  • The plaintiff brought her car into the defendant's shop for repairs. However, it took the defendant more than 100 days to fix because a seatbelt was on back order. The plaintiff waited for proof so her insurance would cover her rental car, but the defendant failed to provide it. The plaintiff is suing for the rental car cost. The defendant insists he notified the insurance company, and they approved the plaintiff for the rental car reimbursement. It's not his fault the plaintiff kept the rental car longer than she needed to.

      I could have sworn that he was trying to give her the paperwork that proved when he ordered the seatbelts from the very beginning. What he didn’t have was the proof that the company he was getting the seatbelts from had them on back order. The company wouldn’t supply him with that information.

    I'm the Parts Manager at a Collision Repair Shop and we've had parts on all Makes and Models go on long National Back Orders. I have a Muffler Assembly now, for a Toyota, that has been on backorder for over a year. We completed the rest of the repair so that the customer could driver their vehicle until the muffler came in off of backorder. With seatbelts there is a safety issue, so placing the customer back in the vehicle once the repair was started, would be a liability issue on the repair facility.

      I don’t know what year the Toyota is but couldn’t you just find a muffler at a junk yard for cheap and temporarily install it until new one comes in?

      You could, but who is going to pay for it? Used parts my be cheaper, but they're still not free. A repair shop is not going to pay for any parts if they don't know if the part will be paid for by either the customer or the insurance. Some shops and Insurance companies will not put certain used parts on anyway, due to the manufacturers repair proceedures.

      @@ckells that requires going down to the junkyard probably pulling it yourself, paying for it, installing it then uninstalling it and reinstalling a new one. No insurance company is gonna pay for all that.

      I was hit a few years ago and I needed a new rear panel and tail lights I had to wait three months for those two pieces luckily I was able to drive it in the meantime though.

    I had this same issue my bumper was on back order for months. Rental bill was almost 7k. Shout out to Navy Federal because when Enterprise tried to come after me for the bill I made one call and they took care of it

    This is just another example of how insurance companies work a period insurance companies are nothing but extortionist. Yes I said it they want you to pay the premiums on time and they want their money every damn month but when it comes time for them to take money out of their pocket for you because you pay your premiums on time every month they find every excuse in every loophole that they can find to their advantage for them not to pay you. They make you get stressed out they make you jump through hoops for something that they should be doing as just being human

    Insurance companies just do a hand slap on these cases. The real problem is that in the US you can be liable for a certain percentage of the cause of an incident. In Europe, you are either 100% liable or 0%.

    Back ordered parts are not the shop’s fault nor the insurance companies’ fault. Make sure you have enough rental/ loss of use coverage on your policy otherwise you are responsible for the rental charges. If an insurance company makes exceptions on rental coverage limits for back ordered parts, follow up with the insurance adjuster to make sure they verified parts were back ordered and that they will pay on your behalf.

    I honestly feel like the plaintiff is sue happy. Insurance companies push the auto body shops to get the car done. He is absolutely correct when he says he cannot release the vehicle without the seatbelts. The longer the car sits in the shop, the shop owner is losing money, and the insurance company runs the risk of losing money.

      If he didn't submit the proper paperwork for the rental extension then she had a legitimate grip. Now she has what she needs, why should she be out all that money and why does it make her sue happy?

      @@lindseyyoung9149 the longer the car is in the shop, the larger the rental bill becomes. Insurance companies try to limit those costs. Most of the times they do that by allowing a body shop to put used parts on a vehicle because they are easier to come by and cheaper. In this case, a seatbelt is a safety device and cannot be secondhand. I’ve been in the industry a long time. I’ve dealt with many insurance companies. She didn’t need to sue the business owner. She needed to push the insurance company.

    He could easily have provided this information along time ago out of court instead of wasting everyones time. Then on top of it, he tried to scam her out of money that the insurance company was suppose to pay 100% fully. Stay clear from this shop thats for sure.

    Judge asked the defendant why he released the car to her if she still owed money. Can a mechanic legally refuse to release the car if you still owe money? Isn't that auto-theft? My ex-wife picked up my son's car {he lives with me-his father as opposed to his mother} and the mechanic who is my fellow congregant at our church let her take it before I got there to pay. He knows that I will pay, but he released the car before it was paid for. By the way, my ex-wife and I were disputing about how much each of us should pay. She was being difficult as always. But in the end I paid the mechanic shop.

      It depends on state law. In Colorado, that isn’t allowed. A mechanic must release the car, they can’t withhold it. The mechanic’s remedy is a ‘mechanic’s lean’ which puts him 1st in line to get paid if the car is sold. That said, they still refuse to release the car until the bill is paid, and the customer must sue to get the car back. But a judge will not order the car released until they pay the mechanic. So in reality, the law here doesn’t really help the customer if the mechanic refuses to release the car.

      If they have on their estimate paperwork that all repairs must be paid in full before the vehicle is released to customer and the customer signs it before they leave with the estimate then the mechanic can keep the vehicle until the owner pays up. I think there also has to be a line about deadlines and how long they will hold the vehicle without payment before taking recovery measures, which I think is sometimes as short as 3 months. The mechanic or tow company usually has to send out registered letters a couple times before going to the courthouse too.

    I've got a feeling that this lady is going to be in court again with her lawyer, suing Allstate for punitive damages for being scumbags. I'm actually looking for a new auto insurance company at this time.

      She didn’t cause the accident and she followed due process and came prepared unlike the defendant who clearly didn’t do what he was supposed to do before coming to court… then retaliating. Rewatch the episode if you didn’t understand it
