    ST. ANTHONY - During a hearing at the Fremont County Courthouse on Tuesday morning, prosecutors in the Chad and Lori Daybell murder case made their arguments about bringing in a jury from Ada County rather than moving the entire trial across the state.
    The Daybells are charged with multiple crimes, including first-degree murder and conspiracy to commit murder. The charges concern the deaths of 7-year-old Joshua “JJ” Vallow, 16-year-old Tylee Ryan - two of Lori’s kids - and Chad’s first wife, Tammy Daybell.
    The trial is set to begin in January at the Ada County Courthouse in Boise and is expected to last up to 10 weeks. The number of people listed as potential witnesses in the case is 104.
    Officers, media representatives and several spectators watched as the hearing got underway. Seated next to his attorney, Chad was dressed in a white shirt and blue tie. He said nothing and showed no emotion.
    District Judge Steven Boyce ordered months ago that the trial will be moved to Ada County so a fair, unbiased jury can be selected. But earlier this month, Madison County Prosecutor Rob Wood and Fremont County Prosecutor Lindsey Blake filed a motion urging the court to follow Idaho code 19-1816 by transporting a jury to Fremont County. The statute outlines several reasons jurors can be brought in from another county, one of which is for economic purposes. That was the entire focus of Tuesday’s hearing.
    Blake was in attendance, along with special prosecutor Rachel Smith.
    “The defendant picked the venue when the bodies were buried on his property and he killed Tammy Daybell,” Smith said in her opening statement.
    Daybell’s attorney, John Prior, noted Boyce has already made his decision about where the trial will take place. He says his client has a right to a “fair and impartial trial,” and the cost of a legal proceeding “is not the overriding factor.” He asked the court to dismiss the hearing, which was denied.
    Fremont County Clerk Abbie Mace was called as the first witness and appeared via Zoom. One of her responsibilities includes overseeing court clerks and managing the budget. She addressed the costs involved in lodging, feeding and transporting a jury and other personnel during the trial and the method used in determining those numbers.
    She said it will cost significantly less to sequester a jury in Fremont County versus Ada County.

    John Pryor gets on my last nerve .He acts like he is the judge while Chad does deserve a fair trial. Tammy and Charles and the kids deserve justice . Justice for the Victims .

      Of course they do but this is one issue that the state has little leg
      and Daybell's Attorney is 100% correct. That right is not to be violated by our emotions but a must.

    I love this prosecutor..she said Chad you picked the trial location when you killed your wife and buried the kids on your property!!!!! I'm glad she said what we all know and are thinking out loud!

      I need to look up her track record 😩 her amount of “um” and “uh”s concern me for some reason. Also the sequestered jury route doesn’t feel right based on historical trials…. 😭

      @Overeducated and Overcaffeinated agreed… the closest experience I’ve ever had (plz excuse how ignorant this is going to sound lol) is debate teams and public speech classes. One of the things they drilled into us was to not use those filler words. So maybe it’s just a thing I’ve learned to be diligent about with others 🤷🏻‍♀️

    If Chad Daybell and Lori Vallow had even an ounce of decency left in them, they would own up to their murderous acts and pay the price for the lives they stole. To watch them plead 'not guilty' to the murder charges is just despicable! With the amount of evidence that has piled up against them over the past few years, it just goes to show how much these two love the attention and fame, even if it is negative.

    It's pathetic that a dime has to be spent on this murder, we all know it's a little difficult to have children buried on your property without your knowledge, never mind his wife's murder. That is pure 😈 sitting there. What was done to these kid's was absolutely disgusting. Lori is guilty as well they were her children, she was responsible for them.

      Knowing isn't murdering. We don't know who did the killing or dismemberment or burial or anything. That's what a trial is for, not just to determine guilt, but to determine the appropriate punishment for specific crimes commited after hearing all the evidence.

      It doesn't matter whose hand ended their lives. The kids bodies were on his property so he knew about it. She obviously knew they were dead as they were not sleeping in their beds. She never reported them to the police as missing. But Chad said they were all Zombies Charles and the kids so it's ok with her So yeah they're both guilty!!! She still wants to be referred to as Mrs Daybell so it's not like oh he told her they were safe somewhere and when they found the bodies she realized he had betrayed her and killed her kids nah!!

    His commentary characterizing the judge’s decision as “backhanded”, statements about “I shouldn’t even have to deal with this”, and exasperated snubbing of a witness as “just a clerk”, came off as rude and unprofessional from my point of view.

    You go get him Rachel!! Where she said the defendant already chose jurisdiction when the bodies were hidden on his property and when he killed Tammy Daybell!! I already love her. My heart goes out to Anne, Larry and Kay and the rest of the family. As Larry said it was all about lust and money. Just a senseless act!! The day is coming that Charles, Tammy, Tylee and JJ will be sitting front and center in that courtroom when they read their verdicts on the Mr and Mrs. And that is the day they will rejoice in victory!!!

    Chad always looks and walks as if he's about to fall over on his face. I think he will. He had plans on throwing Lori under the bus but now that idea is out. Lori will be throwing him under the bus instead. He may even plead guilty in return for avoiding the death penalty and testifying against Lori. He might be wise to do so. The circus is on! However, if one has followed this case over the past year or two, JJ's name has been mentioned far more in the various reports, posts, videos etc. Tragic for both of them. Trusting that justice will prevail. To try and suggest that "some other dude did it" is going to be a big ask. Just hope that the prosecution doesn't blow it as they did with the Barry Morphew case.

    I don't know what kind of a man Charles was. But from what I can gather, he was very generous, hardworking and kind. He certainly did not deserve to be murdered.
    Looking at Mr Daybell - goodness knows what Lori saw in him, and how they manipulated each other's egos into this awful, awful series of events. But - and forgive this shallow comment- Charles looked and seems 10 times the man Chad appears. He looks like a man who had a lot of shortcomings and needed a way to elevate himself because of them.
    And LDS created a platform for him to stand on. Delusions upon delusions.
    So, so tragic.
    My condolences to all the family and all who are affected by these crimes.

    My heart goes out to everyone affected by this horrific tragedy. Those children suffered and it makes me so angry. When I listened to JJ’s grandmother Kay cry her eyes out this morning it completely broke my heart. I want to come thru the TV and hug her. I am so glad she has her husband they are an amazing team. Chad and Lori deserve to be under the jail and anyone that helped like both Melanies should be locked up for their bs lies. This story is so horrific and beyond evil. How this low

      The change in venue is already decided. On 10/8/21 Judge Boyce granted the change of venue and on 10/21/21 the Idaho Supreme Court approved the change in venue and moved it from Fremont County to Ada County. They aren’t arguing about the change in venue. The prosecution is arguing that it will cost too much money for all the Fremont County resources to be transported to Ada County and given a daily food allowance and daily lodging allowance for the estimated 10 week trial. The prosecution is trying to argue that it would be less expensive to pick the jury in Ada County but transport all of them to Fremont County and pay their daily food and lodging and also keep them sequester for the full trial, estimate of 10 weeks.

I just have to observe, in watching this, what an angry man the defense attorney appears to be. How he can be so belligerent regarding the actions of his client, is beyond me.

In view of the publicity this case has attracted, all over the world, Prior has to do his very best, otherwise Daybell could appeal on the grounds of poor representation. Nobody wants that outcome.

I know he'll be in a protected wing , or whatever it's called , but I hope there's a way of getting in there. I must admit I had to look him up as I didn't recognise the name at first. EIGHTEEN YEARS he was working with children. EIGHTEEN. Imagine the victims mental health. How could someone not see they were acting differently after these encounters. They had to be. It's 101 in the signs of what to look out for when your in charge of an innocent child because the child won't tell. I was a scout leader a few years back and a child welfare team came in to tell us about the signs to look for in the children both male and female .it's a tool I use even now even though my son is 33 years old and married and my daughter is 26 years old and engaged but I watched their behaviour when they were little and then teenagers. Thankfully they were fine but it's no harm to watch and the people they were around.
      I could never defend a person like that. But Shannen Smith seems cold enough. 🙏 and justice for Tylee 🙏 and justice for little JJ 🙏 and justice for Tammy Daybell the ONLY Mrs Daybell 🙏 and justice for Charles Vallow and 🙏 and justice for Larry and Kay and Keisha. I only see Larry and Kay advocating for Tylee. I don't see HER grandparents showing up at every court date. Sorry for the novel I've just written ❤😁

    It’s so much money has been dumped into this case before its gone to trial , and to require the county to absorb an enormous Amount of funds to have this case moved to another county is wrong . Bring an outside jury in that makes sense.
