If it's a lease, it remains the company's property. But if it's sold, the owner can do as he pleases.

IMO, first of all the man bought Cybertruck, no doubt he paid too much money for it, and in so many ways this was NOT a smart purchase. And secondly he signed a contract with Tesla, which is another not so smart thing to do. Hopefully this man will learn from this, he probably will need a lawyer.

Anyone who signs a contract that stops you re-selling your own property is clearly foolish. You have to ask yourself why Tesla has made this rule ? To stop bad press on people selling within a year ? To make sure dealership traffic is all ONE WAY ? Clearly Tesla holds all the aces here but the main question is WHY IN THE FIRST PLACE ? Do they not trust and support their product ?

I just drove back from Las Vegas. That was where I saw my first Cybertruck/clusterf*ck. It was at a light and if you think it is ugly in photos, it is even bigger and uglier in person. I started laughing my a$$ off and was tempted to yell something out the window.

How many people sign contracts and don't read the fine print? Retailers hate me because if they put a contract in front of me I will always insist on reading it and most times I give it back to them and refuse to sign

Just a point for those in the UK - you literally CANNOT sign away your consumer rights or any rights for that matter.
Plus, you cannot buy a cyberurinal anyway, it does not meet EU pedestrian safety regulations. So you-all are double lucky.
My thoughts are very simple. Anyone that would purchase a dumpster on wheels with that clause in the contract should just be so excited he has his dumpster, he shouldn't complain. He should put on a bumper sticker that reads "I love my Cybertruck more than brains."

When you sign a legal contract the details matter. This was not unforseen - it was the persons failure of due dilligence to ensure the vehicle will fit in parking spots BEFORE moving.
I mean if you bought a Cybertrash, you're pretty much announcing to the world "I have more money than sense"

It's pretty embarrassing seeing people drive EVs in public, especially Tesla owners. History is not going to be kind to them.
Why on earth would you buy something you cannot resell? In Australia I believe that this could not be enforced. We do not have cybertrucks on OZ and sales of ordinary Tesla's have hit a brick wall.
Cyber Truck won't pass our ADR's. And yes, Tesla sales have hit a brick wall here. C. 6,000 sales in March, 2,000 in April and 3,500 in May. I'm figuring that June is going to be pretty good for them, but just the same, they're down a heck of a long way, YoY.
Well this is so wrong in so many ways as it takes away your rights to own anything. Now it would be like say Toyota stating that if you used Shell petrol in your car within the first 12 months of buying it they have the legal right to fine you or the ice cream shop saying that if you did not eat the ice cream within 10 minutes they would be open to prosecution - totally absurd. So it seems that anyone buying a new car/vehicle (or ice cream) must read the contents/details of any contract before signing away any rights as to what you do with your car because the devil is in those details - or ice cream!!
Tesla does this shit all the time, and on the whole their customer service is diabolical. But what makes them truly nauseating is the way they suck up to influencers and famous people in general. Down to actually giving them free cars so they can shill for Tesla.

Because all their cars are tracked, Tesla knows exactly who are driving their cars. So if you are "important" (influencer/famous) you'll get a perfect seamless "customer" experience. Oblivious to the consumer hell that the average punter experiences when their cars fck up, which is often.

Technically speaking, if you're going to spend a fortune on a Cybertruck then pretty much anything that makes you want to sell it within 12 months could be classified as 'unforeseen'.
The only exception I can think of would be somebody buying one with the explicit purpose of selling it on for profit. But what would be the point? The way Tesla has been slashing prices recently you couldn't guarantee a profitable resale anyway, so that throws that excuse out of the bag.
You know a vehicle is good if you are not allowed to re-sell it.

I don't see a problem with Tesla limiting second party sales for the first 12 months until production ramps other otherwise being allowed to buy one early would just be a gift to scalpers. Used cars shouldn't sell for more than new ones.
Which jurisdiction? Consumer laws vary depending upon local/national laws. Back in the late1940’s early 50’s in theUK there were restrictions on resale within 12 months due to shortages of cars - and speculators buying & reselling high

Why would you honour a “fine” imposed by Tesla? Even if they get their way in court, what leverage would they have to get the money from the owner? This sort of shady customer experience should drive people away from buying the thing in the first place.

Tesla aren't the only ones attempting to stop people flipping their exclusive launch cars. Porsche and a number of others do the same. You know what you're getting into when you buy the car.

Ferrari has been doing this for decades and no one has a problem with it. Ford also does it with the GT.
Sports cars increase in value... Teslas and other EVs lose value as soon as they leave the dealer's yard. It's because of the battery and the software. After a short time, the software has errors and the battery loses power. Buying used EVs is like gambling. With Ferrari and co, it somehow makes sense because their cars retain their value and even increase it. It's not so bad to have to wait a year before you can sell a Ferrari. With the Cybertruck, this one year can mean that the car is only worth half or less.

@@justsomeguy6474 I've just seen that a new Cybertruck costs around 80 thousand and a used one with, say, 100 miles on the clock sells for between 120 and 200 thousand. What a seller wants is one thing, but whether customers are willing to pay that is uncertain. The prices are only so high because there are few of these things. Soon the fact that these cars are simply bad will have an impact on the price. The stainless steel rusts shortly after delivery, the battery can only be charged to between 80 and 20%, etc.... The Cybertrucks that are offered for sale all have very few miles on the clock and have been slipped. A few of them have 1000 miles on them and come from people who didn't like their Cybertruck and wanted to get rid of it. So the entire used Cybertruck market only consists of guys who don't care about the car. One person buys it just to sell it at a profit and the other person doesn't like the car after a very short time and wants to get rid of it. This is not a good sign and will lead to the market for this "car" collapsing soon.
Ford would at least buy back the GT. Ferrari makes you buy a few crappy cars before they'll sell you the good one you wanted all along.

The cybertruck was announced in 2019 and the delivery was 4+ years later. It shouldn't be difficult to prove life changing circumstances can't be predicted in such long waiting time.
Maybe next time tesla should ask pre order customers to hold their breath until delivery.
I can drive 300 mile in any vehicle. The difference is if I run out of gas, I have an infrastructure strong enough to refill it. EV charging stations (if they are working and the temperature is above freezing), my ICE truck works in any temperature and has a much larger range.

Toyota did the same thing in Australia!… absolutely absurd! Then Toyota were also going to start charging established customers a subscription for “remote start” functionality from the keyfob, even after the fact that owners had bought the vehicle with the function and it required no ancillary services to operate the remote start (such as cellular or servers), just the key fob and vehicle.
Now the likes of Adobe are dictating to customers that anything and everything they create and use within Adobe’s software can be used/reproduced/altered/marketed/on sold… by Adobe in any form they choose without consequence from the creator or financial royalty to the creator!!,🤯🤯🤯

I will never sign up for some legal relationship to own a freaking car. The internet/cellular network gadget makers managed to sneak that particular type of corporate/consumer relationship into the world. I'm not going to participate in that with an appliance, a car, a bicycle, etc... corporate world needs to get kicked into the corner.

FEVs are ok, just the lack of gas stations make them a nogo.
BEVs are ok in the smallest of vehicles, the road legal electric scooters (in Europe they are classified same as bicycles), that bridge the last mile or bring you to the shop that's 3km away where you don't want to walk or sit in rush hour traffic jam for.
The rest is just enthusiasm for people with too much money :).

Tesla isn't the first company to include a clause restricting resale within 12 months. The clause was intended to prohibit purchases simply for resale of vehicles which were in high demand with low availability, thereby reselling for profit. Of course, in Tesla's case resale within 12 months at a lower than retail price could drive down new vehicle prices at a faster rate than they are already falling.
