This is an interesting video. On the one hand, everything he does is perfectly legal. And, his answers are all perfect. On the other hand, I also think with the amount of mental illness in America these days that most people would be concerned with a man on a bicycle with an assault rifle (just not normal). It is correct to make a call and correct that the police do a mental illness check. I think that we all agree that the 2nd Amendment should not cover a person with mental illness and an assault rifle. Finally, I really do not like the trend of CZcamsr's being as outrageous as possible just to get views.

It doesn't necessarily make you guilty, but they have to check it out. And with everyone overreacting about guns these days, I see why they would. Could you imagine the backlash if they ignored a call and something horrible happened? In this situation, the cop should've just made sure the guy was in his right mind, then left him alone. That would've taken all of maybe 45 seconds.

@@darylwilson7451 It's how they "check it out" that is the problem. Police are trained that even if there appears to be no offence committed they MUST keep going until the find one. The whole basis of any Police investigation nowadays is that "everyone is guilty of something". Ask any innocent member of the public that has been the subject of a Police bullying interrogation and they will tell you how anti-Police it left them. Seems to me that Police only give up the interrogation when something else catches their interest, not when they initially cannot find an offence.

@@danlabonty9720 In MN merely carrying a firearm in public does give the cop RAS. The court (MN Supreme Court) has ruled that lacking a permit is not an element of the crime, and having a permit is an affirmative defense to the crime.
Although I disagree with the court, I can explain their reasoning with an extreme example. It's generally illegal to carry a firearm on a commercial flight, right? But Air Marshals can do it legally. Does that mean that the TSA shouldn't be able to stop people who are going through security with a firearm on their hip to see if they're an Air Marshal? Air Marshals look like regular passengers, so regular passengers look like Air Marshals, right?
Just like my Air Marshal example, in MN it's generally illegal to carry a firearm in public, and people with a carry permit are exceptions to the rule (per the court's reasoning). This rationale does not hold up in states where it's generally legal to carry without a permit (i.e., states with constitutional carry), and the courts usually recognize that.
PA is an example of a state where their Supreme Court looked at this question, criticized MN for its decision, and said even though permits are required to carry, allowing police to just assume someone doesn't have a carry permit would be as silly as allowing police to just assume every driver doesn't have a driver's license.

Dispatch should triage these calls and say "carrying a gun is legal" please call again if there is a crime involved. The cops saying "we got a call" they see that as a god given reason to infringe on the rights of free people. When will they learn, even a detention for 30 seconds is still illegal if they know what they are doing is legal. Law suit time for this guy...

Agree with every word, every syllable. There's a case, "Trezivant vs Tampa Bay," a motorist was illegally detained for 23 minutes, got awarded 25k, for an illegal detainment. Round it down to $1,000 a minute, or 60k per hour if you're actually arrested.

I agree with your thought but having been in law enforcement all the police need is suspicion to make a stop. You do not have to do anything wrong but the police simply have to have a suspicion a violation of law occurred and given a recent SCOTUS decision the stops will get worse.

      @drantil Před 2 lety

For all I've seen, dispatch is comprised of a bunch of androids taking calls and just regurgitating information to the cops. No knowledge of law, or any interest on defending it. They just take the call so a cop can do something with it. 95 to 99% of the "we had a call" situations that I allways see on these channels could have been resolved by dispatch telling the callers they were wrong to call, and that there's no law being violated from their statements.

They need REASONABLE SUSPICION of a CRIME. This cop had reasonable suspicion of legal activity.

Everyone who carries a firearm openly should know the case *Commonwealth v. Hicks (2019).*
This is a case from Pennsylvania that is awaiting certiorari for the SCOTUS. Keep in mind this case ONLY applies to PA, but the wording is important and can be used in any lawsuit against a police officer in a civil Rights violation case as supporting documentation. It's also good to quote to the police and make them chew on it for a bit.
    As the Court explained:
_"To maintain constitutional validity, an investigative detention must be supported by a reasonable and articulable suspicion that the person seized is engaged in criminal activity and may continue only so long as is necessary to confirm or dispel such suspicion."_
"The Court then went on to declare:
_Although the carrying of a concealed firearm is unlawful for a person statutorily prohibited from firearm ownership or for a person not licensed to do so, see 18 Pa.C.S. §§ 6105-06, _*_there is no way to ascertain an individual’s licensing status, or status as a prohibited person, merely by his outward appearance. As a matter of law and common sense, a police officer observing an unknown individual can no more identify whether that individual has a license in his wallet than discern whether he is a criminal._*_ Unless a police officer has prior knowledge that a specific individual is not permitted to carry a concealed firearm, and absent articulable facts supporting reasonable suspicion that a firearm is being used or intended to be used in a criminal manner, there simply is no justification for the conclusion that the mere possession of a firearm, where it lawfully may be carried, is alone suggestive of criminal activity."_
The Court then went on to agree with the primary argument that I [Joshua Prince, Esq] made in the Amicus Brief that just as the police cannot stop an individual who is driving to see if he/she is licensed, police cannot stop an individual with a firearm (without more) to see if he/she is licensed to carry. In doing so, the Court declared _“that the government may not target and seize specific individuals without any particular suspicion of wrongdoing, then force them to prove that they are not committing crimes.”_

    There's NO crime here.
Police Officers CANNOT just detain you, if they have not witnessed a crime !
People, you do NOT have to answer any questions, you do NOT have to help police officers with their investigation.
If they don't have a crime, they CANNOT detain you. That's the law.
I'm not an attorney, but I learned a few things about law.
