Thank you for the explanation....I understand that the original owner of the house is excluded from the first $250k ($500k for couples) of the capital gain from selling the house; once a Lady Bird Deed is written, when the owner sells the house during their life time, will the owner still have that capital gain tax exclusion?

You said to be aware that creditors of the remainderman/Beneficiary could attach a lien or judgement to property. Can that be done While the original owner is still alive or only after they pass away ? Where is your office located ? I need a consultation. to see if this is best for my situation.

You said you can't use it to disinherit a spouse or a minor child. That means son or daughter correct? It does not mean granddaughter grandson that is a minor correct?

I don’t know what the deed has to do with the probate case. If you have a deed that was executed by the deceased person before they died why do you need probate. I would have to speak with you to evaluate what is going on. Please call my office at 305-967-6741 and schedule a telephone conference.

I applied for probate because I didn't know that the quit claim deed was enough, to close the probate court case..
