite aware of what your rights are, I’m sure. The fact that they are investigating your activity, I commend those soldiers. Obviously, they were no longer alarmed at what you were doing as far as a security threat, so then they decided to share their personal contempt for you and your actions while acting in an official capacity. I guarantee that if you ask to speak to the base commander, or even the company commander of those troops, he/she will go up one side and down the other. I highly recommend you do so. If they behave like that with no consequences, they will be of the opinion that they where right. Nothing will change and when someone else who is not as level headed as you are escalates it to a physical confrontation, someone gets hurt. It is regardless who gets hurt, the point is that if the training is there, the threat of violent confrontations diminishes, which should be the best overall outcome of each encounter. Make sense?
