NO, not her fault AT ALL!!! They should not have moved her to that place in front of the speakers without informing her that she had to use ear buds! She is not technical and medically trained and can’t be expected to understand that she can get permanent hearing damage from being on that test! She gained a life long disability from this!

Back when I went to a small concert, someone decided it was smart to stage dive without a warning.. he was dressed as Santa and was part of she show. He accidentally kicked me very hard with his boots to the head. So things like this happens and are horrible. Sad thing is, he never apologized, but the security and the band did. I had a very bad headache and was very lucky that I didn't suffer anything else than that!

First case I wouldn't have given her anything, her own stupidity caused the problem that lead to hearing loss. Second case dude got what he was looking for, he knew she was gonna jump but still decideed to turn his back
The dude is not obliged to catch her..she should waited first for other people who are not interested to catch her to go before jumping off.. and why she need to kicked him..she can jump but she shouldn't kick someone.

The first case the man had to tell her to put on her earplug ,he was in charge its the company fault rules are rules no matter who you are you need to go by protocol.
She need to leave the courtroom, you fully know you have problems with your ears and you didn’t take any precautions about your safety. I won’t give her anything.
I could relate to the case about the concert. I was 15 years old and at a school dance and the music was very loud, so loud it could be heard from outside. I lost my hearing in my left ear.
I can't hear anyone in that ear. I'm deaf in that ear for the rest of my life. The other ear 's going too.
At that time I didn't know about court and sueing.

In both cases, they both knew what to expect and they both assumed the risks. Maybe they should be awarded half the money but definitely not more than half.

The first case I would award at least 75% because while the plaintiff was 25% responsible for her own injuries by foolishly standing next to a speaker, the stage hand didn't properly do his job at all and was more negligent and he partially was also the reason the plaintiff was near the speaker.

I do not agree as an an adult she's supposed to have some of the responsibilities. At least companies will be aware never to let come to their sound check
To the first case both my eardrums burst (perforated) when I was little and they have never healed and my hearing continues to get worse with age

For the 1st case, I think she's 49% responsible. I mean if you're going to enter into the danger zone you have a responsibility to look after yourself as much as you do to read the back of the card.
Yeah, I think she was irresponsible and didn’t used common sense. She didn’t even read the back of her VIP card. She should have used the earplugs provided. But I think she maybe failed to remember that concerts are very loud and she didn’t seem to understand how sound checks are. I do think the radio station should have said you must wear these earplugs and give her a pair. But laws are written ahead of time just in case of an incident and it was the radio stations show so they are responsible for what happens. I just think she shouldn’t have received 100 in her favor. Maybe 66-75% in her favor.

This exact thing happened to a friend of mine over 20 years ago and she didn't sue anyone. Still can't hear from that ear.
1st how could a woman being suspended in the air by other people, she would've want to kick to destabilise; 2nd it could've been caused by someone "elbowing" him, not unlikely 3rd perhaps extent of injuies were not picked up initial ER visit

All concerts are loud ive been to concerts and they are loud plus she stood right next to the sound system so it is her fault i went to the backstreet boys concert and it is loud after the show yeah my ears rang but come on its freaking loud how ridiculous

This has to be satire right ? this is the fourth video i have seen and 3 cases where a person was at fault, they won against the defendant because the defendant wasn't baby sitting them the entire time. She admitted to have not read the rules, she lied at first of where she was instructed to be at, she didn't wear ear plugs and she moved to the speakers on her own accord. Sure someone might have asked her to move, but they didn't tell her to stand right next to the speakers. She chose that spot, she chose to ignore the rules. Why did she win ? Because the owner didn't baby sit her the entire time. She was at 100% fault here and he should not be liable for her expenses.

I’m sorry when you go to a concert you assume a certain amount of responsibility. Especially I energy shows where stage diving and mosh pits are a possibility. If you don’t want to be involved in those things you have to move to somewhere in the crowd that it is not happening. This is disgusting. I’ve left concerts with a broke hand, and many bruises. It happens and you must pay attention.

You know you’re not supposed to stand next to the speakers and it’s gonna be loud whether they start in a minute or an hour everybody’s that goes to a concert knows that. On top of that it said it on the back of the VIP card and she admitted she didn’t read it.
For that last one, he just ruined all the concerts for everyone else. I hope those millions where worth it. You know he won't be welcome at her concerts anymore.

4 million dollars is a ridiculous amount for an injury. I believe there should be some sort of cap on settlements. Each one of the women are supposed to pay 2 million dollars that I’m sure neither one has, and may never have in a lump sum.
Hi i was at a Snoop Doggy Dog concert ,in san jose california , , the music was so loud , it injured my hearing, my ears ring weekly.
I have been to numerous concerts, some concerts the volume is a decent level. I went to a Fleetwood Mac concert, it was LOUD! Wish I had brought ear plugs

All the back story is unnecessary because it has nothing to do with the injury, If she is an avid concert goer she should know not to stand in front of the speakers.
1) The Ringing is indicative of the damage to the cochlea or sound induced deafness, which is the leading cause of new deafness for people under 30.
2) The rupture is the primary damage to the external hearing mechanism but they usually heal without issue, have had mine ruptured twice without loss of hearing.

Disgusting judge. It was clearly her fault. She said she's been to alot of concerts how come she's still ignorant about the sounds that would be too loud. Sound checks would involve amplifiers. Should she be near that?
On the first case, I don’t think it’s the ladies fault because she said a guy that was moving some heavy equipment told her and her friend to move to the right where the speaker was so if she was told to move to the right where the speaker was, I don’t think it was her fault And if no one told her to use earplugs. Then that’s on them and she said she didn’t see any earplugs out. Sometimes we can walk right by something and don’t see it. Even when we’re at home and looking for things, it can be right in front of us and we don’t see it.
You move, but you don't stay by the speaker!
As a business you cant expect your customers to know even if you think its common sense. That's why businesses put out wet floor signs even thought it can be clear as day that someone is mopping. You have to protect yourself as a business if you know that customers are coming to your sound check warn them to tell them to put in their earplugs and to make sure they in the centre.

Oh please! Americans are some MONEY HUNGRY PEOPLE. She went to a rock concert and now suing that her hearing was damaged. She went to a SOUND CHECK. A rock concert is LOUD. I sing on the praise team and SOMETIMES the sound is loud. I bought me some ear buds to protect my ears. She’s not a kid. Even as a youngster partying I knew better than to stand DIRECTLY in front of the speaker. If she was directed in the middle and someone told them to move, sue that person. Cases like this set a BAD president for people to live irresponsibly AND GET PAID for their irresponsibility and ignorance.

Lol that made me laugh because that's exactly where me and my daughter stand when the loop system isn't working at a venue, or the venue doesn't have a loop system. My daughter is deaf and standing next to the speaker is the best place for her as she can not only slightly hear the music she can feel it and she has the best veiw of who is singing and she can lip read especially when we go see cherry suade as we are friends with them and randy always faces her so she knows what he's singing 😊

You’re not getting $5 million you are getting half of that is partially this is your fault
Unfair decision by the judge. He knows exactly what was going to happen yet he turns his back and not even knows who kick or hit him in the back of his head. If he didn’t turn his back he would see that she was diving and slip that kick . This is not justified. The judge could let him get some money but no so much.
