  • The plaintiff brings her sister to court. She claims her sister stole their mom’s life insurance money after she died and used it for vacation rather than paying or the funeral. She’s suing for funeral costs. The defendant argues the plaintiff was trying to gain power of attorney over their mother’s estate by putting her in a nursing home. She doesn’t think she owes her sister because other people contributed to the funeral costs.

    What is the purpose of have a life insurance policy if the beneficiary isn’t going to use it towards your final expenses? That’s not supposed to be a come up for the beneficiary.

      You usually don't get the life insurance money until after the funeral. So you have to pay out the expenses...and sometimes the insurance money isn't a lot.

      That’s exactly why these insurances should be paid out to the funeral home.
      Only after the funeral expenses are paid in full, any leftover money can then be transferred to a ‘heirs of [name of deceased]’- bank account and then that becomes part of the inheritance.
      That’s how it is in my country.

      In thinking of my mother’s funeral…tbh, life insurance is paid to the beneficiaries and they can do what they want with it. Most people have the candor and care to use it appropriately. And then others…🤦🏾‍♀️🤦🏾‍♀️. The only policy that most be used for funerals burial insurance

      @@ddinottia39 That isn’t true. The beneficiary contacts the life insurance company and put them in contact with the funeral home. The check is sent to the funeral home and any remaining proceeds goes to the beneficiary.

    The law should make it so that funeral costs should be deducted PRIOR to disbursement of inheritance. Sadly,in a lot of cases the beneficiary is the least to honor the deceased.

      As it is in the UK, the inheritance is not distributed until the funeral expense are paid first.

      I would say most always that is the case. BUT if there is life insurance with a specific beneficiary, that is not part of the estate. The mother should have left a will, or she could have named the estate as beneficiary.

    Defendant should have used that money to help pay for the funeral, then divided whatever was left between the three siblings. That would have been the fairest thing to do.

    A lot of people say they would NEVER sue a family member. Those people probably have DECENT family that wouldn't screw them over to begin with. Cases like this make me want to give everyone in my family a huge hug, just for being kind and thoughtful human beings. I can't imagine how I would feel if money meant for a funeral(of a family member) was spent on a vacation. That's devious.

      You’re blessed darling and cherish this always. My mother passed 5-29-2020 after 4wks of cancer. Two of those wks were in the hospital at height of covid, aka no visits. My mother’s son did not go to her funeral over not getting a $500 car. You read that right.. He could have visited her 24hrs before she passed and was a no show. Rest Easy Mommy and know I love you 💔

    I know someone whose father died and soon after his siblings came to take the father's houses from him. He kept proof for many years showing that he bought the houses for $50 each from the father. They stopped talking to him.

      Had something similar with our family except my dad bought my grandma a house that she lived in for 30+ years and everyone benefited by staying there at some point (never contributed mind you). When grandma got too sick to live by herself everyone thought they were going to get a piece from the house. They haven't spoken to me or my dad in years. Not to mention they had been using her money years prior

      I try to tell my clients,
      Let’s make sure we make it clear, what’s going on because children act real different, after the parent has passed, and all of the parents say ‘not my children’.
      But I think I’m going to search for statistics about court cases, and how people behave to get it through my clients head, that a relationship between a child and a parent is not the same as a grieving sibling child that’s left behind and bitter.

      Not everyone desires a funeral/memorial service. One can be cremated for less than $1K and that be the only expense incurred. Life insurance isn't for final expenses, it's for whatever intention the policy holder intends it for. If one chooses to use it for final expenses, then okay, but that's not the only purpose. It's a shame folks only think of final expenses when it comes to life insurance. Other benefits include leaving a legacy and having the beneficiary do as they wish with the funds.

    My mom didnt leave any will.
    I had to retain a lawyer and my brother & my niece totally showed out.
    Meanwhile I got the lawyer for everyone. $$ was split three ways and got still attitudes..
    Haven’t spoken since!!
    I did what was supposed be done for funeral & burial of my parent..

    If there was a life insurance policy in place, why are you getting contributions from family and friends for your mother's funeral. That's why they get a life insurance policy so you don't have to worry about that expense.

    All 3 sisters don't have shit being grown women. I feel sorry for MoMA dying in a nursing home and they are fighting over funeral money. When I buried my parents; I had siblings that took my parents belongings & house because they were financially irresponsible & greedy. I didn't worry because I was financially secure in my own right.

    I went through something similar with my two siblings when my Mother passed. I’m the youngest in the family my siblings really killed me along with my Mother, then when it there evil ways backfired they decided to resurrect me back into their lives. I have let bygones be bygones. However it’ll never be the same. My advice for any person is make sure all of your business is taken care of before you pass, and we’re all gonna die, there’s no exceptions. Make sure everything is understood to the survivors so everyone can mourn and move on with life. It makes everything easier. That’s if you care.

    Many years ago my mother bought a plot and headstone for herself, my stepdad did the same. They were side by side. This was in the early’80’s. Stepdad died first in the state the plots were purchased in.
    15 years later my mother died. She was NOT in the state the plot was purchased in. For the body to be released from the funeral home and taken to the local airport, transferred to the plane, flown to the state the plot is in and transported to the burial site was around $7,000. I had to pay it that moment or the funeral home would not release the body. All of this to say, prepare for funeral arrangements BEFORE something happens, otherwise family members become responsible and it can run them into huge debt. I’m still paying it off.
    My wife and I have everything paid for NOW. Paperwork in order, home paid for, both vehicles paid for . When we’re gone, our children are taken care of in a will.
    Avoid emotional messes like what we see here.

    As the beneficiary of an insurance policy, you have no legal obligation to pay for the funeral unless stated by the policy, but morally you should.

    I love how the sisters are like, "That's my sister! I love her." No malice in the suit. They just needed an impartial 3rd party to help them figure things out. Call you in the morning 😅

    I think there’s a misunderstanding about how life insurance works. I’m a licensed insurance agent and man these case makes me sad.

    Me & my siblings dodnt have any issues when our parents passed away. We used the insurance polices for their funerals and when we needed additional funds for mom; her favorite nuece paid the balance. Life is short! Dont fall oyt with family during your grief. So sad for this family.

    I think both sisters mishandled their mother's money. You can tell they have deeper issues than this money because it's 3 of them and not one word is spoken on what the other sister has done for the mother while alive or her funeral.

    Something similar happened to me. My mother had a 50k life insurance policy. She left my sister as the beneficiary. Not long before her passing, she was telling me that she was thinking of changing it to me because she wasn’t sure my sister would do right.
    Fast forward. My sister used the money to pay for the funeral. She gave me and my brother 3k each. When we questioned her about splitting it evenly, she said she needed it for her kids private school tuition. A week later Facebook posts where she was on vacation.
    My brother was so angry. He wanted me and him to confront her together and bully her into doing what was right. But I wouldn’t do it. I knew how she was. She would’ve never budged and did what was right.

    Fighting over $5K. Both sisters are disgusting. The mother's estate was not worth fighting over. Both were greedy because neither one EVER gave the judge a clear answer to any of the financial questions. This poor mom had some sorry daughters.

    My mother was illiterate, in 2002 my mom passed away. Our younger ½-sister had our mother to sign over my step-dad (her dad) $50K life insurance policy that he left to our mother and she even had mon sign over the $250.⁰⁰ burial expenses that was received from Medicare. She stole our mom's jewelry, even the jewelry mom received from my bio-father.
