    If they can sue Cabela's for selling ammo,, then every place that has ever sold tobacco or liquor and someone has died as a result, or anyone who has given another a cigarette or drink is open to lawsuits.

      Or suing a gas station for selling a customer their vehicle fuel who is later involved in an accident in which an operator is at fault when a person or people are killed / injured. To take that further, is the fuel station operator later to be held liable for selling fuel to a driver [who was sober at the time of purchase] but who decided to drink and drive at a later time which actions may have catastrophic results or the manufacturer of said vehicle used in the drunk driving example?

      @Bravo Golf I never believe those numbers. You’d either have to be living with a person who smokes indoors, or working at an establishment where people smoke indoors. The occasional draft is not sufficient enough to be determinable as the primary factor for cause of death.
      It’s all fucking hype by people that want to force things they don’t like out of the world. Smoking, drinking, guns, etc.

      That's already been attempted. Some guy that ate 15 Big Mac combo meals a day became 500+ pounds. Sued McDonald's from making him morbidly obese. The case was dismissed by the judge.

    So by that logic, a person that buys a vehicle and goes out and kills someone with it should be able to sue the car manufacturer, the dealership, the salesperson, the parts manufacturer and so on an so on.. frivolous lawsuits like these have no place in our society! It’s just another false flag situation to take away our 2nd amendment rights. It’s beyond BS and should have never reached the court system! Just my opinion.

      Automobile (& other product) manufacturers have had much litigation against them for many years, often for frivolous claims that a vehicle was at fault in an accident, when the true fault was with driver carelessness or poor maintenance.
      I know; my Dad was an accident investigator from the '60's until the early '90's, & was called to testify in court as an expert witness on many occasions. I helped my Dad on several accident cases with the investigation work, usually taking pictures of details on a wrecked vehicle. Usually, with my Dad's testimony & excellent courtroom exhibits, the defendant (the company) would win, in cases where there was no clear fault of an automobile or product.
      Sometimes, lawsuits would be settled out of court, & I suspect some of the suing parties were only in it for the money (profit motive only), & not for reasonable "due compensation", because the suing party probably did not care if a product was at fault or not; & only wanted to claim a product was "defective", because the suing party believed it could legally force a company to pay a considerable amount of money ("damages"). Of course, I realize that it's nothing new for people to sue over frivolous claims (some of which are immediately obvious as frivolous).

    Can we start suing the parents of criminals for having a child that they didn’t properly raise / control? How about their friends for either influencing them to commit crimes or not stopping them from committing them? Imagine if this logic was used in a drunk driving case. How far would the “negligent party” net be cast? The car manufacturer for making the car that was used in the accident. The bar that sold the drinks or the host of the party that was attended. The brewer or distiller of the beverages or mixers. The distributor that sold the alcohol to the store or bar. The store that sold the alcohol. The company that made the bottles or cans. Hell! Even the company that printed the boxes that the drinks were shipped in. They were ALL complicit in this individual being allowed to freely become intoxicated and drive. Ooooo!!!! Sue “Big Oil” because they refined the fuel that was in the vehicle driven by the inebriate. And the gas station too.
    This is just more of the victim hood mentality crap, but on such a massive extreme end of the spectrum.

      I agree. I have said for years that Microsoft makes defective software, and always have. And then I ask, why aren't they being sued for it? Anytime someone can hack into your computer, the software is defective. And when you delete something, it should be deleted and not recoverable. They jeopardize people's privacy, and safety for profit to make after market software to fix their built in mistakes.

Apple should be sued for a different reason, mainly for the ”right to repair” that seems to be nonexistent for apple devices outside of apple shops.

      It's NY. After 24 years of living there, in a mostly conservative, western border county, I can assure you that conservatives judges, who follow the constitution, do exist there. They are just few, and far between.
      The town I lived in, Hanover, in Chautauqua County, was where the first Unsafe Act arrest was made.
      BOTH judges, and the town DA, refused the case, so the state sent their DA, and a judge, from Buffalo, to prosecute and hear the case. Only reason they got a conviction, and that there even was a trial. They barely had enough people to fill a jury, with 12, and 6 alternates.
      Even the county DA's office turned it down.
      So, not all of NY is the liberal cesspool, some of y'all seem to think it is. The problem is, they are willing to bend the rules, past the breaking point, when it suits them. That was a big part of the reason, I moved my family out of that state, 6 years ago.

      Depends on who owned the gun. If it was the parents gun, they should be liable because it is their responsibility for the gun. I agree 19 is old enough to drive, vote, join the military, etc, but the law is the law. The owner of the gun did not keep the firearm safe.

    When I was a kid I found a .22 in a grain bin, just sitting there on the farm, was my uncles for getting rid of yard pests. Anyways I picked up the .22 and stepped outside in the sunlight to have a better look. Well it took 3 days for the ringing to stop because the second I stepped outside with the .22 a hand the size of a dinner plate landed on the side of my head. My uncle laid down gun safety control measures in about 6 seconds and after that common firearm safety wasnt a problem for me or my kids 25 years later.... lessons learned..

      They should start doing that, if it is good for the gun and ammo dealers then it is also good for the car manufacturers and those that sell them. If I got hit by a gmc driven by a drunk you can bet I would sue the dealership for knowingly selling a car to a drunk and the manufacturer for allowing and then the state for licensing the vehicle for a drunk driver.

      In DUI's, they sue the bartender as well as the owner of the business where the person got drunk. Usually, the County or State, revolkes the establishments liquor licenses and all other liquor licenses to the establishments that the owner may have within the State.
      This is a similar scam. It's called making the bad judgement call of the customer, not responsible for their own actions and judgement calls. While driving the business into bankruptsy and closure. It just does not make sense to me! Where is this justice?

      The bottle maker too, they provided a vessel which they should have known beyond a reasonable doubt, would be used in an unsafe manner due to its ability to hold petroleum which is a highly volatile substance when exposed to heat and has another highly volatile gas oxygen added to the mix and then (who made the rag and brand of petrol used btw they are negligent too) converted into a flaming projectile with the intention of causing severe injury or casualties. That is enough evidence to put them all out of business through bankruptcy.

      @@khoreis818 I have no idea how he got a hold of it. He tried to over dose on antidepressants 5 years earlier and I believe he shouldn't have been able to buy any firearms after that. He lived with random roommates in a house his parents bought for him. He could have easily gotten it from one of them. He choose to do it the day after his 25th birthday. I didn't bother calling him, we had grown distant but obviously I feel pretty terrible about that. The point is no matter how much I want my friend back I would never take away rights from others to do so. Im less sad that he killed himself but more sad he was hurting enough to do so. In a strange way I'm happy he was finally able to do something for himself.

      I can think of a situation where a gun can just "go off". Leave a gun sitting there with a round in the chamber and a fire starts in the residence when you aren't around, heating up that gun and that round. Eventually, the round will discharge from the weapon. Even loose ammo can "go off" from extreme heat but the brass would explode and fragment rather than the bullet being propelled. Okay okay, I know that's not what happened in this case. I was just giving a scenario where a gun can just "go off".

      There are scenarios where guns go off, but they would be the result of a design flaw. I had a 22 handgun which I was testing the feed, so I was cycling dozens of bullets through the gun. Nothing was touching the trigger. The gun fired on the 22 as soon as the slide closed. Needless to say it was the last time that gun was allowed to seat a cartridge and the gun store returned their entire stock of that particular handgun. And before you ask, this was 40 years ago, so no I don't remember the brand.

      Neither of these instances did the gun just, “go off”. There were other inputs and circumstances leading to a discharge.
      And yes. Maybe I should have specified saying this in regards to a negligent discharge to keep in line with this particular video. But still, fire and cycling are things that would cause a discharge. But the gun didn’t just, “go off”. Which implies it does it all on its own.
      And that doesn’t happen.
      The point was that it gives fuel to the anti-gunners out there. Like that jackass from NFAC talking nonsense when one of his people shot another one of his people.
      We are already in a battle for our 2A rights.

My argument was an event that happened without anyone pulling the trigger so it wasn't negligent discharge but, you're right, some other force must still be at work for any round to discharge or explode. I certainly don't mean we shouldn't have guns because of this. Don't worry--- I feel very confident we'll keep the senate and Trump will take PA, GA and WI and keep NC, and the presidency. And we gained seats in the house! It's looking better and better for our 2A.

      @M.I B.C the hot coffee lawsuit is actually much misunderstood.
      The coffee was kept at a temperature far beyond what an individual would do, and they had been warned by regulators to not do so.
      The spill, a reasonable accident, literally melted the woman's flesh, requiring multiple surgeries to salvage.
      It was unsurprisingly far far too hot to actually drink, and not in an uncomfortable/burnt tongue sense, but in a maim/kill you sense. Serving that in a flimsy cup to customers is a textbook example of excessive negligence.

      I beg to differ. As a gun smith I have seen many, many worn and abused firearms that will just "go off" when handled, absent pulling the trigger. And the vast majority of people don't know the difference. Hair triggers are not normal, of you have a gun with a touchy trigger, take it to a gun smith and have checked and repaired.

With a higher possibility that the owner fudged around with something that they shouldn't have? As far I've seen, mechanical failures are still user errors. Dont manufacturers have to make sure their products are drop safe? I may be wrong but I'm pretty sure if a "weapon goes off by itself" its because someone messed with the internals, that shouldn't have. As far as I know, if a manufacturer pushed a product that could literally go off at anytime, they either could face legal ramifications and/or couldn't actual push that product in the open market, as consumers would not let it go forward without saying something

      @@quizzs5159 believe it not, I've seen this mostly older firearms but I've also seen in new guns. Yes, most had been tampered with by those who had no idea what they were doing, some were mistakes that factory QC missed. It makes no difference, most people don't know what is and is not proper given a certain model of gun. This includes many gun owners. If you own a gun and suspect something isn't right, get it checked by a qualified gun smith.

      Actually that's why Remington is no more.yes because of lawsuits but brought on by faulty trigger mechanisms in their model 700 series that lead to the firearm discharging on its own.many were convicted of murder but claimed that was the case.Remington knew of this and chose not to issue a recall and used this mechanism from the 1970's to the early 2000's.im pro 2nd ammendment but Remington asked for everything they got

      In that case it’s different because it is gross negligence (the assembly company that puts them together in Walmart stores would be more accurate), because those things have the front forks on backwards half the time and the brakes non-functional or loose so they work when you squeeze them light but when you slam on them in an emergency the cable just slips and you get 0 brakes... so that’s actual gross negligence (also don’t get me started on the wheels spikes never being tight and when those wheels collapse the spike can stab you through the heart and that has killed people before). More accurate would be if they sold parts that were perfectly good and the user misused them, that’s closer to this case.

    Having grown up in Ilion, NY (home of the Remington Arms) in the 70's & 80's, I know firsthand how lawsuits can destroy entire communities. The Mohawk Valley and it's surrounding area are ghost towns now.
    I can also say that NY State is now one of the worst states to live in America based on its local & state government.

      And I can vouch for.mechanical failure, causing an accidental discharge. A broken sear, on a friend's 1911A1, and jus dog, bumping his arm, led to my.talokg a .38 Super, through my left thigh.
      Not common, but true accidental discharges do happen. His finger was against the slide, by the ejection port, right where I could see it, when the pistol went off. The case hit his finger, popped back in, and stove piped.
      As to where he bought the ammo, I've been in that store. Used to live 45 minutes west of it, now live in PA, 2 hours from it. All he would have had to tell them is that he owned an Unsafe Act compliant, featureless,AR or Marlin Camp .45 carbine. Unsafe Act compliant PCCs do exist, and a company one county over, makes restriction compliant ARs. I used to work for the company they sourced certain parts from, and both are still in business there. Featureless and fixed magazine ARs, are still legal to own, transfer, sell, and purchase, in NY state, with couple cities restricting long guns to 5 round magazines, such as Buffalo.

    I am not a legal expert! With that being said, I think their are some key points here. The crux of the issue seems to be whether the person who bought the ammo did so legally. If the purchase was illegal, yes that might open up Cabelas to liability in this situation. However, it would also limit future lawsuits to instances where it can be demonstrated that a sale was made illegally. With that being said, if firearm retails can survive the initial problems, putting into place simple age restrictions on what age a person has to be to buy each type of ammunition should be a relatively easy fix.
