He was negligent and distracted. How did he win? She kept talking about safety. But this is a batting cage. Sports are not safe in any way. He took on a risk when he went in that cage.

The alley is for employees only....now what if an employee was in there doing "maintenance"....they would've had to be distracted and hence the same issue, just with another individual....and you need signs if areas are off limits.

While the father was distracted and shouldn't have gone in the cage to take a phone call, that doesn't rule out negligence of repair, proper signage, and safety standards from the owner. He should have lockout/tagout per se the broken cage and closed it for the day, only opening it when it was operational with new netting, as well as posted "do not enter" signs in plain sight. People are dumb, and while I agree that had a lot to do with this situation, i feel the ruling was fair.

A lot of people doesn't have common sense. They have to see it in writing, to see for themselves. If not this will happen.

Common sense is not really a defense, just like standing water, if someone is injured because you forget to put the “standing water” sign, then you might be negligible for the injury

I think what this show does is demonstrate the difference between law and emotion. Emotionally, we do not appreciate the decisions he makes, but legally they are grounded.
The law does not respect feelings as basis for fault or interest of injured parties. You don't have to like his decisions, but you can't say as a blanket statement that he doesn't make the best decision on areas of law where he may not even have the say he'd like to have. That's the tough part about being a judge.

Not watching this show again .His own child was at fault and through his own stuiped need to use the phone in a place where he shouldn't have been. These kind of people put places out of business. I think his own son should have been at fault.

This case shows that we must properly repair something the correct way. This case shows that the defendant Mr. Jones didn't properly repair the net properly. Secondly, there were no signs at the place. Even though the ball was from Mr. Donaldson's son, the net should've not let any baseballs go through.

The problem with this is that the guy saw that the net was in disrepair and still expected it to work properly. there are many other cases where this same judge has made decisions against people because they knowingly went somewhere unsafe. This is why the decision makes no sense and also displays that the show has 0 consistency.

This Judge has not established the direction of the ball for which direction it came from, Passing on Judgement because of the Crocodile tears of the women is actually wrong and should be looked into.
There was a lot of acting on the husbands part. The walk to the board and back had been well rehearsed.

This episode is just another that proves how Ill knowledge this judge is. First: Alleyway was not for customers. That automatically puts the husband at fault. Second: nets. Even if they are made to be safe, can break. There was at no time mentioned that the ball went through a pre-Existing hole that was taped up. So the ball going threw the net would as well be on the husband. More so the son but the point is the husband oils that get a cent.
Third: the netting fix IS a regulated fix. There is a certain time that you will have to chnage it, but at no time was this discussed or mentioned. Heck, we don’t even know how bad the net looked.
Overall the husband is at fault for his own damages.
Based on real court cases.The knowledge of the law , is the judges decision. Regardless of what the public think , I believe every state in the USA has different laws. How ever, the owner was found negligent. The corridor was for employees I believe, according to you , they would never be safe, the net was faulty and the door left open. Negligence on the owners part
Also programs rarely give the full picture, court cases can go on for days, this was 20 minutes at most
We do know how bad the net was because the ball went through it and caused catastrophic injuries. Had it been a small child, it would have been fatal.
@@sue3028 judgment is based souly on the laws. Sentencing is the same. Think about it as a standard. Judges can do more or less depending on the circumstances but they always have to abide by the laws at a minimum. No feelings and emotions can dictate a ruling. Even if that feeling seems logical.
If the verdict/ruling was found to not subside with written laws and is proven to be bias on feelings and emotions, the case can either be thrown out or re-evaluated and the judge can/would be charged and even prosecuted
Infact many cases have been taken to court and the stadium/ facility found guilty of not protecting spectators adequately. The judges refusing to accept that spectators go at their own risk, while owners provide shoddy safety

The difference is what is leagally required and he did not have a sign labeling employees only and the fact the net did not stop the ball from hitting the guy is the owners fault plus there was no faking the injury if the owner himself admitted that the victim was bleeding and the fact is that this isn’t the first case where something similar happened so get off your high horse the judge is required by law to follow the law

The judge is creepy with this judgement.
I think it was the right decision. The safety net did not do the job it is supposed to, it had already had a temporary repair that clearly was not strong enough. The other cages were empty...this cage could have been closed off until proper repairs were done. Also, the guy left the cage to take a phone call, and walked into what he though was a viewing area. There were no signs posted, and clearly no staff said he was in the wrong spot until after the fact. The gate was wide open. How was he supposed to know not to enter that area? Remember, HE LEFT THE CAGE TO TAKE THE PHONE CALL, the incident happened OUTSIDE of the cage, in an unmarked area that was though to be a viewing area. All the guy did wrong was to be distracted on his phone. If the gate had been shut, this would not have happened. If the walkway was signposted "Staff Only", this would not have happened. If the safety netting had been repaired properly, this would not have happened. If this cage had been closed off and another one used, this would not have happened. Too many failures to prevent on the side of the cage owner.

This batting cage had negligence all over it. Not only did he not have signs up, there was gates left open. And even if he did have signs up and the gates closed an employee could have still gotten injured so his safety protocols are bad from the start. How are employees suppose to protect themselves. 🤔
This is a horrible ruling, if you wanted a fair trial, you should have brought in a safety expert instead of a medical professional. She was after the money, nothing more. I believe the business man, maybe it was her mouth that drove their relationship to pieces.

This judge doesn't know how to handle cases, he based his judgement on emotions that the actual facts on the table...im close to abandoning his show completely. I think he should take notes from other judges such as Judge Judy....that woman judge cases fairly than this man.
