If you are an heir or a beneficiary, you have certain rights. However, some of the rights do not accrue until the party in whose estate you are the heir or beneficiary dies. For instance, you may be named as a beneficiary in a Will but that does not mean you can demand that the lawyer who drafted the Will give you a copy. On the other hand, if you are a beneficiary in a trust and the event whic...

This situation sounds like Fractional Ownership. A prime target for rogue investors. These type of investors attempt to buy shares of the property, usually for pennies on the dollar, from as many of the owners who are willing to sell. They do this until they have a majority stake in the property. The best way to avoid this is to have a Will and or a Trust BEFORE the owner is deceased. It should list Exactly who the owner wants to inherit the property. Furthermore, a Trust Fund should be created for the beneficiaries to pay into for expenses related to the property. The original homeowner and each beneficiary should also have a life insurance policy with enough value for their final personal expense, with funds remaining to contribute towards the Family Trust Fund. Beneficiaries of the Family Trust Fund should only be allowed to borrow money With Interest from the Trust upon approval from the Trustee and/or the Majority of the Family.

My family and I are heirs to land in Madisonville, Texas. It is so many heirs it is ridiculous. Some of the older relatives did file an Affidavit of Heirship but now I am going back and filing one for the individuals living today. If I am correct, I know it is over 200 people. No one is willing to sign a Quitclaim Deed just sitting back and watching to see what happens. We opened up a bank account so we can get contributions to help with the development of the land. It was left by my 2nd great-grandmother; no will at least I haven't found one. She purchased the land abt. 1901 and she passed in 1959. I cannot find anyone that knew her to help with the affidavit. I know a relative can help but they cannot have an interest in the land. Some of the older relatives were trying to sell it but the title company said no because it is too many heirs, and they did not file it properly anyway. We do not want to go to probate court because if no one is hardly helping out now they definitely won't help with probate. Some of us are doing what we can in order to keep it. Another thing it is LANDLOCKED. We see an attorney on the 22nd to see if they will help get us a way into the property.

Hello Vernita love your informative and easy to understand videos. To cut to the chase, my situation is Im the adminstrator of my mother's estate. She passed last summer and the reverse mortgage is in the extension stage. Its a HUD loan adminstered by a private co.We owe about 350k. House has been appraised at 450k. We should have an apprx 215k HELOC (from a kind relative) available in a few weeks. Does anyone out there know if we make an apprx 200k down payment to the reverse mort.holder, would they possibly be willing to extend us for another 6 months or so. The idea is to buy some time and then i will be in better shape to secure a mortgage for the remaining amount. Any info/advice would be greatly appreciated!

My father passed away leaving me and my brother executors my brother passed away before my dad's estate was settled. (The will had per stirpes in it) the attorney we hired for my dad is now doing the brothers estate for my nephew and i feel she cannot advocate for us both fairly. From the moment my brother passed my attorney has said she needs to advocate for my nephew and now my nephew is interfering with my abilities to finalize debt. I found out after my brothers passed that they were writing checks to theirselves out of the estate account and was removing property from the estate property.

And I am the top co-executor of her will... how's that working out for me..😅. My mother's stepson is in full control over everything.. and they've been robbing her place blind with a lawyer who refuses to work with me . 😅.. I wrote letter to the courts and wrote letters to the lawyer, but they all refused to listen. And I was also the main executor on her living will also..😂. How do you think it's working out for me.😂.. the law system is a joke and all I can do now is laugh 😂😂😂😂 when you're broke you can't fight it.. I've already partitioned...
