That NDA wont hold, as it contains illegal paragraphs. This is why NDAs are all but dead, as people neither know how to write them nor understand how they actually work. Two adults can sign a contract that they both agree to, but if that contract covers illegal activities, or has improper wording, or is missing certain clauses, it's worthless and non-binding.

no, however in most states it's considered a misdemeanor, which means they'll only serve AT MAXIMUM 1 year in prison for even the worst of cases, and most cases generally just end with fines. However it's extremely unlikely for prostiution like this to even be taken to court, as theres a necessary burden of proof and both sides will end up in legal trouble. Her for selling herself, and kai for purchasing. all in all its a lose lose situation for both so unless someone sends this to some boomer court that has nothing better to do it'll likely get swept under the rug, no harm done. They are both grown consenting adults after all. Usually prostitution laws are just a means to stop pimping and hold up public moral integrity.
There's also the possibility that the NDA he had her sign had some clause that said he was paying for relaxation services and not sex or something along those lines, and that if they did have sex it was voluntary. it's very obvious what they're doing but it would hold up in court.
