@@maces1405 OK, all charges are dropped because he acts military (until that last part). But the two-year suspension of his license is automatic, and has already happened, effectively, before the end of the video.
Yess, he'll be pulled over again, drunk as shit (again), but the penalties will be significantly worse.
@@maces1405 It has nothing to do with opinions. He refused to blow and got a 2 year suspension. It's not the opinion of the cops that he refused to give a breath sample. It's an objective fact. Another objective fact is he's just another drunken idiot.

And the automatic suspension is outside of any court proceedings, other charges may be dropped (like resisting), but refusal to do an alcohol/drug test is automatic, and put in place to avoid people like him just acting mute in an attempt to avoid consequences to their own stupid, arrogant decisions.
Get a warrant for a blood draw. We need stiffer penalties for drunk driving.

It shouldn't matter. A refusal of a breath test should just get you the exact same charge as DUI. No reason to refuse unless you are wasted.

Knew he would have a prior OVI, so that's why he knew what to do and not to do. He is never going to comply with a 2 year ban.
Maybe if the penalties were stiffer like maybe impounding the vehicle for 90 days people wouldnt do this

Doesn't deter them at all, My dept has arrested one guy for DUI 7 times now and he keeps getting probation but even when we seized his car, He'd have another one within a few days

@@adeptusfantasticus Actually it is. He is REQUIRED to present his drivers licence, his proof of insurance and his registration for the vehicle. He is NOT required to answer questions or speak to the police but in refusing to speak with police or cooperate with their investigation, he has guaranteed he will go to jail for at least a while.

Right to remain silent is t a right during traffic stop & identification. Right only applies if and when asking questions or conducting investigation.
@@adeptusfantasticus It absolutely is covered by his right to remain silent. He has the right to refuse the breathalyser unless a judge issues a warrant. Some states have instituted laws where it is a requirement to submit to a breath analysis or blood test in order to keep your licence, because having a drivers licence or driving a car is not a constitutionally protected right. You still have the right to refuse the breath analysis but the state has determined that if you refuse to do so, they will suspend your driving priviledges.

Under the 1984 U S Supreme Court case of Berkemer v McCarty, during a traffic stop, once you give the police your license, registration and proof of insurance, you have the absolute right to refuse to answer any and all questions.

I know, i let my gs go to the beach this weekend with a friend 5 hr drive theyare 16 yo i worried the whole time till they got home sunday. People on the road are crazy

I worked a lot of evening and night shifts. One Friday night, around 1 am, I came up on a drunk that was so bad, I couldn't safely pass him on a three late interstate. I called 9-1-1, and followed him for several miles, while on the phone, as the police came flying in. Worked GREAT.

Speaking of needing a new profession. A whole lot of employers let you go with a DUI. Most drunks are already on the radar of the bosses anyway. You cant hide it. The smell, the strange mood swings and poor performance, calling in sick too much. They know, now you have given them a way out.

Woke up yesterday morning to a car crashing into my house. The woman driving was blackout drunk. She made it across the street (probably drove a total of 100 feet) and smashed a car parked on the street and then flew through my yard into the house. She was swearing at me when I said I was calling the cops. Drunk drivers are some of the most selfish people on earth. This was in a city neighborhood at 6am. People were already out walking their dogs etc. someone could easily have been killed.

You are supposed to identify yourself, and it is polite and non harmful to answer yes and no to questions.

The right to remain silent does not apply to requirement to follow orders, turn over license registration and insurance, or comply with SFST's and BAC tests.

This is a small town PD that could actually work much more proficient. When the backup officer arrived and it was clear that the driver was reaking off booze in addition to being ignorant by not talking, you get on your phone and call the on call judge, get a warrant for a blood draw and move straight to the hospital and then to jail, it was clear he wasn't going to ptovide a breath sample and he had a previous DWI conviction therefore he knew exactly how to delay and stall!

Everyone has the right to remain silent and not assist in their own prosecution, and this man simply took it to the extreme. I personally know someone who was stone cold sober and decided to be cooperative, did the FST (and flunked) , blew 0.00, got taken for a blood test, and was still charged with a DUI. Only months later did his drug tests come back clean and he got his case dismissed. But he got his car towed, had to post bond, and pony up a couple grand to hire a lawyer in the meantime.
Now I'm not condoning driving under the influence, but this guy almost did everything "right" to avoid a DUI conviction. As it stands there is very little hard evidence that could be used in a court of law to suggest that he is legally under the influence of drugs or alcohol. He is mostly likely gonna get nailed thanks to the implied consent law, but honestly, with a prior DUI conviction violation of implied consent is definitely going to be the lesser of two evils.
