Its irrelevant if they were on the side of the carriage. As the owner, you have to assume that not everybody will follow the rules. If the tent was at its correct distance, even if they leaned the wrong way, they would have hit nothing but air.. you saw the minimum distance required was 350 feet based on the knots, the tent was 100 feet away.. cant ignore that

But prior to this part when he FIRST says "I told them to stay in the center" and the husband says "😂 who stays in the center?" Basically telling on himself that they truly DID move to the edge. So I'm not sure what the verdict is, but I mean he literally admitted that they didn't stay in the center as was told, then later denied that, so it seems they might be lying a little. I get what your saying and to an extent I agree with you. However, once the expert came in and showed that the balloon would have hit the tent due to the owner not being far enough away from the tent, then the judge backed up that fact while reading the aviation guidelines was proof of the owners neglect. It wouldn't have mattered if they were standing in the middle of the basket or not, they would have fallen out and received the same injuries when it hit the tent. Therefore, the owner was fully at fault due to his neglect of not following aviation guidelines for hot air balloons regardless of where the couple were standing.

I don't think that basket was large enough to allow all three adults to stand in the middle. The hot air balloon guy has been in business for 25 years without safety incident. I think his experience should have been taken into account. This ruling takes away his livelihood and no one will have money. I’ve had the pleasure to ride a hot air balloon and the instructions we received were to stay in the center. Only when we got higher were we permitted to equally (by weight) go to the edge. Their accident is certainly unfortunate and that’s a lifetime of physical problems. So I have one question, if they took photos, why didn’t they provide photographic evidence? All around, it’s awful for both parties.

I think both are at fault in the hot air balloon case. But because of the law of needing to be at least 350 ft away from the tent due to the wind and the owner should have known better for being in business for 25 years. I also think that couple didn’t stay in the middle as they were told. However, the owner neglected safety precautions by not making sure the balloon was far away enough from the tent.

Balloon man isn't saying a lie you have be in middle going up an going down. As I helped many Balloons land in Ottawa. There are over 100 balloons that land once a year . Am so many times people don't go in middle an ballons shift to what ever side when they are not in middle so if they looked over edge they was looking over on side to towrds tent . I've seen it personally hot air balloon go up when there is wind they lower or add heat to control shifting of the wind an heat would lifted the wind an shes not considered the hanging off the side . They say an ask wait for ballon be up in air before walking around in basket as many times I have been up this are the rules judge I think you should take a ride with your wife for nice date 😊 just be aware of its gose up high an its beautiful experience. An landing should go easy if weight is in middle an going up is easy going up if in middle there's no shift in basket when you are up in air they ask you to step on one side go in direction to decent an then ask to stand in middle to land all ways . People are below to tie the balloon . To safely wait an exit when permission is granted. I've seen balloons go up as people try get out an people all most get injured.

The warnings were there in writing and even verbal and she was the one that wanted a picture. Her fault judge is wrong.
