  • TSM’s CEO Andy ‘Reginald’ Dinh has publicly shared the results of an independent and internal investigation into accusations of bullying and creating a ‘culture of fear’ at TSM by both current and former employees.

      Did you even watch the video?? He was investigated and it came to be inconclusive by an outside source. Of course the TSM company would be investigating their OWN CEO on grounds of verbal abuse and inappropriate workplace behavior.

    This is what I expected from the TSM investigation. An internal investigation where the outside investigating party is probably going to be paid by the company to investigate their own company sounds sketchy at best.
    I'm not saying Andy is guilty, but I'd like to see what Riot's investigation pulls up before making any decision.
    Essentially the result said the third-party investigation found "no unlawful conduct." My previous job had a manager who would berate us, but what my manager did wasn't illegal or breaking the law. He made the workplace feel like a nightmare at times. So I remember the company eventually fired the manager on the basis of a different mistake he made and not him being rude and demeaning because that itself isn't enough to fire someone according to the company lawyer.
    So what Andy is doing isn't unlawful, but I'd be hard pressed to believe that he creates a positive work environment.

    As a lawyer, this is incredible sketchy. I'm not from the us, so idk how the legal system works there, but this is almost a joke for several reasons.
    1.- The report seems more like a legal defense than an investigation, when you do a legal defense the main goal is to prove nothing illegal was done, but says nothig about unmoral beheavior, that isn't strictly illegal
    2.- They were very specific about the subject and the legal definition of "sexual harrasment", and "discrimination" (as Danny said), and wasn't about the alegations that DL made, probably because he wasn't the reason this "investigation" was conducted in first place.
    3.- Most likely, the employee who made the original complaint actually said something about sexual harrasment.
    4.- An investigation like this shouldn't be conducted by an attorney, unless they are highly specialized, a team with a wide variety of professionals is way more suited (psychologists, psychiatrists, social workers, etc.)
    5.- They said "Mr. Dinh recused
    himself from the special committee", and "Mr. Dinh (...) supported the formation of the special committee." I mean, they guy had no other choice, he had to do that, but the words chosen to explain this, sounds like he's doing this out of free will, because he's "good", supporting what i said that this sounds more like a legal defense rather than an investigation.
    6.- In the last paragraph, the "investigation" actually said that the guy is a bully, he mistreat his employees and call them names, but its just not on the range of illegal activity.
    This, not even taking in consideration the method they used to pick the lawfirm which conducted the investigation, although I don't think that it matters, beause they weren't hired to ask to correct questions.
    In summary, Reginald can get away with this, because being a bully isn't illegal, but I think that riot investigation will (and should, for the sake of the company) adress this behavior, but idk if they are legally empowered to sanction this person.

      All your points lead to a conclusion of...
      This 'internal investigation' was investigating an entirely different matter than what DL brought up.
      This wasn't investigating "Is Regi a bully?"
      It was investigating whether or not Regi sexually harassed and/or discriminated against the former employee who made a complaint against Regi before DL even made his statements.
      That's why it reads like a legal defence; it was a legal defence.

      RIOT is allowed to ban anyone from their gaming platform or sponsored tournaments for any reason. Its their product, and bullying breaks their TOS. They could tell TSM they cant participate in any tournaments or play any games in LoL until Reginald is legally not a part of the company anymore.

    The problem with this is that no employees would whistleblow on their EMPLOYER without any protection of any sorts.
    In public companies where an employee whistleblows on their company, the SEC will sometimes protect the whistleblower to help secure them of a job or anything else.
    Realistically if I speak up on my boss and they find out I was the one that did it. I will 100% get fired one way or another. My job wouldn't be worth speaking up.

    Regi: ok i wont be a part of it, but the board of directors who I pay and chose personally will.

    Lol notice how the doc from the law firm said no cases of sexual harassment or legal wrong doing which wasn't ever the main thing in question. People were concerned if regi was engaging in POWER harassment not sexual harassment.
    Kinda slick of regi to take the findings of this law firm and spin it into 'see guys all I ever did was give people some poor taste pokemon nicknames and call it a day 😏'

    "Unlawful" doesn't mean unethical or that no form of bullying happened, btw. Just that nothing was found by the lawyers to have been significant enough or of a specific enough nature to warrant them worrying about incoming lawsuits because of it. The words "unlawful" and "discrimination" are likely used in their legal definitions here, since this was written by lawyers, which especially in the case of "discrimination" is strict and not the same as the Miriam Webster/Oxford definition.

    Most people who have been in the work force for 10 plus years have came across more than 1 people like this. In fact most kids who went to public schools experienced a teacher or staff member like this. Bullies deserve to lose. When 1 percent of people makes 50 percent of people feel like shit. They need to be humbled by life abs stripped of power

    What’s funny is they did actually find that he did things wrong, just that he didn’t do anything illegal(which no one accused him of). If you read the report there are responses of him doing the things claimed. And this is with a small sample size of people who may or may not have been relevant.

    I would argue on Riot's side that they will want to be extra thorough BECAUSE TSM is such a large org for their games. Does Riot want to carry the baggage of Regi bullying and intimidating his players and champion that? Regardless of if they want to side with or against, there are going to be no half-measures.

    RIOT is allowed to ban anyone from their gaming platform or sponsored tournaments for any reason. Its their product, and bullying breaks their TOS. They could tell TSM they cant participate in any tournaments or play any games in LoL until Reginald is legally not a part of the company anymore. Hope they do this.

    The internal investigation was a joke and a sham. Not a darn part of it addresses any of the allegations about him. If anything it touches on stuff no one was talking about. Regi is a terrible person and he will never ever change. Its clear he has too much power there and just told the investigator what to write. This a joke and I hope karma catches up to Regi and it sees him permanently removed from any position of power.

    There's no "illegal" thing he done. (Didn't cheat, elo boost, account share, poaching, betting on opposite team and make ur team lose for more $$$, which are mostly problems that riot sees but not abusive management)
    He is just committing a really bad rep of being an arrogant bully who is lucky because he discovered this first and now thinks he's still an expert on this field.
    All those abused would otherwise chose to "idk, he's not a bad guy" approach as to avoid any underhanded tactics regi would do to these victims (be it not be able to play at pro or even amateur league, because he can)

    Honestly really not surprised by this. Reginald basically became a powerful man in the league scene when he was relatively young. I highly doubt that he would have had evolved his work ethic above that of a late teenager since, let's face it, TSM is still one of the main NA teams in League.

    Investigator: “It’s shown that you said this and I quote - You fucking piece of shit - end quote. Did I read that correctly?”
    Regi: Oh that, yes I you did…. but I was talking about the shit, not really about anyone.
    Investigator: Alright so misunderstanding of words I see… Okay what about you calling you players words like dog, toilet and trash?
    Regi: Easy. I was just playing I spy with my little eye game with them.
    Investigator: But it’s shown that neither you or your organisation own a dog.
    Regi: Oh crap… ermmmm… Woof?
    Investigator: * stamps acquitted *

    Besides the fact that the investigation is internal with Regi "taking no part in the process", does anyone else find it DISTURBINGLY different topics of Regi's response (talking about his tone and how he addresses people and potentially makes people feel uncomfortable) and the investigation results themselves (no evidence of unlawful sexual misconduct, gender discrimination, or race discrimination)? (this is more of a specific take on what is said at 6:25)
    The problem is with him berating his players/employees and as doublelift put it "acting like a bully", not him being mysoginistic/racist/sexually predatory. The people who counteract the claims of his harsh language by directing his words towards a different topic (~4:30) is not only *wrong* based on some of the publicized clips, but almost seems to act like a direct call to Regi's announcement. TO ME it seems to read "Hey guys! Nothing illegal going on here! Oh-yeah-and-btw-the-people-that-said-he-was-a-bully-and-all-of-that-bully-stuff-he-didnt-mean-it-in-that-way-lol, but here's a public statement by Regi saying that he thinks he could've came off harsh in the past despite the clean investigation (albeit one with a result not properly addressing the actual issue presented) and he's working on himself! Go TSM!"
    I really started writing this at like 5:00 in the video and it's being repeated at the end of the video xD

    What was this joke of an investigation. "None of the witness interviewed had witnessed or were aware of conduct or derogatory comments aimed at and / or based on any protected characteristic, i.e. gender, race, religion, sexual orientation." He wasn't being accused to being misogynistic/racist/anti semitic/homophobe. He was accused of being a shit person regardless of protected characteristics. All this says is that he didn't target one particular protected characteristics but doesn't say he created a culture of fear, which was the main allegation made by doublelift.
