  • The plaintiff put down a deposit on an apartment, but the defendant changed her mind and rented the place to someone else. The defendant refuses to return the deposit, so the plaintiff is suing. The defendant insists the plaintiff was the one who changed her mind. Therefore, the defendant believes she owes nothing.

      @KyleSorenti she had a verbal contract which was entered into with the acceptance of her original deposit, the plaintiff didn't need to learn anything she was already in the right, right?

      @@joshmpbf I dont think she understands that a deposit is non-refundable, regardless if there is a signed contract in place. The refundable aspect was null by the defendant asking for more but Plaintiff didnt really understand she would’ve been out the deposit had not been for the ask of an extra $250

    That lady is SHADY with a capital S!! She really tried to extort them and then turned around and kept $500 dollars!! They dodged a bullet because no telling what esle she would have done once they moved in. The deposit was to hold it for them and I really don't think it was another couple trying to rent it out because I could have swore she said she didnt rent it out until December!! Anybody else catch that!?

    I've seen this a bunch lately where someone thinks that a "nonrefundable deposit" means nonrefundable even if I don't provide the service. "Nonrefundable's right in the name, as soon as it hits my hands, regardless of the situation, I don't have to give it back." Can you imagine how screwed we would all be if that was how things worked. You can't take money from someone, not fulfill your end of the contract, and keep their money. That's not how things work. And for the record, she kept showing that wage form as a second excuse why they shouldn't get the apartment. If she'd made a contract with them to give them the apartment and then tried to back out AFTER the fact because they don't make enough money, she would ALSO have to return the deposit. It's your responsibility as a landlord to check those things first. That's why legitimate places have application fees and stuff. That woman probably would have been a pain to work with anyway. A BIG bullet dodged.

My youngest kitten struggled through the winter , because the clan bullies him so he became a skittish scaredy cat who always ran and hid from me, so he never came inside.....so it was 1am and he was crying outside my window. It took him almost freezing to death for him to allow me to pick him up. 😢.....I took him into bed with me, and he shivered for two hours before he finally fell asleep. Then I set up a bed for him, with a heating pad, under my table where I sit a drink coffee/watch PC/do everything else that I do. And if I go into the kitchen, he follows me and sits on my feet while I cook and clean. 😊....but his dang grandma! She's such a meanie! She growls and smacks at him whenever she walks by. She's in trouble, all day long.....

    If a landlord could keep a non-refundable deposit AND be the one to break the agreement, then I'd never have to work again. I'll just take deposits all day, then break the agreement myself to keep the deposits.
