You can watch people start yelling htat they didnt do anything and then when the cops say "put your hands behind your back" they will continue to argue and fight getting arrested. NOWWWW they do have a real reason to arrest you. Resisting arrest. Whether i did anything wrong or not, I wouldnt argue being arrested just because of what it additionally starts to stack against you.

Landlords can't just change locks, or mess with utilities, or take your things out. They need to go to court to evict a tenant. The process can take months, and landlords can not do a thing. Once court orders eviction, then the sheriff will come and evict you. Also rent can only be raised by a certain percentage of present rent every year.

Honestly, the cashier from Walmart was likely laughing because she was upset, nervous laughter, at least for Americans is a common thing. It was evident that the customers escalated the situation simply because the original cashier missed an item and security asked her to go back to customer service and pay. They just seem like assholes (the customers). They're ganging up on the girl, who was busy with other customers and they have the nerve to record the girl AND call her unprofessional whilst they're acting like children themselves.

Walmart is a private business that has every right to ask you to stop recording. Once you refuse you can be arrested for trespassing and disturbing the peace. You do have the right to film in public but once you enter the building you are on private property and no longer in a public place. There have been over 100 people who have sued Walmart over recording in the store and every one has lost. Also when they call the cops the cops will sieze your phone and use your own video of the employees asking you to leave the store to prosecute you for criminal trespass. Your recording will be used as evidence to put you in jail. I know because I used to work for Walmart. Usually they will ask you to stop recording and if you don't you will be asked to leave. Once they call the police all bets are off and you will probably leave with some shiny new steel bracelets and a ride I the taxi with red and blue lights to the Grey bar hotel.

Re: the landlord/tenant dispute: The tenant said that she illegally raised the rent - in some jurisdictions, mine included, the Rent Control Board decides, based upon a formula, how much the rent can be raised. If the tenant challenges it, as it sounds like this tenant did, then it can ultimately go to court. First though, the landlord serves a Three-Day Notice to Pay or Quit on the tenant. If rent is still not forthcoming, then the landlord contacts an attorney and papers are filed with the court to start the eviction process. Maybe the tenant went to a Tenants' Union and they helped him legally, including representing the tenant at the eviction hearing. It appears that the judge ruled that the tenant can be given access to the apartment to collect his possessions, or that the landlord had not proved her case and the judge ruled that the tenant has a right to stay in the apartment. If the judge rules on the side of the landlord, the bailiff or sheriff serves the order on the tenant that gives the tenant a date and time to be at the apartment to collect his possessions. At that time, the landlord then changes the locks and arranges with the tenant to remove all possessions. Caveat emptor: this is only how it happens in my jurisdiction. Either way, I would not want to continue renting the apartment if the issue had progressed to this level of animus.

I don't know the rental laws in Canada, but in the US, a landlord can't go in and remove your stuff until an eviction process has happened, and a certain amount of time has happened. I imagine it's the same in Canada, or similar. If a bailiff had put locks on the door, and she or her husband had removed those, that's illegal. None of it needed to get to that point, probably.

    • @LA_HA
      @LA_HA Před 11 měsíci +1

I'm not saying I understand the situation clearly because English isn't her first language his English just sucks. So, I admit that maybe I don't have a clear understanding from one viewing. But, I from what I saw and heard in one viewing, I got something different from it...
It sounds like the renters didn't pay the rent, so she added late fees. So, they got a judgement, but have to be out by a certain time. The time came and she started taking their stuff out.
However, they're saying that they have an extension that their lawyer has been calling to tell her about. She's saying she hasn't gotten Any calls.
Then, the guy is saying that he's suing her for $25,000. She's saying she doesn't care because she just wants him out because he hasn't been paying the rent at all.
The people inside start saying she can't raise the rent, but she said he's supposed to leave because he's not been paying at all, so the $200-300 fee isn't the point. She doesn't want Any money. She just wants them all to leave now.
He's threatening to call the police. She's saying to go ahead because he's supposed to be gone anyway.
He starts talking about a bailiff and paperwork that he supposedly has, but won't show her because he threw it away. It sounds sus, but okay.
In short, I kinda think this is the situation...
During the pandemic, he and his roommates didn't pay the rent. This went on for a couple years while tenants were protected by a legal referendum. The problem is, independent landlords weren't protected from the banks or paid by the government. Because of that, Many of them were losing their properties because renters refused to pay even After getting Federal and State money to help them do that, pay bills, and buy food.
Now, the referendum is over and renters have to not only pay rent, they have to pay All Back/Owed rent and fees. These payments may also include any raises in rent that would have taken place during the referendum. Landlords are allowed to raise the rent a certain amount every year or so, depending on what State this is in.
Therefore, the renter's claim that she's not allowed to raise the rent isn't necessarily true. If you rent in an area that improves, the rents can go up. However, there might be a limit to how much, how often.
The sad part is, if they had been paying their rent, on time, regularly and without a problem, she might've been good about letting them stay because it's a bigger hassle to try to Get good tenants than to kick out bad ones.
Landlords love good tenants that don't cause problems, keep up the place reasonably well, and Pay Their Rent On Time. They usually don't care if a renter needs a little more time now and then If they have a good track record.
But, people being what they are, there are people who drag out the process because a lot of States have laws that tilt far more in favor of the tenants than landlords. Many tenants know very well how to manipulate the laws to stay in a rental for months without paying. Just like squatters do.
Meanwhile, the landlords aren't able to pay the mortgage on the property because of the time passing during which they're unable to collect rent. So, they wait to the second for the day the renters are supposed to leave.
Plus, we all know that most renters like this will likely destroy the property, and the landlord will have to pay far more than the deposit amount to clean, repair, and replace the damages.
People take the side of the renters because most people Are renters and don't believe they need to care about landlords. They see landlords as rich, greedy, and selfish for wanting people to pay their rent on time.
Plus, since so many people hate working because they see it as "slavery," they don't have rent money when they should, and it starts a bad cycle of anger and resentment on both sides. Renters don't want to be "forced" to pay rent when they don't have it, and landlords don't like being screwed over and lied to with false promises of being paid "next month," or "when I get a job" but aren't looking for a job.
Some renters think their landlords are stand-ins for their parents in that way, believe it or not. Some break things on purpose in order to lodge a complaint about not paying rent until the repair is made, knowing it'll take time because of the expense or the unavailability of the item.
Again, since a lot of people are in this position from the Renter's point of view, the overwhelming consensus is that the landlord is always at fault and the renter is always in the right.
      Just a thought

So many of the customers should be "trespassed." The cops can be called and make the offender leave. Why waste your time arguing? Karens and Kevins want to get a rise out of you and get the attention their parents did not afford them. Don't oblige. As for the screaming landlord, the man filming her knew she was easy to emotionally push over the edge. Even if she was in the wrong, most decent human beings wouldn't film her while goading her. They would have moved. If she's so wrong, why would you move back? She raised the rent above that which he could pay, so he should move to a lower rent situation. He was baiting her to destroy his property, getting her worked up, and didn't stop talking. He did it to destroy her through social media, which is futile because i doubt she's on any platforms, and he hoped to add on a charge of assault or vandalism. She looks like she's elderly as well. Whether he had the right to be there or not, it was a set up for clicks and elder abuse. Most of the people who film these types of incidents WHO ARE INVOLVED, bury themselves in the court of public opinion. The mature person walks away as soon as things get weird. If someone continues to argue, they are getting off on the whole thing on BOTH sides. They're getting some sort of psychic payoff. The Karen or Kevin gets attention. The "victim" gets video clicks. I used to be addicted to these, but now I'm beginning to realize I'm being manipulated by the person holding the smart phone. They are as low as Jerry Springer.

Its wild that people claim to understand their rights and WILDLY misinterpret how they are actually supposed to be. People think "free speech" means you can say whatever you want and not get kicked out of somewhere. And thats NOT what it means. Those rights dont even apply to private businesses. Perfect example is, whether there was a pandemic or not, a place can require you to wear a mask and kick you out if you dont follow the rule. It doesnt matter, in that context, that you have the right to free WHATEVER right, because you are in their business and they are allowed to set the rules. Just like you could kick somone out of your private residence(your home) for not following YOUR rules. Which most of the people who cause situations like this in public would agree with. Its cherry picking to a really high degree, "this rule only applies when it hurts me or my residence" .

Where I live, the tenants have more rights than the landlord. There is a procedure to evict a tenant properly and legally. It takes at least 3 months to go through the process. Some can stay up to 6 months when they delay their hearings and pay no rent and the original rent to cause the eviction. If the tenant does not have any savings or work, there is nothing to get from the tenant. Once the tenant leaves and left their things in the unit, the landlord cannot just throw their things outside. The landlord needs to store the items and do all the means to get in touch with the tenant to give back their items. If the rents went up and they are not under rent control, there is a percentage each year to raise the rent. If you have a problem with the tenant, sometimes the tenant destroys the apartment/house when the premises are handed back to the owner.

Walmart is a private business and if you try to record there you will be asked to stop or leave. The parking lot is considered public but once you enter the building you lose the right to record. If you insist on recording they will ask you to leave and will call the police if you refuse. The police will then arrive and ask you to leave and if you don't you will be arrested for trespassing. The police will also sieze your phone and use your recording of the employee asking you stop recording and leave as evidence to arrest you for criminal trespass and they will likely hold onto your phone until the court proceedings are done. This can take months depending on the court schedule. Also if they have to get the cops involved you will be banned from entering the store for minimum of 1 year. I have seen a whole family leave in handcuffs because one of them was asked to stop recording in the store and the others decided to cause a scene.

There’s a certain sign businesses get here that cover themselves as a warning:
We reserve the right to refuse service.
Businesses can refuse to serve you for any reason, provided legal rights are not broken.
But I’ll say one thing. There’s a few positions of people you never mistreat. Those who serve your food, those who handle your finances, those who clean your environment, and those who provide your post.

What that landlord did is illegal. There is a process to evict a tenant, and she has to allow him access to the property. Once he's officially evicted, she can then change the locks. If she hasn't gone through the proper legal process to evict, she can be fined for this. I'm definitely not an expert, so I don't know what other possible penalties there are for her, but there are some.

The minute you step into a private business you no longer are assured of the freedoms in a public space. These morons filming are so entitled and looking to start fights thinking that they're superior to everyone else. Throwing around unprofessionalism or racist comments is ridiculous. Whether the landlord is wrong or not the tenant continues to egg her on by constantly challenging her. The fact that he has a camera in her face isn't helping the situation. He needs to analyze the situation and try a different approach. He just kept throwing these veiled insults at her which only aggravated the issue as if he was the more righteous person.

If you go to a Wal-Mart then you had to expect that you will see Wal-Mart employees standing around talking. They expect the customer to do their job, because they will not check you out. I don't have a Wal-Mart name tag nor do i get paid so i don't shop their and have to ring up what I'm paying for. The last time I went to Wal-Mart I had close to $300.00 and I left the buggy since I was going to do their job. If you accidentally don't ring up or mess up checking out then you are arrested for shoplifting. Amazon and Kroger is where I buy my stuff. Wal-Mart treat their employees like crap. When I did work my job was a bakery manager and cake decorator. They tried to head hunt me and offered me $8 hour less than what I was making. I was a great cake decorator and they wanted me but didn't want to pay for the talent I had. No way would I want to ever work at Wal-Mart, but I do feel bad for the souls that are working there. 9:46

Dennys used to be a great place. Problem in most cases is since its cheaper in price, you see a lot of trouble makers hang out there now. Likewise the workers don't care anymore as corporate doesn't seem to care either. Though many cheaper places (Taco Bell, Arbys, Wendys...etc) have crappy customers and workers because HQ doesn't care about them either. I remember contacting a Taco Bell about a few hairs in my taco, including a cut off fingernail.
They never responded. I contacted Dennys about two flies in my salad and silverware that har dried, old eggs on them (these were washed mind you) and heard nothing back. These kinds of places are run to the ground and are slowly dying off because of all this.

Manager said they can't do that. I freaked. Screamed, totally went Hulk mode. Took a stack of flyers at the door and throw him in the air, as i walked out. Manager came out, followed me, eventually got my money. My my dad was in the car and Saw me storm out. So, we were both screaming at the managers... Kabir, on the renter one: The landlady raised the rent $200 more, and I'm going to guess they had a rental/lease agreement which stated the rent would be $X for X time, so her increase on the rent went against the agreement. They also mention that they've paid the rent and the check was at the ministry (I'm guessing it's in Canada and the court system is called the ministry), they also mention in the video she stopped the checks. Apparently she just wanted them out and is taking the law into her own hands by changing the locks after the court changed the locks, in violation of the court. While she may have filed for eviction, she can't just go in and damage, remove, throw away, etc. their property because she wants them out faster than what the court has granted them.
I'm also going to say that they paid the rent money to the court to allow them additional time to move their belongings out, or something to that effect, which supersedes the previous paperwork, which is why he mentions that her prior papers are thrown out, and he didn't want to show her his copy of the new order for 2 reasons, 1 I don't think he has to, and 2 he doesn't want her destroying his copy of them. He's apparently moving his stuff out, but it doesn't seem to be fast enough for her. And apparently she went and changed the locks after the court changed them, and in the process she either damaged or removed some of his property, which is why he has a suit against her, actually it sounds like he has a couple against her.
Also in the U.S. and it seems the same in Canada as well, to remove a renter the landlord has to go file for eviction, a hearing is done and the occupant of the property is given X amount of time to vacate ... you can't just go in and remove the renters property until after the period is over.
In Florida, all evictions must follow the same process. The steps in the Florida eviction process are:
    Landlord provides a written notice
The landlord files an eviction complaint with the court
Court serves the tenant with Summons and Complaint
Court holds the hearing for the eviction and issues a judgment
Local sheriff provides tenant with Writ of Possession
Sheriff returns possession of the property to the landlord
Typically, an eviction in Florida can take about 2 to 3 weeks, depending on the reason and if the tenant contests the eviction. You cannot perform a constructive eviction, even if the tenant does not pay rent.
    Reasons for Eviction
Due to the laws in Florida, a landlord cannot evict a tenant without cause. Legal reasons to evict a tenant include failure to pay rent, staying on the property after the lease ends, violating the terms of the lease agreement, or not upholding tenant responsibilities under Florida law.
Regardless of the reason, proper notice must always be provided to the tenant if they are to be evicted. You also have to let them know if you’re deducting from their security deposit.
    Eviction for Non-payment of Rent
In Florida, a landlord is allowed to evict a tenant for failure to pay their rent on time. First, they must provide a notice of 3 days that states the tenant must either continue paying rent or leave the leased premises. If neither action is taken, then the landlord can file a Florida eviction suit.
    unpaid rent eviction florida
Rent is considered late in Florida the day after it is due. There is no legal grace period for tenants or exceptions for holidays and weekends. Once rent is considered late, the landlord may begin the eviction process in Florida.
Eviction for End of Lease or No Lease
Florida landlords can evict a tenant when the lease has ended or if there is no lease. This is known as a “holdover tenant” or “tenant at will”. To evict the tenant, the landlord must provide notice for them to move out, which is 15 days for a month-to-month lease.
Once the tenancy ends, if the tenant stays on the property, then the landlord may proceed with the eviction procedure.
Eviction for Violating the Lease Terms
A landlord in Florida can legally evict their tenant if the tenant violated the terms of the lease or fails to uphold their responsibilities as stated by Florida Landlord Tenant Law.
Some, but not all, violations give the tenant the option to repair the issue to avoid eviction. Regardless of the problem, landlords must provide 7 days' notice before proceeding with the Florida eviction process. A lease violation allows for a legal eviction.
    Curable Violations
For some minor violations, tenants may avoid eviction by fixing the problem before the 7 days’ notice is up. Examples can be parking in an unauthorized area, having an unauthorized pet or vehicle, or not maintaining a standard level of cleanliness within the home.
    cleaning house tampa
However, if the tenant repeats the offence within 12 months of the first Florida eviction notice, the landlord is not required to provide the tenant with a chance to fix the issue before starting the eviction procedure.
    Incurable Offenses
For larger or repeated violations, the tenant is not given the option to avoid eviction by fixing the issue. In these cases, the tenant must leave the property within the 7 days’ notice period, or the landlord may continue the eviction procedure. Examples of larger violations can include excessive damage or abuse of the property or illegal activity.
Steps of the Eviction Process in Florida
    Step 1: Providing Written Notice
In Florida, the eviction process begins with the landlord providing written notice. This can be delivered in person, via mail, or by leaving the notice in a clearly visible place (ex. Front door). It is crucial that the landlord keeps a signed copy of this notice for proof.
Step 2: Filing the Florida Eviction Lawsuit
If the tenant remains on the property after the notice period, the landlord may then file an eviction lawsuit in the court of the proper county. This can be done conveniently by using Florida Courts’ e-filing portal.
This complaint should include the landlord and tenants’ names, the address of the rental property, the reason for eviction, and when any Florida eviction notices was provided.
After being notarized, it's sent to a process server or the county sheriff, who will then serve each tenant.
Step 3: Summons and Complaint are Served
Once the tenant has been served with the summons and complaint, they have the option to contest the complaint. This response must be in writing and filed within 5 days.
    court hearing florida
A tenant contesting the complaint may make the eviction process take longer. If the tenant has a valid reason why the landlord should not evict them (ex, false accusations from the landlord, or the tenant resolving a curable issue), then the court may dismiss the eviction lawsuit if they find the claim to be true.
If the tenant does not contest the claims, then the eviction will continue with the following steps.
Step 4: Court Hearing and Judgment
This step is when the landlord moves forward to obtain a Judgment for Possession.
Both the landlord and the tenant must bring a copy of the lease or rental agreement, the written eviction notice, the complaint, and any evidence to help prove their eviction case to the hearing. If the tenant fails to show up to the hearing, the judge will rule in favor of the landlord.
Step 5: Writ of Possession is Posted
If the judge rules in favor of the landlord, a writ of possession will then be issued. This is a court order served by a sheriff that gives the tenant 24 hours to vacate the property before being forcibly removed.
    Step 6: Property is Returned
This is when the sheriff returns the rental unit to the landlord by placing a padlock on the unit’s door. If the tenant remains on the rental unit, they may be forcibly removed.

For the McDonald's case of the free fries....it is customary for most fast food places to give you courtesy food when they mess up you order or if you have to wait too long. There has been several times when I've had to drive back to the restaurant after they have given me burnt, undercooked, or over salted food, messed up my order, or given me the wrong order. I try not to wait until I check my order at the drive thru window before pulling off because I don't want to back the traffic up at the drive thru, but now I just wait and check it before leaving rather than having to come back all the way across town. But in the event there's something wrong when I get home or to my destination, I call back to the restaurant and ask to speak to the manager and they always just take your name for the next time you come in and they (at least where I live) will fully replace your order with another meal. Even at BK if they have to ask you to pull forward and wait for your order in the drive thru they'll give you a coupon for a free large fry the next time you visit and sometimes they'll give you a coupon for a free meal if it takes a long time.

      @shadowgod1009 Před 11 měsíci

But it's not our job to enforce a higher standard on their service though. If we don't like the service we've received, we pay for what we have already ordered, do not tip, and leave. That is what tipping is for. You tip for good service, and you withhold the tip if the service was bad. If your service was really bad and not due to something like the restaurant just being busy, do the before mentioned but also tell a manager what happened. And be respectful about. Just say that you were not happy with service provided and leave it at that. A good manager will have a talk with the waitress. If you decide to give them a second chance and you go back and the service is still bad, then you know to avoid that restaurant going forward for sure. Either the manager doesn't care or they can't control their employees. Both are a good sign that you should probably eat somewhere else.
