Every Officer's Worst Nightmare When Responding To a Domestic Dispute

  • On November 19th, 2022, Officers were dispatched to an apartment for a report of a battery occurring between a couple in Skokie, Illinois. They were advised that the suspect, later identified as Devonier, was currently trying to strangle his girlfriend. When officers arrived, they could hear screaming coming from the apartment and his girlfriend screaming "Help me!" repeatedly.
    Devonier was arrested for felony, aggravated battery to an officer, and misdemeanor domestic battery. The misdemeanor domestic battery charge on him was dismissed in court; however, he was found guilty of aggravated battery to an officer and was sentenced to a two-year probation.
    Since this arrest, Devonier has been arrested seven times for domestic battery, and his girlfriend, Melissa, has been arrested twice for domestic battery.

It also creates a paper trail so eventually the victim can get a restraining order, as well as the police can keep track of the problematic couples like these. DV results in a lot of injuries and deaths, of the responding officers as well. It's an enormous problem and very high risk. Convictions are the LAST concern. It's about safety.

      Yup. That’s more often than not what happens when the “victim” refuses to cooperate with the prosecution.
      I’d be willing to bet that, after he was bonded out and they’d kissed, made up and bonded over their “poor us, the police are such bullies” victim narrative, she signed an affidavit of non-prosecution, which is her basically saying “this was all a mistake. I don’t want to press charges.” Doing so won’t make the DA immediately dismiss the case but it can matter when it comes to the DA’s decision to offer a plea deal or to take the case all the way to trial.
      In most states, the DA doesn’t need the victim to press charges in order for someone to be arrested and charged with DV because it’s pretty common for the victim to change their minds or refuse to cooperate. Because the officers can choose to press charges, the state doesn’t need her to testify to convict, especially if there are other witnesses. That said, it makes the DA’s job more difficult and could’ve actually resulted in this guy being acquitted after tons of money and time have been spent on his prosecution, or it could’ve gotten his entire case dismissed before it ever made it to trial. She said she didn’t want to press charges and I’m sure she wouldn’t cooperate with the prosecution so, chances are, the plea deal was the best possible outcome in this case because it’s better than all of the charges being dismissed.
      As for the other 7 cases, probably the same exact thing! Unfortunately, nearly ever DA in the country is HEAVILY overworked. Their cases are piled so high that they plea out more cases than they prosecute. People like this guy get one deal after another until someone is lying in the morgue.

      The court systems in many states try to be progressive with low or no bail, lowering charges, pleading down, or entirely dropping cases. Quite often they swing too far and end up simply cycling the offenders through the court systems over and over without any real punishment or convictions.

      I was impressed as well. My husband had the house key break off in our lock and I was in another state. All he could think is “I need to get my baby girl in the house” and kicked in our door with four kicks. Hopefully the doors we bought to replace his break in is just as strong as this door. (Yes he could have done a bunch of different things but he felt he MUST get his baby into the house for her safety and that’s the ONLY thing that was in his head.)

      I completely disagree. So first, victims of domestic violence don't get to decide ti press charges or not. It's required by the state and I believe every state in the country has embraced that practice. Second, it's fine if someone calls for help but chose not to press charges. Officers are keepers of the peace so they absolutely can separate parties without charging anyone.... as long as it's not a domestic issue. Like a regular assault and battery on someone you arent related or lives with you, there's nothing wrong with calling the cops to help in that moment without pressing charges.

    She's most likely too scared to press charges knowing he'll come after her, It's all too common with females in abusive relationships, who know that the police can't protect them once the man is out of jail for domestic violence, once he's out, and she's found, 99% of the time, end up dead. A "Protective Order," isn't going to stop an abusive man from killing the woman he abuses, the police can't be with her 24/7, and certainly not a piece of paper that says, protective order. Sadly, many women know that Filing a restraining or protective order doesn't do anything but only makes their abuser more aggressive and angry.
