As far as declaring war being the purview of congress, congress abdicated that power to declare war to GW Bush in 2002/2003 so he could attack Iraq. Bush never officially gave that power back, and the issue of that power hasn't been clear but technically congress is not empowered to declare war, the president now has that power and has since GW Bush.

Though not really possible, I think Trump will try anything and everything to delay the proceedings including going to jail. Of course the trial will continue with him in absentia, but I think he thinks that any spanner in the works, is worth a shot, including of course painting himself as a victim. However, a spoilt rich kid like him, in jail, even for a few hours, will seem like an eternity...I doubt he can stomach multiple instances of incarceration.
