6:38. In most jurisdictions in the US, if you are in commission of a felony, everyone in the group can and often are charged as though they committed every crime themselves. For instance if 6 people rob a bank and one of them shoots and kills a guard, they can all be charged with his murder even though only one of them did the killing.

The last girl was lucky the the sentences were concurrent and not consecutive. Concurrent in law means that a person with with five one- year sentences only needs to spend one year in jail or prison. A consecutive means that the person must all five year. So the girl only needs to do 22 years before being able to ask for parole. If her sentences were consecutive, she would have had to do over 60 years before asking for parole.

    • @Adplusamequalsadam

What’s the point of concurrent sentences?

    • @steeljawX
      @steeljawX Před 11 měsíci +1

@@Adplusamequalsadam I'm not a legal expert by any means, so don't quote me on any of this. But I believe the point of concurrent sentences is the fact they are being found guilty for different crimes but there are other punishments that severely outweight the mandatory punishment of the concurrent sentence that you might as well have the time served count for both. It would be considered a little petty and inhumane to some to just continually chock up the charges to consecutive sentences instead of making some of them a bit more sensible. It's also how the judge is feeling that day. If they're benign and you've been a cooperative and genuinely remorseful defendant, they might run a concurrent sentencing. If you've been a bit of a pr*ck, they might just keep adding consecutive sentences to give the excuse to give you a life sentence with the chance of parole after 782 years (aka no chance for parole.)
But really it's a bit of sensibility and mercy molded into it. Like if you're found guilty of 3rd and 1st degree murder (key being found guilty) the maximum sentence of 1st degree would considerably outweigh what the max sentence for 3rd degree has, but you've been convicted of both. So you get both the bronze and gold "medal" in this even though the gold medal out classes the bronze one and is the one that actually counts the most, to put in another perspective.

Just because you weren't the one behind the trigger doesn't mean you didn't intend for it to happen or know of the potential outcome.

Children need more than a parents love. They also need discipline and consistency. My mother loved my brother very much. But she always chose to pacify him rather than show the firm hand he needed sometimes. Subsequently, he became a drug addict, and eventually died of a heroin overdose. He died face down with a heroin needle in his hand. The coroner wouldn’t let us see him for several days because they had to flip him over and wait for the blood to go down so his face wouldn’t be so purple. One thing, these kids need to pay for their crimes. Hopefully it will be a deterrent to others so they can think about the actions they will cause to others. I remember some kids get a defense because of their home life, parent's neglect, etc... If the parent's want to use that as an excuse, they need to put the parents in jail too. So other parents can see that they will have to take responsibility for their children's actions because they were not giving attention, teaching their children right from wrong and one and all involved (even those who were not part of the crime, but because of how they raised or neglected their kids) needs to be punished for the crimes they did. Most of the stories you had today, these kids will get off in their 20's and hopefully live a crime free life and teach others of the lessons they learned. I have not been in their situation, but for the victims and their families, their mental state of surviving a crime and/or losing a loved one for no reason, I don't know if I can be so forgiving and wanting these kids to have a lesser sentence. I do not know if I can be satisfied with even life in prison. I do believe in second chances if the person is sincere, admit to their crimes and what they learned to better themselves. Right now, after 3 years losing my husband because of Covid and the situation that caused his death (he broke his hip and was in a care center. He had only two weeks left, after the lock down started to come home and when I was not able to personal visit him, they gave him a new roommate that had covid, the nurses were coming into work with Covid. Once he had covid, been hospitalized, passed/negative covid tests, and died 1/2 hour before the hired ambulance service was to bring him home). I am still angry with what happened to him and blame myself that I did not do all I could have done for my husband before he contacted covid. That month and half, I did not get the chance to be with him, talk to him. I did try the legal way to make the care center pay for their negligence, but because my husband got Covid in the early stages, the Care Center did what they were supposed to do/minimal rules, since we did not know all about the virus regarding keeping their patients safe.

Not sure if this is the case in the US, but here in Canada we have the youth criminal justice act which basically means if a kid aged 12-17 commits a crime there is a limit of 10 years on their sentence and their identity will be kept confidential to the public. However, there is a provision that those as young as 16 can be tried as adults depending on the nature of the crime. It's been heavily debated given that youth crime is on the rise, those under 12 get off scott free and it means that technically a 16 year old could face a life sentence.

That last girl will have to work while in prison because at the beginning of sentencing, the judge ordered her to pay thousands of dollars in fines and restitution so she will work for no money the whole time she is in jail and hopefully she will pay off her debt by the time she is up for parole.

Under the law in most states, everyone involved in a violent crime gets the same sentence. Not having a gun really doesn't matter. The only time it matter is when the judge decides it is important. Otherwise, everyone involved get hammered with a long sentence.

In some states if there is a murder and you were in any way involved, you too are charged along with the shooter. Some states, I believe, do not do this. Every state unless a federal case has its own laws.
Prison is avoidable by not breaking the law.
I do feel for those falsely incarcerated and pray the truth will come out. Now they are using genealogy sites’ dna results (Ancestry, etc.) to find criminals through relatives. Crime really does not pay.

A serial killer is someone that has killer 3 people over a period of time with a cool down period between the offensives of days to years. Killing multiple people with no cool down period is classified as a spree killer or just a murderer.

These kids definitely don't comprehend much...in particular about how one should act in society. It comes down to parenting imo. Parents need to teach their kids right from wrong and teach them how to be human before they leave the household. And while I do feel a bit bad for some of the families involved, it was these kid's choices that led them to prison. They've got no one else to blame. At least most of them showed some sort of regret.

the first person with the plot to commit a crime and end her family, there may be room for leniency, but this is where the system clashes with mental treatment. they often dont work well when mixed, and its too risky to let them free while treated, or let them be jailed and put them back into the world with zero life XP after 20 years. kinda wish this never happened but it happens all the time to teenagers aged 15 even who did do aweful things but were also possible to prevent, but then again i just hope anyone going through that is fairly treated

If you work jobs in prison the money that you earn is kept to pay any fines or restitution you owe too so some people don’t really get much for that. I receive restitution checks a lot at work and they’re rarely over $100. Some of these people have been paying us for over a decade for their restitution. We don’t really anticipate ever getting all of it paid off for most of those instances, we just keep the file open to mark the files whenever the checks come in.

In Florida, there was, for many years, a:
    10, 20, Life Law
    [ during a crime]:
    Pull a gun = 10 years
    Fire a gun =20 years
    Shoot some =25-to Life.
    This was a Minimum Mandatory.
    [ they finally changed it].

Judges hated the fact that they didn't have discretion when it came to decisions. Mandatory minimum sentencing is legislative interference in the judicial system. I believe that, now, judges confer with one another on significant rulings and that there are sentencing guidelines that are suggestive of a ranges of years of incarceration a defendant might face.

Why are these parents crying over their children's sentences? YOU RAISED THEM, from their first breath you had the gift & opportunity to guide them in what is right and wrong, to push them scholastically, what they see..... THEY ARE YOU!!!!! You taught them, influenced how they think & act stop the dramatic tears because if you were a decent parent, they wouldn't be involved. Don't blame environment or mental issues.......FIRST BREATH OF LIFE YOU KNOW YOUR CHILD....YOU JUST DIDN'T FIND THEM IMPORTANT ENOUGH and your own life/agenda took precedence!!! If they killed my family member......
