The fifth amendment is a protection against self-incrimination, it's not a protection against being arrested. I'm not American and even I understand how this shit works.
Well he is detained so he has a right to remain silent. Hes only required to give his name if he is suspected of a crime and he doesn't have to answer questions.

I was a sovereign citizen when I was 2 and 3 years old. I screamed about my rights every time my parents took away my toys or made me eat vegetables. Fortunately, unlike this gentleman, I matured and stopped such nonsense when I turned 4 years old.

I yell at them all the time, as they are typically rude and unprofessional themselves, and I'm good at putting them back in their place. But I answer the citizenship question every single time, the Supreme Court has ruled that we have to, and given their mission it is not unreasonable. But please understand on behalf of us rural border area dwellers: these are such poorly prepared, poorly trained and terribly paid federal police that they hide the really bad ones at the most remote checkpoints. Like where I live. These are not even mall security in talent or intelligence, and much worse in attitude. They regularly try to intimidate rural Americans, violate our rights, and they are thus *really* unpopular out here. On the other hand, they do save immigrants and non-immigrants lives in our dangerous desert backcountry. I have seen it.

I have traveled through the same check point and had no problems except when women are checking vehicles. They violate the constitution and Bill of Rights everyday. The error was invoking the 5th. If you shut down the ability to do an investigation, you will get arrested. The sole reason he was arrested was for pleading the 5th. If he answered yes, he was free. He plead the 5th so he was arrested. Pleading the 5th isn't a get out of jail free card

My wife and I were flying from Toronto to D.C. The folks ahead of us had a Fisher-Price Jolly Jumper in its original, oversize carton going through the X-Ray machine. On the monitor were silhouettes of metal rods, springs, gizmos etc.
The agent on the X-Ray (very calmly) asked, "Is this a child's toy?"
Mister Smarts snarked back, "It says so on the box!"
From across the way, another agent stood up saying, "Well. We're going to have open that up."
They were pulled aside and we went through.

Being a trucker, I've been through border checkpoints many times. Answer their questions, and you're through in no time. What I'd really like to see is him try this on the Mexico side.
If they pulled this shit on the Mexican side the very best they could expect is losing the truck and spending come quality time in a luxurious Mexican jail. If they pissed off the wrong Mexican authorities they could be found pursuing a new career as fertilizer in some Mexican farmer's fields.

I went through a checkpoint in California coming from Arizona. The entire interaction didn't take more than two minutes: short, friendly, to the point, then "thank you, Sir. Have a nice day, and drive safely".

I have been through such checkpoints in under twenty seconds, not counting the backup behind people who want to argue about their rights... "Hello, sir, is everyone in the car an American citizen? Yes? Okay, have a nice day..."
That's not the point. It doesn't matter how long your were stopped. You hadn't crossed the international border, so you shouldn't need to be stopped at all by the Border Patrol. Granted not complying like these two yahoos is not worth the trouble, but that is exactly what they are counting on.

I was in a car with 2 white people and I was the only one question even with my military ID. My white friends just showed IDs and were on their way, I was asked 20 questions. I have never been more resentful of law enforcement or government than being forced to stop and justify my own citizenship when I was just minding my business driving along a US road. Drunk-driving and seat very checkpoints are completely fine and justified in my opinion, but this bullsbit absolutely is not. I live in Texas, and Iâve gone through these checkpoints a few times. It is easy. The dog goes around the car, they look in the car, you tell them if you are a US citizen or not, and then you go. Some cars they go through. They never had to go through our cars. They are doing a valuable job in protecting our borders and he is being a jerk!

The constitution clearly says he has a 5th amendment right. The ACLU has a fact sheet on this and it says: "Even though you always have the right to remain silent, if you donât answer questions to establish your citizenship, officials may detain you longer in order to verify your immigration status."

Identifying yourself and your nationality is not considered self-incrimination. At a border checkpoint, some rights are altered (for instance the 4th amendment protections from search and seizure without a warrant). You cannot refuse to identify yourself or your nationality at a border (or the functional equivalent of a border). He does not know the law, his rights and he is completely in the wrong here. He must answer the agents question or be arrested or detained. In some states, you may not refuse to identify yourself, as you may be arrested or detained.

Just want to add some context to this video: this is not a border crossing checkpoint. This is an internal checkpoint within 100mi of the border. This guy is not a Sovereign Citizen... He is an A-hole... But he is mostly correct about the 5th amendment, he does not have to say anything to the officer... But he is asserting it in a terrible way.
Unfortunately the courts have upheld this type of stop so far away from the border without reasonable suspicion. The border officers have the authority to stop and search this vehicle AND the occupants still have rights they can assert.
I repeat: nothing in this video suggests this guy is a sovereign citizen which is a completely different delusion.
Also, I would bet both of these guys are "tough on crime, secure the border MAGA voters" which makes this encounter even more ironic.

Most countries have border zones, usually about 50 to 100 ks within the country, in which border controls and customs officers are allowed to be active.

I think you're confused. No he didn't. This isn't a permanent border with a checkpoint that he knew would be there. This is a random spot that border patrol set up on a regular road to demand the papers of anyone passing.
Why on earth would the border patrol have a permanent checkpoint besides at the border? As soon as everyone knew where the checkpoint was, no illegal immigrants would ever go near it. They have to temporarily set it up quickly and then move it to a different location the next day. This is the same as a random drunk-driving or seat belt inspection.

At the border, even a border between states? Absolutely, that's fine. But being randomly stopped on a road up to 100 miles inside of the United States is ridiculous. I have never been more resentful of law enforcement or government than being forced to stop and justify my own citizenship when I was just minding my business driving along a US road. Drunk-driving and seat very checkpoints are completely fine and justified in my opinion, but this bullsbit absolutely is not. This is the one and only instance where the American government legitimately forces you to show them your papers, like the Gestapo.
I live in a border state. These checkpoints are more and more common. Imagine being on your way home and being stuck for hours because of people like this.

These checkpoints are annoying especially when they get backed up and Iâve seen some pretty horrible truck lines. These clowns effectively shut down the checkpoint because of all the agents dealing with them. Easily 200+ vehicles could have been cleared had the agents not had to deal with dumb and dumber.

SCOTUS has ruled that these border patrol checkpoints, so long as they are within 100 miles of the border, do not violate the Constitution. And yes, technically, you do have the right to remain silent and ypu don't have to answer when asked if you are a citizen. *However,* if you don't answer, you can be detained for however long is reasonably necessary to ascertain whether you are a US citizen. #notlegaladvice
Itâs a ridiculous rule, though. Inclusive of the coasts, do people have any idea how huge an area it is that they are allowed to do âborderâ checks on? You could drive from Tampa to Miami and be subject to a âborderâ checkpoint anywhere along the way even though at no point were you within 1,000 miles of being able to drive over a border.
While this may be true (I've not looked into it for myself due to lack of interest) There is no talking to the sovcits about the facts. I dont think he was arrested, he was detained. In order to arrest him, they would need probable cause of a crime. Refusing to answer questions, even at these checkpoints is not a crime. From the ACLU website:

I picked up two German Shepherd puppies from a breeder from their kennel in Texas and had to stop at a Border Patrol checkpoint.
They asked could they check the vehicle and I said of course and they asked about the puppies and I showed them their German passports in the import papers and they just laughed and said we were free to proceed.
The funny thing is we're German Nationals living and working in the United States and we provided all our documentation without hesitation.

Voluntarily going from being a natural-born US citizen to a "non-citizen" (aka, renouncing) is a complicated legal process that can only happen outside the US. INA 349(a)(5) [8 U.S. Code § 1481]. After that, you'd need a visa (and passport of some other country) in order to return. It is probably rare for any sovcit to figure out, let alone agree to do any of that, therefore they are still US citizens. ICE maintains a master database of any US citizen who has ever renounced.
