    I don't believe these people deserve one penny for the stupidity of the grandpa what-so-ever. Even if there was a glass window I would have never place a one-year-old on a railing and let her go. What the hell was he thinking? how is it that you don't make sure the area is safe? and the parents hired an attorney before they even got the remainings back. Sorry but is definitely NOT the cruise ship staff responsibility to babysit your child and grandparents.

      As long as we continue to allow attorneys to file consequence free lawsuits than we should expect to see lawsuits regardless of who is responsible or who is at fault. The problem is that most companies will settle because it's cheaper than paying defense fees and that's not a sustainable model.

    If he thought it was all glass then why not leave her on the floor where she can still bang the window??? why bring her up to the higher window? I'm not blaming no-one here, i just don't understand why put a 1 year old on a wooden railing to bang on the glass when the whole wall is made out of glass??? she didn't have to be lifted...I been on a few cruises and they do leave some top windows open to flow some air in.those windows are high and hard for any toddlers to reach.

The railing is not meant to be sat on is meant to prevent people from getting that close to the windows. That's a warning sign on it's own! Such a tragic loss. I don't think the Cruise line is at fault on this one.

    Gramps noticed the open window. He walked over and stood the baby on the rail to get a clearer view and to feel the cool breeze coming through the window. The baby jerked or leaped out of his hands. Gramps pride will not allow him to admit it.

      Why life her up when she can see everything perfectly from the 1st level of windows? Because he saw that particular window was open and thought he'd raise her up and give her a thrill by looking directly out of the open window. Perhaps he even "dangled" her a little, like Michael Jackson did his child, to make it more exciting for her.Very likely, the kid was terrorized by the height and struggled with her tormentor to be released, at which time, pumped up with adrenaline, she over-powered his grip and he dropped her. Embarrassed by what just happened, the step-grandfather made up the story that the little 18 month old had a "window-banging fetish" and he was just trying to make sure she was enjoying herself with all the windows on level 11. Something not right here, especially the big lawsuit against Royal Caribbean, for "not watching over their child" when she had the whole family on the cruise to keep in eye on her and monitor her safety.

    Showing cute photos of the one year old to make people angry at the cruise line may work for some people but not me. She was adorable and her grandfather deliberately lifted her onto a handrail and left her there (according to him). The window was not down where she could get at it (like the plane of glass in the 'hockey' picture). He lifted her onto a HANDRAIL. Handrails are there to stop people falling over edges and he, his family and their (predictably) lying lawyer are just a bunch of money grabbers.

      This was a tragic accident and blaming a cruise ship for the accident is preposterous. Leaving a kid in a hot car and it dies, should we blame the auto makers for not allowing air in the car? The healing process should not start with a lawsuit and no amount of money will bring her back. We need to stop blaming others for the mistakes we made.

      Ruth S. Agree! On my last three RC cruises, the windows were not exactly clean, so you can easily see if they were open or closed. Hard to believe he “didn’t” know it was open. He did a very irresponsible, stupid thing & now wants to blame the cruise line.

    Glass can break regardless of what type it is and no one should be banging on glass anyways rather it be an adult or a kid. Also the child was lifted up to the open window and over a railing which is not a standing area and the child was left unsupervised or is there something else going on we don't know yet. The videos will be out and will show exactly what happened. So getting money if they happened to win a lawsuit will never replace your kid and the person will always know the guilt and the pain which they could have prevented by making bad choices.

      Cantante Gaming Exactly! On my last three RC cruises the windows were dirty enough that you can easily see which ones were open or closed. I have been on Freedom & due to being an older ship, the windows are scratched up so that they are not clear, so makes it easy to see if they are closed. Bottom line, the grandfather did something irresponsible & stupid and wants to blame the cruise line.

      Exactly, the cruise ship should’ve ASSUMED that people got 99 problems but a cruise trip with the royal Caribbean ain’t one... therefore Think scientifically and not emotionally. What if you went on a vacation and took your mentally unstable grandma to that very same cruise ship. Granny is doing all fine and well but then granny just snapped and ended up going through her common burnout syndrome with your little baby on that nice and totally safe window spot where that grandpa (cough) (cough) accidentally mishandled a baby into spacetime? Obviously it’s the cruise ships fault in simple engineering failure of common passenger public safety. Yes you can say that your granny or someones else’s granny intentionally threw your baby into spacetime but all of this could have been avoided if the retarded cruise ships had safe windows to BEGIN WITH... Hence, granny could only have just yelled, throw some punches and call it a bar mitzvah. Therefore, with the help of SIMPLE safety, your ugly baby would be good and safe for now but waiting for another innocent accident to happen.

    I've been on Freedom of the Seas three times. You can absolutely tell when the window is open and when a window is closed. The ship has been sailing for 13 years and never had a problem or on any other sister ships.

    It’s a 1 year old baby! The person that was suppose to supervise her is responsable for what happened to her. If that person can’t even tell if a window is closed or open then he shouldn’t have been in charge of the baby in the first place. And besides that, he put her in the wooden railing 🤦🏻‍♀️ who does that!?!

      Don't be ridiculous. This is a public place, the environment has to be able to cater to people of all ages and capabilities including possible aggressive drunk young men and oldies well into their 90's. You don't allow a system which lets a whole pane of glass to simply be removed at that height. Hotels, hospitals and tower blocks have made sure for decades that their windows can't be opened any more than about 4 inches at any kind of height, usually second floor and above. The grandfather thought it was an entire wall of fixed glass panels, and that was a reasonable assumption to make at that level above ground. Of course there was a handrail, someone crashing really hard into a wall like that could still break the glass, and people get vertigo too and might need something to steady themselves near a window on a ship... so I don't think the existence of the rail signalled anything in terms of the danger of being near the window. He not unreasonably thought there was a secure pane of glass in front of them.

      @Robb: You are so right. One of the first articles I read stated that she liked to bang on the glass at her brother’s hockey games. Who would let a child do that? It’s not only dangerous, but it’s annoying to the other attendees. Then the grandfather stands her on a handrail (which is meant to keep people AWAY from the windows?) I think it’s totally the grandfather’s fault but I also think that the parents were raising this child to be a spoiled brat. Seems like the word ‘No’ does not exist in their vocabulary.

      I can't tell in the photographs that that window is open. You can see clearly from outside the ship that it's open, but not from inside.

      Epsom Salts You actually can, ive sailed with Royal Caribbean before and this is the exact reason the windows are tinted, so that when one of them is open you can easily tell the difference between glass and air based off of the extreme difference in color. I know there’s photos circling around of the window supposedly open in one and closed in another and there being no visual difference, but I strongly believe the window is open in both pictures. And even if you don’t notice the color difference, if you’re paying attention there’s no way you won’t notice the noise and wind coming through the window being less than a foot away. Again, no excuse.

The point is that it can't be picked in the first photo - it needs the second one with the red circle drawn around it before you actually realise which pane is open. It should not be possible in any public place to find a window open like this, let alone in a children's play area and at a height that people often carry their kids at - hip height. Hotels and hospitals stopped allowing open windows any higher than the second storey decades ago, because too many people threw themselves out! Relying on a window tint is poor practice I would have thought, because being able to see the tint relies on a lot of things, including the age of the person viewing it and whether or not they themselves are wearing tinted glasses. The ship was docked in port with quite a lot of built environment around it, so there may not have been any breeze or very much noise, and the visual background may not have allowed the tint to be easily seen. Just as it can't be seen in the photographs.

    I’ve been on 13 royal carribean cruises and 4 of them have been on the Freedom of the Seas. There is no way that the little girl could have fallen from that window unless she was being held by someone. I’m around 5’7 and the window starts at my chest. The cruise is getting blamed for something that is nowhere near their fault. I’m sure they will give the family some money for their sadness anyway, but this case they won’t lose.

      Exactly. Cruise ships can be humid and stuffy, especially when docked. So having an open window helps. That's why they open! Those people knew that window was open. No way they couldn't tell. People always place blame on someone or something else.

      Yep been on royal carribean same style as this. Deck set up is familiar. Yeh those upper decks get stuffy so windows open and close. Only the tops are open since they are out of a kids reach unless parents lift that past that rail to what gramps did. They just arrested him.

      Attorney saying window should have been closed. Lol. Umm anyone can open and close them they sliders windows. Does not matter staff or passengers esp when the ship is docked and in port. Those upper decks get hot so the windows open to ventiliate. Poor gramps. But seems he held his kid out an open window.

    I'm still wondering why you would take an 18 month old in a 7 DAY cruise! You can't even take them to the kiddie pool unless they are potty trained. They are bound to get bored and restless. And why would you let a child "bang" on a glass window that is 11 stories high. And why did it happen to be the only window open out of all those windows? That window is RC's property, not his to let her bang on. The whole thing doesn't make sense, especially since his story keeps changing. It's not the cruise liner's fault. He was probably aggravated for having to babysit while the other grandparents and parents were out having fun. And this was just their first day of the cruise. And they hire an attorney and thinking of suing before she is even buried? Smh

      Karen, there is a large splash pad for kids that she does not need to be potty trained for. Swim diapers are acceptable on the ship. There are also kids programs, games, arcades, etc. Let’s not talk about whether kids are welcome to go on a vacation that is otherwise safe if a supervising adult isn’t dropping them over a railing...

    I feel terrible for what happened to that child. But sometimes you have to take responsibility for your own actions! Why on earth was that child left alone on a railing in the first place?! That’s just begging for the child to even fall backwards and hurting herself. My deepest condolences to the family and that poor child, but grandpa was wrong in this case.

      She wasn't alone. He was standing right beside her, as you would if you put your toddler down to enjoy standing against the glass. She was used to doing that at her brother's games. Except this time, there was no glass. He just wasn't restraining or securing her, because he had no idea there was no glass there. Sorry but adults carry their toddlers at hip-height all the time, and pop them down on safe, convenient benches, ledges, countertops etc. This was an accident waiting to happen.

    Sorry but I went on this ship last October and saying that they didn’t notice that the window was open doesn’t seem right. I am NOT saying any foul play was involved at all. There are definitely windows that open in that area where there childrens water park is located. But the windows have a bluish tint to them and anyone can easily notice the difference between an opened one and a closed one. Its so tragic and I feel terrible for the family! What a nightmare! 🙏🏽💔😔

      It depends what the light is like in the room and the backdrop to the windows as to whether that blue-ish tint is going to be noticeable. Also seniors tend not to see subtle distinctions in shade as well as younger people do. He clearly thought it was just a wall of glass panes and didn't realise any of them could open.

    This is tragic, what is even more tragic is that this ambulance chaser, who im can almost promised you approached the family and put the idea of a lawsuit in thier heads, while they are in such a horrified state, is convincing everyone that its the cruise ships fault. Sorry, but that area is not a children's play area, its part of the lido pool area. the grandfather sat the child on the railing, against the contract he signed when he booked the cruise, and please dont tell me you cant tell an open window from a closed on that's 6 inches away from you.

      I agree with you man, I've been on that ship recently and I know exactly the area where the tragedy happened. That area is not the little children play area as the family claim. The guests that I saw in that area were mostly young adults and older and their usual activities are playing cards, reading, eating and socializing.

    The family have had the cheek to retain a lawyer to try to move the blame on to RCI for having the window open - when it's obviously 100% the grandfather's fault. How can anyone not know when a window is open?. I'm heartbroken for the child who lost it's life - but can find no sympathy for the grandfather whose gross stupidity caused all of this, and for the family member who has retained a lawyer - as the only thing this means is someone somewhere is on the hunt for money.       @LTD Davis Dude, I been on that ship before and I know how these windows work. They are about 4 feet from the floor and pretty big. It requires some effort to slide the windows to open it. No children would be able to open these windows. As an additional safety, they have hand rail about 12 inches along the glass pane to make it harder to stand close to the windows. You on the other hand have never been on a cruise ship before but try to sound like some expert.

      @LTD Davis Windows are necessary on deck 11 to allow fresh air to cool the area. They are tinted and chest high for safety reason. Your argument by compare a pool in your house have lock and fence is nonsense. All public pool area normally have lifeguard on duty do you have a lifeguard on duty at your home pool?

    Wow, the incident occured on Sunday and on Wednesday they already have an attorney? This was totally preventable by the grandfather not putting a toddler on any railing, period!     This is such crap. The windows on a cruise ship open so you can catch a breeze, but only the upper windows above the railing open. Also every cruise ship I have ever been on, you can tell if it is open or not. 1. You will feel a breeze 2. The windows are a bit cloudy from the sea salt 3. They are at a level that even an adult would have to stand on a chair to get out of. Own up to your mistakes Grandpa and allow your family a time to greive.

First of all why would you think it's okay to put your one-year-old up on a hand raill, let alone at a window 11 stories high. It's a handrail not a viewing ledge. Secondly why would it be okay to let your child bang on a window! Third....how do you not know a window is open! Be responsible for your children, hold on to them!

      The cruise company should require all its "guests" to wear bubble suits and/or life preserver vests at all times while on the boat. This would put an end to most of their litigation problems. The suits would fit right over their mentally challenged headgear, and would provide for minimal contact with other guests.

A giant chicken fence of approx 18inch hexagonal wire, suspended around the ship should provide much more than adequate protection. HOWEVER, accelerometer equipped suits with appropriate parachutes would be indicated for airplanes, or high rise buildings. I understand there is an airbag for motorcyclists which is similar to this that is already available (sadly it doesn't deploy a parachute, yet)

    Who puts a child up on a railing to "bang on the glass" glass breaks if banged on long enough hard enough. Dont think the cruiseline is responsible at all. Railings are not there to be sat on. I think going for compensation after the line has made sure family has incurred no expenses after tragedy occurred is trying to shift the blame and get compensated for own negligence. Why try and profit now from the negligence. Thats like me running onto the motorway , getting hit by a car then suing the makers of the car because i got hit

    Those windows are always open. It’s wrong for the grandfather to put the child on the rail in front of the window. I’ve taken six cruises and they always had those windows open for people to lookout. Their should not have anyone be on a railing looking out. The grandfather should not put the child on the rail unless he check to make sure the window is closed. Who in their right mind would put a child in front of an open window on the 11th floor. You can’t blame the cruise because the family of the child was in the wrong. That child should not even begin looking out the window in the first place. My heart goes out to the family but you can’t put the blame on the cruise line. Because those windows are always open regardless who looks out of it take your hand 🖐 and feel if the window is closed.🙏

Horrible accident, but letting a kid bang on a glass surface (even if she got used to it during hockey games), lifting her up that high without holding her, not noticing the window is 'missing' and doing it in front of a window with a long way down..? All sounds pretty preventable too - if you're looking to blame the cruise ship/crew... If I were the mom, I'd have a hard time visiting gramps... ever again.

    I’ve been on Royal Caribbean cruises before and there is no way that a children’s play area with the next two windows that would open. And why would you put your kid on a wooden rail before I even finding out if the windows open or not because you thought it was cute secondly there’s no way you cannot tell a window is open they don’t open all the way you can even feel the breeze coming through the open window basically the grandfather messed up and drop the kid.     I was on a ship identical to that--Liberty of the Seas and the glass is tinted so it is easy to tell if a window is closed or not. Every other window is open in that area to keep it cool and you can easily tell which windows are open. I still don't understand how that that grandfather did not know the window was open there. This is a tragic story all around.

      It's not easy to tell in the photographs. I can't tell. It depends on what's in the background as to whether the tint is clearly visible or not.

    For those of you saying that you have been on a cruise, and you can tell if a window is open or not, you don't need to go on a cruise to tell if the window is open or closed.

    Why did they refuse for the STEP grandfather to have a blood alcohol test? if he hadn't been drinking they would be happy to prove it.

    That area is not just a children's play area, it is a general public area. There is specific children's areas and they do not have windows that open. This is all about the family NOT taking responsibility.

      @Debbie: they have the video but the parents didn’t want to watch it. They asked for a copy instead. Authorities refused (I would too. This family is a bunch of liars.)

    What about the wind ....how he can not know there was no glass ....I think he just wanted to seat the baby on the reeling and the baby though there was glass and try to bang on it and he lost the grip on the baby

    All the mean comments, wow. If this was their first cruise and the grandfather put her up to see better and the other windows were closed it is possible it was just a terrible mistake. The lawyer could be the spokesperson for them, they have not filed a law suit. And I’m sure they don’t want to be on camera for the worst thing that has ever happened to them, a true nightmare. Very sad.

    It's months later - we now have video footage of the grandfather literally holding the toddler out of the open window - he totally lied !

      @Nick V- the cruise line can't predict that an opened window that is about 4 feet above the deck would cause the death of a toddler who can't even stand up. The cruise lines do their very best to keep passengers from falling off their ship but they can't prevent stupidity of an adult placing a child near an opened window. If not an opened window, the grandfather could have placed the toddler on the railings that are everywhere on the ship. I've been on over 10 cruises and it's nearly impossible to accidentally fall off a ship. Most of the passengers who have fallen off either climbed over the railings or were pushed off by someone else.

      It doesn't matter who opened the window. The window is too high for a child to reach on it's own, and there is a wooden railing in front of the window. Railings are just like the ones you see on staircases. They are there for safety, not for decoration. The minimum height is higher than the waist of an average adult. Those standards are in place to prevent accidental falls. A child is not in any danger from a window at that height because they cannot reach it. The grandfather chose to place her in front of an open window.

    I love kids and feel sorry for there loss. However, it is your job to keep your child out of danger / harms way. The cruise has windows that open, not a crime apparently or they wouldnt be there. It was a mistake by the grandfather clearly. Im suprised the lawyer isnt trying to sue the person who acually opened the window LOL. .. that would be just as dumb as sueing the cruise line for your parenting mistake.
