    I won't say that it is exactly fighting, but I do have questions about what happened to some of my parents' property and assets that were not mentioned in the will. What I have learned from this is: Parents, first of all, you need to be ABSOLUTELY TRANSPARENT with ALL your children regarding assets. My parents were extremely closemouthed about what they had, and their constant refrain was, we don't have much money and we have to be careful. But a closer look at their situation said that they were not as bad off as they claimed to be. I'm not saying they were rich, but they weren't destitute, either. The thing was, only one person knew the whole situation and they turned out to be just as closemouthed as my parents. This person was simultaneously the executor and an heir. So the opportunity was there to skim off the top. Not saying this happened, don't have any proof, but the numbers I was given don't add up to what I do know about what my parents had. And it was like pulling teeth to get that information!
    So, do not put anyone in charge of your estate that stands to inherit. That's a conflict of interest. Also, if you intend to split up your estate among your children, make sure you clarify BEFOREHAND what splitting it up equally means. Investments, bank accounts, vehicles, retirement plans, anything that has beneficiaries or has a title ARE NOT INCLUDED IN THE ESTATE. Those things go directly to the beneficiaries, they do not go to probate. Probate also does not ask any questions, so whatever the executor chooses to tell them, that's what goes to probate. Because my father signed over much of his assets over to the person who was the executor, these did not show up in the inventory of assets. This involved several vehicles, savings accounts, investment accounts. What did show up in the inventory was this: house valued at so much, cemetery plots valued at so much, and miscellaneous household goods valued at $1000. Do you see where I am going with? If Dad had intended that everything, including vehicles, savings accounts, investments, etc. be divided up equally among his children, along with the house, he did not make provision in the will for this. On the contrary. This is how I learned that you can legally "hide" assets. Trust me, I took notes. I will not be making the same mistakes as my parents did. I will not be putting anyone in charge who stands to inherit.

    Hi say my aunt had no kids just us nieces and nephews . However her mother who is 96 years old on a nursing home IS alive.
    Aunt died 2 years ago nothing was ever done about her estate. She owned a home.
    Are we the heirs ?
    Or grandma ?
    From what I understand its grandma ..
    My brother who is aunts personal representative recently put my grandma in a nursing home in order to settle aunts estate. He thinks its ours I somehow think its grandmas even though she's 96 has dementia and recently put in a nursing home by him.

      by relationship, grandma is the next of kin. it seems, though, that because of her poor health & lack of capacity, she will need her power of attorney (POW) or guardian ad litem to act on her behalf, perhaps to research grandma’s rights (her rights may be limited or non-existent due to her lack of capacity 🤷🏽‍♀️).
      btw, i’m not an attorney, but i have first-hand experience with the probate process. if you do a google search for “elder and health law,” “elderly heir rights,” or something along those lines, a good amount of info should pop up.

      @@traceyperry1659 thanks for taking thr time to reply. In the short time my grandma has now passed. And so it is now her estate. My 2 brothers are fighting with each other over that . They both want to live there and not sell.

      Did grandma have a will? Is grandma's estate still in probate? If not, who presently own the property (or properties)? We need more info to able to assist.

    I am number 5 I do not get along with any of my siblings yet. My mother left me too Insurance policy and left my sister and myself on her home policy. My sister has stolen the policy that I have never seen. I have 4 other brothers that have seen it. One of the brothers and her has gotten together. Have the policy and living in the house.I'm here in Palm Bay, Florida.Can you please help me

    My daughter is añ adults with frontal lobe damage, she's the only air her aunt ordered, well had my daughter sign for six death certificates because his family wanted suviners, why would she ask for all the same thing and payed for each one when she could have taken a copy, and I'm in Woburn Massachusetts, she needs a lawyer do you have any suggestions for our situation she got mailed a check but she can't cash it

    Hey Mrs. Williams, I still pay my mom's mortgage along with taxes, insurance and interest on the home. It was left to her heirs. Can I claim the interest, taxes and insurance that I pay by myself? I reside there with my nephew.

      You are not the homeowner. Consult an accountant. However I don’t think it is appropriate for you to claim interest, taxes and insurance.

    Is Fernandina Beach Florida in your location? I need some real help, apparently relatives who haven't seen or contacted me in ten years are Deeming me IRRESPONSIBLE, knowing My Husband just passed in January 2021, they lied to me they gave Everyone else the Real will and trust and are listening to My Father who knows nothing!!! Won't allow me to live they are all wealthy except Me, like I'm sorry I didn't know my Husband was gonna pass away from brain cancer and covid are u kidding me it's awful and mean what and how they are treating me😧
